But even having a will is not necessarily enough to avoid a costly and contentious legal dispute.<\/p>\n<p>Consider what happened after <a href=\"https:\/\/www.cbsnews.com\/news\/jimmy-buffett-cause-of-death\/\" target=\"_blank\" rel=\"noopener\">Jimmy Buffett died of skin cancer<\/a> at the age of 76 in 2023. The singer and entrepreneurial founder of the Margaritaville brand ordered in his will that his fortune be <a href=\"https:\/\/www.investopedia.com\/terms\/t\/trust.asp\" target=\"_blank\" rel=\"noopener\">placed in a trust<\/a> after his death. To manage the trust, Buffett named two co-trustees: his widow, Jane Slagsvol, and Richard Mozenter, an accountant who had served as the singer\u2019s financial adviser for more than three decades.<\/p>\n<p><a href=\"https:\/\/cdn.theconversation.com\/static_files\/files\/3829\/Jane_Buffett_-_trustee_removal_petition.pdf?1750099972\" target=\"_blank\" rel=\"noopener\">In dueling petitions<\/a> filed in Los Angeles and Palm Beach, Florida, in June 2025, however, Slagsvol \u2013 identified as Jane Buffett in her legal filing \u2013 and Mozenter are both seeking to remove each other as a trustee.<\/p>\n<p>The outcome of <a href=\"https:\/\/www.nytimes.com\/2025\/06\/05\/arts\/music\/jimmy-buffett-jane-estate-lawsuit.html\" target=\"_blank\" rel=\"noopener\">this litigation will determine<\/a> who gets to <a href=\"https:\/\/www.wealthmanagement.com\/estate-planning\/legal-battle-over-the-control-of-jimmy-buffett-s-275m-estate-heats-up\" target=\"_blank\" rel=\"noopener\">administer Buffett\u2019s US$275 million estate<\/a>.<\/p>\n<p>As <a href=\"https:\/\/www.law.virginia.edu\/faculty\/profile\/nrc8g\/2915359\" target=\"_blank\" rel=\"noopener\">law professors<\/a> who <a href=\"https:\/\/law.rutgers.edu\/bio\/weisbord\" target=\"_blank\" rel=\"noopener\">specialize in trusts and estates<\/a>, we teach graduate courses about the transfer of property during life and at death. We believe that the Buffett dispute offers a valuable lesson for anyone with an estate, large or small. And choosing the right person to manage the assets you leave behind can be just as important as selecting who will inherit your property.<\/p>\n<p>Buffett\u2019s business empire<\/p>\n<p><a href=\"https:\/\/vailgardnerlaw.com\/estate-planning\/how-much-is-jimmy-buffett-worth\/\" target=\"_blank\" rel=\"noopener\">Buffett\u2019s estate includes<\/a> valuable intellectual property from his hit songs, including \u201cIt\u2019s 5 O&#8217;Clock Somewhere,\u201d \u201cOldest Surfer on the Beach\u201d and \u201cCheeseburger in Paradise.\u201d Buffett\u2019s albums have <a href=\"https:\/\/dos.fl.gov\/cultural\/programs\/florida-artists-hall-of-fame\/jimmy-buffett\/\" target=\"_blank\" rel=\"noopener\">sold more than 20 million copies<\/a> worldwide and continue to generate some $20 million annually in royalties. Buffett also <a href=\"https:\/\/www.wsj.com\/real-estate\/luxury-homes\/jimmy-buffett-homes-002cf031\" target=\"_blank\" rel=\"noopener\">owned a yacht<\/a>, real estate, airplanes, fancy watches and valuable securities.<\/p>\n<p>In addition, he owned a 20% stake in <a href=\"https:\/\/www.nytimes.com\/2023\/09\/05\/business\/jimmy-buffett-margaritaville-business.html\" target=\"_blank\" rel=\"noopener\">Margaritaville Holdings LLC<\/a>, a brand management company he and Slagsvol founded in the 1990s. <a href=\"https:\/\/www.cnbc.com\/2025\/06\/13\/jimmy-buffett-estate-family-trusts.html\" target=\"_blank\" rel=\"noopener\">Margaritaville owns 30 restaurants and 20 hotels<\/a>, along with vacation clubs, casinos and cruise ships. It also sells branded merchandise. <\/p>\n<p>According to Slagsvol\u2019s petition, Buffett\u2019s trust was set up to benefit his widow. Slagsvol, who <a href=\"https:\/\/www.yahoo.com\/entertainment\/jimmy-buffett-wife-jane-slagsvol-221827527.html\" target=\"_blank\" rel=\"noopener\">married Buffett in 1977<\/a>, is one of two trustees of that trust, which is required to have at least one \u201cindependent trustee\u201d in addition to her \u201cat all times.\u201d That requirement is stated expressly in Buffett\u2019s trust declaration.<\/p>\n<p>Slagsvol receives all income earned by the trust \u2013 an <a href=\"https:\/\/courts.alaska.gov\/shc\/probate\/trusts.htm\" target=\"_blank\" rel=\"noopener\">estate-planning technique for giving away property<\/a> managed by a trustee on behalf of the trust beneficiaries \u2013 for the rest of her life. She can also <a href=\"https:\/\/www.youtube.com\/watch?v=zUy92DVYAYE\" target=\"_blank\" rel=\"noopener\">receive additional trust funds<\/a> for her health care, living expenses and \u201cany other purpose\u201d that the independent trustee \u2013 Mozenter, as of July 2025 \u2013 deems to be in Slagsvol\u2019s best interests.  <\/p>\n<p>The estate plan also created separate trusts for their three children: <a href=\"https:\/\/people.com\/jimmy-buffett-kids-everything-to-know-7965232\" target=\"_blank\" rel=\"noopener\">Savannah, Sarah \u201cDelaney\u201d and Cameron Buffett<\/a>, who are in their 30s and 40s. Each child reportedly <a href=\"https:\/\/finance.yahoo.com\/news\/know-legal-battle-surrounding-jimmy-112841863.html\" target=\"_blank\" rel=\"noopener\">received $2 million<\/a> upon Jimmy\u2019s death. When Slagsvol dies, she can decide who will receive any remaining assets from among Buffett\u2019s descendants and charities.<\/p>\n<p>The structure of Buffett\u2019s plan is popular among wealthy married couples. It provides <a href=\"https:\/\/www.youtube.com\/watch?v=8KpFqNbc4vY\" target=\"_blank\" rel=\"noopener\">lifelong support for the surviving spouse<\/a> while ensuring that their kids and grandchildren can inherit the remainder of their estate \u2013 even if that spouse remarries. This type of trust typically cannot be changed by the surviving spouse without court approval.<\/p>\n<p>            <a href=\"https:\/\/images.theconversation.com\/files\/677691\/original\/file-20250701-62-3o2e3v.jpg?ixlib=rb-4.1.0&amp;q=45&amp;auto=format&amp;w=1000&amp;fit=clip\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" alt=\"Rear view of female caregiver walking with retired male on footpath.\" class=\"lazyload\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/07\/file-20250701-62-3o2e3v.jpg\"  \/><\/a><\/p>\n<p>              If you\u2019re fortunate enough to reach your golden years with a sizable nest egg, it helps your loved ones if you can draft a detailed will. You might also want to consider establishing a trust.<br \/>\n              <a class=\"source\" href=\"https:\/\/www.gettyimages.com\/detail\/photo\/rear-view-of-female-caregiver-walking-with-retired-royalty-free-image\/2185761820?phrase=trust%20estate&amp;searchscope=image,film&amp;adppopup=true\" target=\"_blank\" rel=\"noopener\">Maskot\/Getty Images<\/a><\/p>\n<p>Dueling trustee removal petitions<\/p>\n<p>Slagsvol is trying to remove Mozenter as the trust\u2019s independent trustee.<\/p>\n<p>She claims he refused to comply with her requests for financial information, failed to cooperate with her as her co-trustee, and hired a trust attorney who pressured her to resign as trustee. Slagsvol also raised numerous questions about the trust\u2019s income projections and compensation paid to Mozenter for his services. <\/p>\n<p>Mozenter\u2019s petition, filed in Florida, is not available to the public. According to <a href=\"https:\/\/www.nytimes.com\/2025\/06\/05\/arts\/music\/jimmy-buffett-jane-estate-lawsuit.html\" target=\"_blank\" rel=\"noopener\">media coverage of this dispute<\/a>, he seeks to remove Slagsvol as trustee. He claims that, during his decades-long role as Buffett\u2019s financial adviser, the musician \u201cexpressed concerns about his wife\u2019s ability to manage and control his assets after his death.\u201d<\/p>\n<p>That led Buffett to establish a trust, Mozenter asserted, \u201cin a manner that precluded Jane from having actual control\u201d over it.<\/p>\n<p>Estate planning lessons<\/p>\n<p>We believe that the public can learn two important estate planning lessons from this dispute.<\/p>\n<p>First, anyone planning to leave an estate, whether modest or vast, needs to choose the right people to manage the transfer of their property after their death. <\/p>\n<p>That might mean picking a <a href=\"https:\/\/www.americanbar.org\/groups\/real_property_trust_estate\/resources\/estate-planning\/guidelines-individual-executors-trustees\/\" target=\"_blank\" rel=\"noopener\">professional executor or trustee<\/a> who is not related to you. A professional may be more likely <a href=\"https:\/\/www.cnbc.com\/2025\/06\/13\/jimmy-buffett-estate-family-trusts.html\" target=\"_blank\" rel=\"noopener\">to remain neutral<\/a> should any disputes arise within the family, but hiring one can saddle the estate with costly fees.<\/p>\n<p>An alternative is to choose a relative or trusted friend who is willing to do this for free. About <a href=\"https:\/\/lawreview.law.ucdavis.edu\/sites\/g\/files\/dgvnsk15026\/files\/media\/documents\/53-5_Weisbord.pdf\" target=\"_blank\" rel=\"noopener\">56% of wills name an adult child or grandchild as executor<\/a>, according to a recent study. Some estates, like Buffett\u2019s trust, name both a professional and a family member. An important consideration is whether the people asked to manage the estate will get along with each other \u2013 and with anyone else who is slated to inherit from the estate.<\/p>\n<p>The second lesson is, whether you choose a professional, a loved one or a friend to manage your estate, make clear what circumstances would warrant their removal. Courts are reluctant to remove a handpicked trustee without proof of negligence, fraud or disloyalty. But trustees can be removed when a breakdown in cooperation interferes with their ability to administer the estate or trust.<\/p>\n<p>Some trusts anticipate such conflicts by allowing beneficiaries to replace a professional trustee with another professional trustee.
