{"id":237265,"date":"2025-07-04T11:23:09","date_gmt":"2025-07-04T11:23:09","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/237265\/"},"modified":"2025-07-04T11:23:09","modified_gmt":"2025-07-04T11:23:09","slug":"supervisor-let-go-from-boarding-school-wins-e12k-at-wrc","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/237265\/","title":{"rendered":"Supervisor let go from boarding school wins \u20ac12k at WRC"},"content":{"rendered":"<p>A worker let go when the patron of Ireland&#8217;s only full-time Irish-language boarding school moved to taking day pupils only has secured orders worth nearly \u20ac12,000 for employment rights breaches.<\/p>\n<p>The Workplace Relations Commission (WRC) has upheld a series of statutory complaints by Ant\u00f3in \u00d3 D\u00fallaing against Gaelachas Teo, the Irish language organisation and school patron.<\/p>\n<p>Mr \u00d3 Dullaing held employment as a boarding supervisor in charge of overnight pupils at Chol\u00e1iste an Phiarsaigh and Scoil na n\u00d3g in Glanmire, Cork City until it ceased taking boarders in May 2024.<\/p>\n<p>He told the WRC he worked nights on Sundays, Mondays and Tuesdays at the school. He said that despite having nine years&#8217; service when the boarding facility shut down, he had received no notice of the closure and no statutory redundancy.<\/p>\n<p>He also claimed he was &#8220;underpaid by \u20ac20,912.67&#8221; over the course of his nine years in the employment, which he was pursuing under the National Minimum Wage Act.<\/p>\n<p>He also referred further complaints under the Organisation of Working Time Act in respect of holiday pay and annual leave, along with further alleged employment rights breaches.<\/p>\n<p>A management representative came to one preliminary hearing into Mr \u00d3 Dullaing&#8217;s complaints in January, but failed to appear before the WRC when the matter was called on again in April, the tribunal noted.<\/p>\n<p>Adjudicator Gaye Cunningham wrote that the second hearing had been &#8220;convened due to the board not having enough time to prepare for the first hearing&#8221;.<\/p>\n<p>She noted Gaelachas&#8217;s written submission that it had examined its records to see what employees were due redundancy when it decided to &#8220;suspend&#8221; boarding services. &#8220;Those entitled to receive redundancy received same,&#8221; the statement said.<\/p>\n<p>The submission stated that the organisation&#8217;s records were that Mr \u00d3 Dullaing &#8220;does not have the 104 weeks&#8217; continuous service in order to qualify for a statutory redundancy&#8221;.<\/p>\n<p>The respondent further submitted that Gaelachas had been managed by one person until May 2024, who had fallen ill and was &#8220;not in a position to assist us further&#8221;.<\/p>\n<p>The submission stated that all of the supervisors were &#8220;made aware of the decision to suspend boarding services&#8221; and that it had no record of any prior issue being raised about the rates of pay.<\/p>\n<p>Addressing the use of the phrase &#8220;off the books&#8221; in Mr \u00d3 Dullaing&#8217;s complaint form, the submission said Gaelachas did not &#8220;understand the reference&#8221;.<\/p>\n<p>Ms Cunningham noted the organisation&#8217;s written submission that it was facing multiple similar complaints from former boarding supervisors.<\/p>\n<p>She found that Mr \u00d3 Dullaing was entitled to a statutory redundancy payment on the basis of 8.9 years\u2019 service from June 2015 to May 2024.<\/p>\n<p>Based on the statutory formula under the Redundancy Payments Act, the order is worth over \u20ac5,000, but is subject to confirmation of PRSI status for the period.<\/p>\n<p>She upheld two complaints by Mr \u00d3 Dullaing under the Organisation of Working Time Act 1997 in respect of non-payment for annual leave and public holidays.<\/p>\n<p>Ms Cunningham awarded \u20ac2,000 in compensation for those two rights breaches and \u20ac270 for the economic value of the unpaid leave in each case, totalling \u20ac4,540.<\/p>\n<p>The employer was also directed to pay Mr \u00d3 Dullaing four weeks\u2019 wages, \u20ac1,080, for each of two further breaches: failing to give him a statement of employment terms following commencement of the job, and for failing to give the required four weeks\u2019 statutory notice.<\/p>\n<p>She rejected Mr \u00d3 Dullaing\u2019s National Minimum Wage Act claim on the basis that he had failed to write to his employer looking for a statement of his hours in advance of referring the complaint.<\/p>\n","protected":false},"excerpt":{"rendered":"A worker let go when the patron of Ireland&#8217;s only full-time Irish-language boarding school moved to taking day&hellip;\n","protected":false},"author":2,"featured_media":237266,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[3092],"tags":[51,897,16,15],"class_list":{"0":"post-237265","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-jobs","8":"tag-business","9":"tag-jobs","10":"tag-uk","11":"tag-united-kingdom"},"share_on_mastodon":{"url":"https:\/\/pubeurope.com\/@uk\/114794712489215356","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts\/237265","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/comments?post=237265"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts\/237265\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/media\/237266"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/media?parent=237265"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/categories?post=237265"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/tags?post=237265"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
