Justice Mini Pushkarna passed the order, Bar and Bench reported.

The matter arose after Patanjali put out an advertisement featuring Baba Ramdev, in which he questioned the authenticity of Chyawanprash of other brands in the market.

The advertisement states: “Jinko Ayurved aur Vedo ka gyaan nahi, Charak, Sushrut, Dhanwantari aur Chyawanrishi ke parampara mei ‘original’ Chyawanprash kaise bana payenge?” Bar and Bench reported.

Dabur objected to the advertisement and some of its references, which called a 40-herb Chyawanprash “ordinary”.

It was argued that the statement clearly pointed to Dabur’s product, which promotes itself as using “40+ herbs” and controls more than 60% of the Chyawanprash market. Dabur said the comment was disrespectful in three ways: it gave a wrong idea about Patanjali’s own formula, suggested that Dabur does not follow Ayurvedic traditions properly, and made Dabur’s product look inferior.

Dabur argued that the advertisement misleads consumers and reduces their confidence in a category of products that are strictly governed by regulatory standards. It said that Chyawanprash is a classical Ayurvedic medicine, which is regulated under the Drugs and Cosmetics Act, that makes it mandatory for the companies to adhere to the prescribed formulations based on ancient Ayurvedic texts.

Dabur further argued that it was both misleading and harmful to label other brands as “ordinary”.

Dabur also raised concerns that the ad suggests non-Patanjali products could be harmful to health, which could create fear and affect public safety. The company referred to earlier Supreme Court orders in contempt cases against Patanjali for similar ads and claimed that Patanjali has a history of repeating such actions.

Ashesh Mallick

Ashesh Mallick is a Sub-Editor with over three years of experience in news writing, video production.
