{"id":249893,"date":"2025-07-09T05:09:10","date_gmt":"2025-07-09T05:09:10","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/249893\/"},"modified":"2025-07-09T05:09:10","modified_gmt":"2025-07-09T05:09:10","slug":"birmingham-venue-given-green-light-to-serve-alcohol-18-hours-a-day","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/249893\/","title":{"rendered":"Birmingham venue given green light to serve alcohol 18 hours a day"},"content":{"rendered":"<p>Applicant Kelvin Ikechukwu applied for a premises licence for 042 Bar and Restaurant in<a href=\"https:\/\/www.expressandstar.com\/news\/local-hubs\/birmingham\/\" target=\"_blank\" rel=\"noopener\"> Soho Hill,<\/a> which he said would provide a \u201ccontrolled, sit-down <a href=\"https:\/\/www.expressandstar.com\/entertainment\/food-and-drink\/\" target=\"_blank\" rel=\"noopener\">dining<\/a> environment\u201d.<\/p>\n<p>But the application, seeking permission to sell alcohol from 9am to 3am seven days a week, attracted concern from a number of residents.<\/p>\n<p>One, who attended a recent licensing meeting, argued some residents felt a venue selling alcohol until 3am was \u201cnot at all appropriate locally\u201d and said it was close to Villa Road, which he described as an \u201cantisocial behaviour hotspot\u201d.<\/p>\n<p>He said he feared granting the application would create \u201cthe risk of further enhancing and enabling that hotspot of disorder\u201d.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/07\/0fc1f026-15b8-4a7a-9384-11a6e34d2487.jpg\"   alt=\"The site of 042 Bar and Restaurant in Soho Hill, Birmingham in June 2024. Taken from Google Street View.<\/p>\n<p>But Duncan Craig, a lawyer representing Mr Ikechukwu, said there was nothing to tie the application to antisocial behaviour and West Midlands Police was \u201ccontent\u201d with the application after conditions were agreed.<\/p>\n<p>The conditions included ensuring there was CCTV on site and that door staff were deployed from 11pm.<\/p>\n<p>Mr Craig said representations about existing late-night establishments were \u201ccompletely irrelevant\u201d and there was no evidence to suggest the premises would create an unsafe environment.<\/p>\n<p>The applicant previously said 042 Bar and Restaurant was \u201cnot an off-licence or takeaway outlet\u201d and alcohol consumption would be strictly on-site.<\/p>\n<p>\u201cIt provides sit-down dining and drinks in a controlled, mature environment,\u201d Mr Ikechukwu wrote. \u201cThe clientele is predominantly African (Nigerian), aged between 30 to 60, who are more likely to engage in calm social dining than disruptive behaviour.<\/p>\n<p>\u201cThis differs significantly from the typical late-night bar profile that attracts younger, high-risk patrons.\u201d<\/p>\n<p>He said the proposed late hours \u201cdo not imply a party venue or club atmosphere\u201d.<\/p>\n<p>\u201cRather it reflects the cultural tradition of evening dining and socialising common in African communities,\u201d he wrote.<\/p>\n<p>He said dispersal would be managed by trained staff and there would be \u201cclear signage\u201d advising patrons to leave quietly.<\/p>\n<p>\u201cNoise will be controlled through internal acoustic insulation and keeping doors closed during evening service,\u201d Mr Ikechukwu said.<\/p>\n<p>The council\u2019s public health team withdrew its written representation before the meeting.<\/p>\n<p>Members of the licensing sub-committee decided the application could be granted together with the conditions agreed with the police.<\/p>\n<p>\u201cThe members were satisfied any potential for issues had been sufficiently addressed in the application and new conditions,\u201d the decision notice read.<\/p>\n<p>\u201cThere was a proper focus on the promotion of the<a href=\"https:\/\/www.birmingham.gov.uk\/licensing\" target=\"_blank\" rel=\"noopener\"> licensing objectives<\/a> and a responsible style of trading had been proposed.<\/p>\n<p>\u201cNothing in the written representations, or the submissions made in the meeting, had evidenced a threat to the upholding of the licensing objectives.\u201d<\/p>\n","protected":false},"excerpt":{"rendered":"Applicant Kelvin Ikechukwu applied for a premises licence for 042 Bar and Restaurant in Soho Hill, which he&hellip;\n","protected":false},"author":2,"featured_media":249894,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[7820],"tags":[855,748,58860,393,77,786,4884,8823,379,12,16,15],"class_list":{"0":"post-249893","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-birmingham","8":"tag-birmingham","9":"tag-britain","10":"tag-dining-out","11":"tag-england","12":"tag-entertainment","13":"tag-food-and-drink","14":"tag-great-britain","15":"tag-ldrs","16":"tag-local-hubs","17":"tag-news","18":"tag-uk","19":"tag-united-kingdom"},"share_on_mastodon":{"url":"https:\/\/pubeurope.com\/@uk\/114821553809855448","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts\/249893","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/comments?post=249893"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts\/249893\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/media\/249894"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/media?parent=249893"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/categories?post=249893"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/tags?post=249893"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
