{"id":265322,"date":"2025-07-14T22:25:32","date_gmt":"2025-07-14T22:25:32","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/265322\/"},"modified":"2025-07-14T22:25:32","modified_gmt":"2025-07-14T22:25:32","slug":"us-supreme-court-allows-trump-to-resume-gutting-education-department-us-supreme-court","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/265322\/","title":{"rendered":"US supreme court allows Trump to resume gutting education department | US supreme court"},"content":{"rendered":"<p class=\"dcr-16w5gq9\">The <a href=\"https:\/\/www.theguardian.com\/us-news\/us-supreme-court\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" target=\"_blank\" rel=\"noopener\">US supreme court<\/a> on Monday cleared the way for Donald Trump\u2019s administration to resume dismantling the Department of Education as part of his bid to shrink the federal government\u2019s role in education in favor of more control by the states.<\/p>\n<p class=\"dcr-16w5gq9\">In the latest high court win for the president, the justices lifted a federal judge\u2019s order that had reinstated nearly 1,400 workers affected by <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/12\/education-department-firings-trump\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">mass layoffs<\/a> at the <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/20\/what-is-department-education-trump\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">department<\/a> and blocked the administration from transferring key functions to other federal agencies. A legal challenge is continuing to play out in lower courts.<\/p>\n<p class=\"dcr-16w5gq9\">The court\u2019s action came in a brief, unsigned order. Its three liberal justices dissented.<\/p>\n<p class=\"dcr-16w5gq9\">A group of 21 Democratic attorneys general, school districts and unions behind a pair of legal challenges had warned in court papers that Trump\u2019s shutdown efforts threatened to impair the department\u2019s ability to perform its core duties.<\/p>\n<p class=\"dcr-16w5gq9\">Created by Congress in 1979, the Department of Education\u2019s main roles include administering college loans, tracking student achievement and enforcing civil rights in schools. It also provides federal funding for needy districts and to help students with disabilities.<\/p>\n<p class=\"dcr-16w5gq9\">Federal law prohibits the department from controlling school operations including curriculum, instruction and staffing. Authority over these decisions belongs to state and local governments, which provide more than 85% of public school funding.<\/p>\n<p class=\"dcr-16w5gq9\">The department\u2019s Republican critics have portrayed the department as a symbol of bureaucratic waste, underlining the need for smaller federal government in favor of greater state power.<\/p>\n<p class=\"dcr-16w5gq9\">In March, Trump sought to deliver on a campaign promise to conservatives by calling for the department\u2019s closure.<\/p>\n<p class=\"dcr-16w5gq9\">\u201cWe\u2019re going to be returning education, very simply, back to the states where it belongs,\u201d Trump said on 20 March before signing an executive order to close the department to the \u201cmaximum extent\u201d allowed by law.<\/p>\n<p class=\"dcr-16w5gq9\">Trump said that certain \u201ccore necessities\u201d would be preserved, including Pell grants to students from lower-income families and federal funding for disadvantaged students and children with special needs, though he said those functions would be redistributed to other agencies and departments.<\/p>\n<p class=\"dcr-16w5gq9\">Trump in March directed that the department transfer its $1.6tn student loan portfolio to the Small Business Administration and its special education services to the Department of Health and Human Services.<\/p>\n<p class=\"dcr-16w5gq9\">Although formally eliminating the department would require an act of Congress, the downsizing announced in March by <a href=\"https:\/\/www.theguardian.com\/education\/education-us\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" target=\"_blank\" rel=\"noopener\">US education<\/a> secretary Linda McMahon aimed to slash the department\u2019s staff to roughly half the size it was when Trump took office in January.<\/p>\n<p><a data-ignore=\"global-link-styling\" href=\"#EmailSignup-skip-link-13\" class=\"dcr-jzxpee\">skip past newsletter promotion<\/a><\/p>\n<p class=\"dcr-rsfwa\">Sign up to This Week in Trumpland<\/p>\n<p class=\"dcr-1xjndtj\">A deep dive into the policies, controversies and oddities surrounding the Trump administration<\/p>\n<p><strong>Privacy Notice: <\/strong>Newsletters may contain info about charities, online ads, and content funded by outside parties.
