{"id":273104,"date":"2025-07-18T21:59:12","date_gmt":"2025-07-18T21:59:12","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/273104\/"},"modified":"2025-07-18T21:59:12","modified_gmt":"2025-07-18T21:59:12","slug":"european-commission-is-bringing-legal-action-against-france-over-its-environmental-labelling-rules","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/273104\/","title":{"rendered":"European Commission is bringing legal action against France over its environmental labelling rules"},"content":{"rendered":"<p class=\"c-paragraph b-article-body-skinny\">French law dictates that household product waste that falls under Extended Producer Responsibility (EPR) \u2013 which includes food packaging \u2013 must display the \u2018Triman\u2019 logo and the \u2018infotri\u2019 sorting instructions, regardless of where they were produced.<\/p>\n<p class=\"c-paragraph b-article-body-skinny\">The Triman logo indicates that the product is subject to sorting rules, while inforti specifies the methods for sorting. <\/p>\n<p class=\"c-paragraph b-article-body-skinny\">France has created its own rules due to a lack of EU-wide harmonisation. However, if a product is lawfully made and sold in one EU member state, another cannot impose additional national rules that would impede free movement of goods. <\/p>\n<p class=\"c-paragraph b-article-body-skinny\">\u201cThe European Commission considers that these specific national labelling requirements constitute an obstacle to the free movement of goods, violating Articles 34 to 36 of the Treaty on the Functioning of the European Union (TFEU). Unilateral measures like these force companies to adapt packaging exclusively for the French market, contributing to the fragmentation of the single market,\u201d added Francesco Montanari, agri-food lawyer and research at Wageningen University.<\/p>\n<p class=\"c-paragraph b-article-body-skinny\">The Commission says it also consider the French requires \u201cdisproportionate\u201d, as other suitable options are available to inform consumers which do not hinder trade until harmonised labelling rules come into effect under <a href=\"https:\/\/eur02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Feur-lex.europa.eu%2Feli%2Freg%2F2025%2F40%2Foj%2Feng&amp;data=05%7C02%7Cbethan.grylls%40wrbm.com%7C42897237e2984634d8da08ddc5edf45b%7C8d5287f1f765422c89618fa7884626d9%7C0%7C0%7C638884347996293373%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=wHpU2YDOLVkkxAiZAXi5sNi%2BB4rsA9RMfI%2FuIR6HZXE%3D&amp;reserved=0\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/eur02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Feur-lex.europa.eu%2Feli%2Freg%2F2025%2F40%2Foj%2Feng&amp;data=05%7C02%7Cbethan.grylls%40wrbm.com%7C42897237e2984634d8da08ddc5edf45b%7C8d5287f1f765422c89618fa7884626d9%7C0%7C0%7C638884347996293373%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=wHpU2YDOLVkkxAiZAXi5sNi%2BB4rsA9RMfI%2FuIR6HZXE%3D&amp;reserved=0\"><b>Regulation (EU) 2025\/40 on Packaging and Packaging Waste<\/b><\/a><b> <\/b>(PPWR).<\/p>\n<p class=\"c-paragraph b-article-body-skinny\">The Commission contends that France is in breach of the notification obligations under the Single Market Transparency Directive (<a href=\"https:\/\/publications.europa.eu\/resource\/cellar\/a857b646-5cfd-11e5-afbf-01aa75ed71a1.0006.03\/DOC_1\" target=\"_blank\" rel=\"noopener\" title=\"https:\/\/publications.europa.eu\/resource\/cellar\/a857b646-5cfd-11e5-afbf-01aa75ed71a1.0006.03\/DOC_1\"><b>Directive (EU) 2015\/1535<\/b><\/a>), as a result of failure to notify the Commission and other EU Member States of the draft law, prior to its adoption.<\/p>\n<p class=\"c-paragraph b-article-body-skinny\">\u201cFollowing a formal notice letter in February 2023 and a reasoned opinion in November 2024, the Commission states that France remains non-compliant, which justifies legal action at the European level,\u201d explained Montanari. <\/p>\n<p class=\"c-paragraph b-article-body-skinny\">\u201cThe proceedings before the CJEU may take between 18 and 24 months on average.
