{"id":277659,"date":"2025-07-20T15:15:09","date_gmt":"2025-07-20T15:15:09","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/277659\/"},"modified":"2025-07-20T15:15:09","modified_gmt":"2025-07-20T15:15:09","slug":"nhs-facing-absolutely-shocking-27bn-bill-for-maternity-failings-in-england-nhs","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/277659\/","title":{"rendered":"NHS facing \u2018absolutely shocking\u2019 \u00a327bn bill for maternity failings in England | NHS"},"content":{"rendered":"<p class=\"dcr-16w5gq9\">The NHS is facing an \u201cabsolutely shocking\u201d \u00a327bn bill for maternity failings in <a href=\"https:\/\/www.theguardian.com\/uk-news\/england\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" target=\"_blank\" rel=\"noopener\">England<\/a>, the Guardian can reveal, after a series of hospital scandals triggered a record level of legal claims.<\/p>\n<p class=\"dcr-16w5gq9\">Hundreds of babies and women have died or suffered life-altering conditions as a result of botched care in <a href=\"https:\/\/www.theguardian.com\/society\/nhs\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" target=\"_blank\" rel=\"noopener\">NHS<\/a> trusts across the country in recent years, prompting the government to launch a \u201crapid\u201d national inquiry.<\/p>\n<p class=\"dcr-16w5gq9\">Analysis of NHS figures shows the potential bill for maternity negligence in England since 2019 has reached \u00a327.4bn \u2013 far more than the health service\u2019s roughly \u00a318bn budget for newborns in that time.<\/p>\n<p class=\"dcr-16w5gq9\">The number of families taking legal action against the NHS for obstetrics errors rose to a record of nearly 1,400 a year in 2023, double the number in 2007, according to figures released under the Freedom of Information (FoI) Act.<\/p>\n<p><a data-name=\"placeholder\" href=\"https:\/\/interactive.guim.co.uk\/datawrapper\/embed\/QlaOV\/1\/\" class=\"dcr-1eupayo\" target=\"_blank\" rel=\"noopener\">Number of obstetrics claims<\/a><\/p>\n<p class=\"dcr-16w5gq9\">Labour MP Paulette Hamilton, the acting chair of the Commons health and social care select committee, said the figures were \u201cabsolutely shocking\u201d and represented a \u201cdevastatingly high number of deaths and injuries of mothers and babies\u201d.<\/p>\n<p class=\"dcr-16w5gq9\">She added: \u201cThe words \u2018eye-watering\u2019 come nowhere near to describing the enormous financial cost of these cases to the NHS, arising from failings within its own provision of care.\u201d<\/p>\n<p class=\"dcr-16w5gq9\">An NHS source said about half of the 1,400 claims a year may not result in compensation payouts, so the amount paid out would be lower. However, compensation only accounts for part of the total 27bn figure, a larger share being legal costs. In the past six years, the NHS has spent \u00a324.6m on legal fees for claims that did not result in damages.<\/p>\n<p class=\"dcr-16w5gq9\">NHS Resolution, the organisation that handles negligence claims for the NHS trusts in England, recorded in its <a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/6878fe277ea209168636391b\/nhs-resolution-annual-report-and-accounts-2024-to-2025-hc1065.pdf\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">most recent annual report<\/a>, published on Thursday, that the cost of settling all maternity-related claims was \u00a337.5bn. This amounts to nearly two-thirds of its total \u00a360bn clinical negligence liabilities bill, a sum <a href=\"https:\/\/www.theguardian.com\/society\/2025\/may\/14\/nhs-medical-negligence-liabilities-hit-582bn-amid-calls-to-improve-patient-safety\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">described by senior MPs<\/a> as \u201cjaw-dropping\u201d.<\/p>\n<p><a data-name=\"placeholder\" href=\"https:\/\/interactive.guim.co.uk\/datawrapper\/embed\/Bl7y3\/1\/\" class=\"dcr-1eupayo\" target=\"_blank\" rel=\"noopener\">Estimated cost of harm from maternity incidents<\/a><\/p>\n<p class=\"dcr-16w5gq9\">Jeremy Hunt, the former Conservative health secretary, said: \u201cIt should be a matter of national shame that we now spend more on maternity litigation than the total cost of running maternity services.\u201d<\/p>\n<p class=\"dcr-16w5gq9\">Hunt said the NHS was still not doing enough to learn from mistakes and the biggest problem was that clinicians fear being sacked for admitting errors.<\/p>\n<p class=\"dcr-16w5gq9\">Jess Brown-Fuller, the Liberal Democrat hospitals spokesperson, accused the Conservatives of a \u201cscandalous\u201d neglect of maternity services.<\/p>\n<p class=\"dcr-16w5gq9\">She added: \u201cThe crisis in our maternity services is being laid bare through the trauma that so many families have to deal with. Now these figures are showing just how much damage it is causing to our health service.\u201d<\/p>\n<p class=\"dcr-16w5gq9\">The \u00a327.4bn figure is the estimated value of maternity claims arising out of incidents since April 2019. NHS Resolution said the figure could change as there is an average three-year gap between an incident and a legal claim, the most serious birth injuries resulting in payments made over several years \u2013 and sometimes for the duration of the child\u2019s life.<\/p>\n<p class=\"dcr-16w5gq9\">The figures have been revealed amid growing alarm about the state of maternity care in NHS hospitals across England. Wes Streeting, the health secretary, last month ordered a national investigation into \u201cfailing\u201d services for women and babies, following a series of scandals in Shrewsbury and Telford, Nottingham, Barrow-in-Furness, Leeds and elsewhere.<\/p>\n<p class=\"dcr-16w5gq9\">Inspections of 131 NHS maternity units across England classed as many as two-thirds as \u201cinadequate\u201d or \u201crequires improvement\u201d for safety between 2022 and 2024.<\/p>\n<p class=\"dcr-16w5gq9\">The Care Quality Commission, the healthcare regulator, <a href=\"https:\/\/www.cqc.org.uk\/publications\/maternity-services-2022-2024\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">said<\/a> issues including staff shortages were \u201csystemic\u201d and \u201cwidespread\u201d, with almost half of the 131 maternity units it reviewed performing below standard.<\/p>\n<p class=\"dcr-16w5gq9\">Hamilton said the state of maternity care in the UK was \u201ccompletely unacceptable\u201d.<\/p>\n<p><a data-ignore=\"global-link-styling\" href=\"#EmailSignup-skip-link-19\" class=\"dcr-jzxpee\">skip past newsletter promotion<\/a><\/p>\n<p class=\"dcr-1xjndtj\">Our morning email breaks down the key stories of the day, telling you what\u2019s happening and why it matters<\/p>\n<p><strong>Privacy Notice: <\/strong>Newsletters may contain info about charities, online ads, and content funded by outside parties. A further \u00a3247m was paid out over birth defects owing to clinical negligence.<\/p>\n<p class=\"dcr-16w5gq9\">Natalie Richardson, a medical negligence solicitor for Patient Claim Line, said there had been a 79% increase in the number of birth and pregnancy cases the firm had taken on this year.<\/p>\n<p class=\"dcr-16w5gq9\">Leeds teaching hospitals NHS trust, whose maternity units were last month <a href=\"https:\/\/www.theguardian.com\/society\/2025\/jun\/20\/two-leeds-hospitals-maternity-services-rated-inadequate-safety-risks\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">downgraded to inadequate<\/a> over safety concerns, paid out nearly \u00a372m in compensation due to 107 obstetrics failings in the nine years to March 2024 \u2013 including 13 fatalities and 14 stillbirths.<\/p>\n<p class=\"dcr-16w5gq9\">In the same period, Nottingham University hospitals NHS trust was ordered to pay nearly \u00a360m for 80 clinical damages claims related to pregnancies \u2013 including seven deaths.<\/p>\n<p class=\"dcr-16w5gq9\">That trust is at the centre of a <a href=\"https:\/\/www.theguardian.com\/society\/2025\/jun\/02\/police-launch-corporate-manslaughter-inquiry-into-nottingham-hospital-trust\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">vast criminal investigation<\/a> into suspected corporate manslaughter over the severe harm of potentially more than 2,000 babies and women.<\/p>\n<p class=\"dcr-16w5gq9\">The Department of <a href=\"https:\/\/www.theguardian.com\/society\/health\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" target=\"_blank\" rel=\"noopener\">Health<\/a> and Social Care said it had inherited \u201can unacceptable situation where too many families are suffering from botched care\u201d and the NHS is \u201cpaying billions for its mistakes, rather than fixing them\u201d.<\/p>\n<p class=\"dcr-16w5gq9\">It added: \u201cWe are committed to breaking that cycle and providing mothers and babies with safe, compassionate care once and for all.\u201d<\/p>\n<p class=\"dcr-16w5gq9\">NHS England said it was taking immediate steps to strengthen maternity services, including closer oversight of underperforming trusts. It added<strong>: <\/strong>\u201cWe recognise that too many women and families are not receiving the high-quality maternity care they deserve, and we are committed to changing this.\u201d<\/p>\n<p class=\"dcr-16w5gq9\">NHS Resolution said: \u201cThe high cost of compensation arising in maternity comes from a small number of very serious incidents resulting in brain injury to a baby at birth.
