We believe quality journalism should be available to everyone, paid for by those who can afford it.<\/p>\n<p><strong class=\"sc-1uza6dc-1 bcqyHy\">Your support makes all the difference.<\/strong>Read more<\/p>\n<p><a href=\"https:\/\/www.independent.co.uk\/news\/uk\/home-news\/supreme-court-woman-definition-ruling-legal-uk-latest-news-b2734201.html\" target=\"_blank\" rel=\"noopener\">Trans women<\/a> are not legally <a href=\"https:\/\/www.independent.co.uk\/topic\/women\" target=\"_blank\" rel=\"noopener\">women<\/a> under the <a href=\"https:\/\/www.independent.co.uk\/topic\/equality-act\" target=\"_blank\" rel=\"noopener\">Equality Act<\/a>, <a href=\"https:\/\/www.independent.co.uk\/news\/uk\/home-news\/supreme-court-woman-definition-ruling-legal-uk-latest-news-b2734201.html\" target=\"_blank\" rel=\"noopener\">the Supreme Court has ruled in a landmark judgment. <\/a><\/p>\n<p>Campaign group For Women Scotland (FWS) brought a series of challenges \u2013 including to the UK\u2019s highest court \u2013 over the definition of \u201c<a href=\"https:\/\/www.independent.co.uk\/topic\/woman\" target=\"_blank\" rel=\"noopener\">woman<\/a>\u201d in Scottish legislation mandating 50 per cent female representation on public boards.<\/p>\n<p>On Wednesday, five judges from the UK <a href=\"https:\/\/www.independent.co.uk\/topic\/supreme-court\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> ruled unanimously that the terms \u201cwoman\u201d and \u201csex\u201d in the Equality Act refer to a biological woman and biological sex, in a decision that could have wide-ranging ramifications for <a href=\"https:\/\/www.independent.co.uk\/topic\/trans\" target=\"_blank\" rel=\"noopener\">trans<\/a> women\u2019s rights to use services and spaces reserved for women.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/04\/Britain_Court_Gender_39290.jpg\"  loading=\"lazy\" alt=\"Women\u2019s rights activists celebrate outside the Supreme Court\" class=\"sc-1mc30lb-0 QHifS inline-gallery-btn\"\/><\/p>\n<p>open image in gallery<\/p>\n<p>Women\u2019s rights activists celebrate outside the Supreme Court (AP)<\/p>\n<p>It means that transgender women with a gender recognition certificate (GRC) can be excluded from single-sex spaces if \u201cproportionate\u201d.<\/p>\n<p>Gender critical rights campaigners have hailed the ruling as a victory for <a href=\"https:\/\/www.independent.co.uk\/news\/uk\/crime\/supreme-court-keir-starmer-scottish-government-kemi-badenoch-b2734220.html\" target=\"_blank\" rel=\"noopener\">biological women<\/a> that will protect <a href=\"https:\/\/www.independent.co.uk\/news\/uk\/home-news\/definition-woman-trans-supreme-court-b2734090.html\" target=\"_blank\" rel=\"noopener\">single-sex spaces<\/a>, with FWS saying they were \u201cabsolutely jubilant\u201d about the result.<\/p>\n<p>But trans rights groups have reacted with dismay, warning that it will \u201cexclude trans people wholesale from participating in UK society\u201d.<\/p>\n<p>jane fae, director of trans campaign group TransActual, argued society will \u201cdivide more sharply into queer-friendly and queer-hostile spaces\u201d as a result of the ruling, adding that it will \u201cbe the poorer for it\u201d.<\/p>\n<p>\u201cThe entire trans community is devastated,\u201d the campaigner told The Independent. \u201cIrrespective of the small print on this ruling, the intent seems clear: to exclude trans people wholesale from participating in UK society.<\/p>\n<p>\u201cThis morning, we are feeling very alone. That, though, is today. We have come through worse before and trans people are not going away. Whatever the non-trans world throws at us, we will be back, each time, stronger than before.\u201d<\/p>\n<p>Labour for Trans Rights have called the Supreme Court\u2019s decision \u201chugely disappointing\u201d, arguing that it came as a result of \u201cceaseless lobbying from a well-funded anti-trans network\u201d.<\/p>\n<p>The group said: \u201cLabour must not follow the example of Donald Trump, and must instead protect the Equality Act, one of Labour\u2019s proudest pieces of legislation, and its legal protections for trans people.<\/p>\n<p>\u201cThe Labour Party must stand firmly behind the LGBT+ community.\u201d<\/p>\n<p>Meanwhile, transgender rights campaign group TransLucent said: \u201cMany in the trans community will be extremely worried by this decision and its implications\u201d.<\/p>\n<p>\u201cWe would like to reassure them that they are still protected from discrimination, victimisation and harassment because of their protected characteristic of gender reassignment,\u201d they added in a statement.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/04\/Trump-Transgender-Health_Care_11379.jpg\"  loading=\"lazy\" alt=\"Trans rights groups have called the ruling \u2018hugely disappointing\u2019\" class=\"sc-1mc30lb-0 QHifS inline-gallery-btn\"\/><\/p>\n<p>open image in gallery<\/p>\n<p>Trans rights groups have called the ruling \u2018hugely disappointing\u2019 (AP)<\/p>\n<p>The dispute centres on whether someone with a GRC recognising their gender as female should be treated as a woman under the UK 2010 Equality Act.<\/p>\n<p>FWS has previously said not tying the definition of sex to its \u201cordinary meaning\u201d could have far-reaching consequences for sex-based rights, as well as \u201ceveryday single-sex services\u201d such as toilets and hospital wards.<\/p>\n<p>But lawyers for the Scottish Government told the Supreme Court at a hearing in November that a person with a GRC is \u201crecognised in law\u201d as having changed sex.<\/p>\n<p>In their ruling on Wednesday, justices at the UK\u2019s highest court unanimously ruled in FWS\u2019s favour.<\/p>\n<p>In the wake of the verdict, the government reaffirmed its support for the \u201cprotection of single-sex spaces based on biological sex\u201d, with women and equalities minister Bridget Phillipson saying the ruling brings \u201cclarity and confidence, for women and service providers such as hospitals, refuges, and sports clubs\u201d.<\/p>\n<p>\u201cSingle-sex spaces are protected in law and will always be protected by this government,\u201d she added.<\/p>\n<p>But Rosie Duffield, an outspoken critic of Labour\u2019s position on trans rights, accused the government of \u201cgaslighting\u201d.<\/p>\n<p>The gender critical MP, who quit the Labour Party last year, told Times Radio the party had \u201cactively blocked women from promotion\u201d if they questioned the rights of trans people \u201cto enter our spaces\u201d.<\/p>\n<p>Officials have confirmed the NHS is now looking at updating its official guidance on same-sex wards to reflect the ruling, which currently says trans people \u201cshould be accommodated according to their presentation: the way they dress, and the name and pronouns they currently use\u201d.<\/p>\n<p>In an 88-page judgment, Lord Hodge, sitting with Lords Reed and Lloyd-Jones alongside Ladies Rose and Simler, said that while the word \u201cbiological\u201d does not appear in the definition of man or woman in the Equality Act, \u201cthe ordinary meaning of those plain and unambiguous words corresponds with the biological characteristics that make an individual a man or a woman\u201d.<\/p>\n<p>They argued that transgender people are still protected from discrimination under the act, but that \u201cgender reassignment and sex are separate bases for discrimination and inequality\u201d.<\/p>\n<p>The ruling was welcomed by Britain\u2019s equalities watchdog which argued it successfully addressed challenges around single-sex spaces.<\/p>\n<p>Baroness Kishwer Falkner, chair of the Equality and Human Rights Commission (EHRC), said: \u201cWe are pleased that this judgment addresses several of the difficulties we highlighted in our submission to the court, including the challenges faced by those seeking to maintain single-sex spaces and the rights of same-sex attracted persons to form associations.\u201d<\/p>\n<p>Meanwhile, Conservative Party leader Kemi Badenoch used the ruling to launch a political attack on the prime minister, saying: \u201cThe era of Keir Starmer telling us women can have penises has come to an end.<\/p>\n<p>\u201cSaying \u2018trans women are women\u2019 was never true in fact, and now isn\u2019t true in law either. This is a victory for all of the women who faced personal abuse or lost their jobs for stating the obvious.
