{"id":299194,"date":"2025-07-28T18:57:30","date_gmt":"2025-07-28T18:57:30","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/299194\/"},"modified":"2025-07-28T18:57:30","modified_gmt":"2025-07-28T18:57:30","slug":"judge-rules-foreign-office-should-reconsider-helping-palestinian-family-of-six-who-are-trying-to-flee-gaza-to-join-relative-in-britain","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/299194\/","title":{"rendered":"Judge rules Foreign Office should reconsider helping Palestinian family-of-six who are trying to flee Gaza to join relative in Britain"},"content":{"rendered":"<p class=\"mol-para-with-font\">A High Court judge has urged the <a style=\"font-weight: bold;\" target=\"_self\" href=\"https:\/\/www.dailymail.co.uk\/news\/dominic-raab\/index.html\" id=\"mol-9e9ba2c0-6bc3-11f0-a92e-21ba885136bd\" rel=\"noopener\">Foreign Secretary<\/a> to \u2018think again\u2019 about a decision to refuse consular assistance to a Palestinian family-of-six who were given permission to join a relative in Britain.<\/p>\n<p class=\"mol-para-with-font\">The mother, father and their four children have been attempting to flee <a style=\"font-weight: bold;\" target=\"_self\" href=\"https:\/\/www.dailymail.co.uk\/news\/palestine\/index.html\" id=\"mol-9edbe010-6bc3-11f0-a92e-21ba885136bd\" rel=\"noopener\">Gaza<\/a> since they were granted the right to settle in the UK in January after applying through a scheme meant for Ukrainian refugees.<\/p>\n<p class=\"mol-para-with-font\">Their application was initially rejected by the <a style=\"font-weight: bold;\" target=\"_self\" href=\"https:\/\/www.dailymail.co.uk\/news\/the-home-office\/index.html\" id=\"mol-9ed5eca0-6bc3-11f0-a92e-21ba885136bd\" rel=\"noopener\">Home Office<\/a> whose lawyers said it could set a precedent and lead to \u2018the admission of all those in conflict zones with family in the UK.\u2019<\/p>\n<p class=\"mol-para-with-font\">However they were victorious in an appeal to an Upper Tribunal judge.<\/p>\n<p class=\"mol-para-with-font\">But the family have remained in Gaza as they need consular support to leave via <a style=\"font-weight: bold;\" target=\"_self\" href=\"https:\/\/www.dailymail.co.uk\/news\/israel-hamas-conflict\/index.html\" id=\"mol-9edf8990-6bc3-11f0-a92e-21ba885136bd\" rel=\"noopener\">Israel<\/a> and the permission of the <a style=\"font-weight: bold;\" target=\"_self\" href=\"https:\/\/www.dailymail.co.uk\/news\/israel\/index.html\" id=\"mol-9edc5540-6bc3-11f0-a92e-21ba885136bd\" rel=\"noopener\">Israeli<\/a> Government.<\/p>\n<p class=\"mol-para-with-font\">Foreign Secretary <a style=\"font-weight: bold;\" target=\"_self\" href=\"https:\/\/www.dailymail.co.uk\/news\/david-lammy\/index.html\" id=\"mol-9e958840-6bc3-11f0-a92e-21ba885136bd\" rel=\"noopener\">David Lammy<\/a> has refused this on several occasions with the Foreign Office warning that such a move would be equivalent to a \u2018quasi-repatriation\u2019 and could even impact Britain\u2019s \u2018diplomatic relationship\u2019 with Israel.<\/p>\n<p class=\"mol-para-with-font\">Lawyers acting on behalf of the Foreign Office told the High Court that interference \u2018would require the court to enter the forbidden area of foreign relations.\u2019<\/p>\n<p class=\"mol-para-with-font\">However in a ruling handed down this afternoon, Mr Justice Chamberlain sided with the family and said the most recent decision in June not to provide consular support was \u2018flawed\u2019 and \u2018cannot stand.\u2019<\/p>\n<p>   <img decoding=\"async\" id=\"i-1c19629538ee8a27\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/07\/100702813-14947795-image-a-1_1753715097595.jpg\" height=\"423\" width=\"634\" alt=\"Foreign Secretary David Lammy has been urged to rethink the decision not to provide consulare assistance to the family\" class=\"blkBorder img-share\" style=\"max-width:100%\" loading=\"lazy\" \/>   <\/p>\n<p class=\"imageCaption\">Foreign Secretary David Lammy has been urged to rethink the decision not to provide consulare assistance to the family<\/p>\n<p>   <img decoding=\"async\" id=\"i-9f8525f8aa31dd7c\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/07\/100702823-14947795-image-a-2_1753715133326.jpg\" height=\"897\" width=\"634\" alt=\"Mr Justice Chamberlain said the decision-making was 'flawed' and 'cannot stand.'\" class=\"blkBorder img-share\" style=\"max-width:100%\" loading=\"lazy\" \/>   <\/p>\n<p class=\"imageCaption\">Mr Justice Chamberlain said the decision-making was &#8216;flawed&#8217; and &#8216;cannot stand.&#8217;<\/p>\n<p class=\"mol-para-with-font\">\u2018This does not mean that the Foreign Secretary is obliged to decide in the claimants&#8217; favour, just that he must think again,\u2019 he said.<\/p>\n<p class=\"mol-para-with-font\">The case attracted national attention in February when the Prime Minister said a judge who granted the family the right to live in the UK after they applied through the Ukrainian refugee scheme was \u2018wrong.\u2019<\/p>\n<p class=\"mol-para-with-font\">Hugo Norton-Taylor, an upper tribunal judge, had allowed the family to come to the UK on the basis of their right to a family life under article 8 of the European convention on human rights (ECHR).<\/p>\n<p class=\"mol-para-with-font\">The parents and their children \u2013 the two youngest aged nine and seven \u2013 were seeking to join the father\u2019s brother in the UK.<\/p>\n<p class=\"mol-para-with-font\">The court heard he came to Britain in 2007 and is now a British citizen. Both the father and his brother worked for the security services of the Fatah-controlled Palestinian Authority, which are political opponents of Hamas.<\/p>\n<p class=\"mol-para-with-font\">Responding to a question from Conservative leader Kemi Badenoch during PMQs about the case, Sir Keir Starmer said: \u2018I do not agree with the decision. She is right, it is the wrong decision.\u2019<\/p>\n<p class=\"mol-para-with-font\">The family applied for the right to live in Britain under the Ukraine Resettlement Scheme as they believed it \u2018most closely matched their circumstances.\u2019<\/p>\n<p class=\"mol-para-with-font\">It prompted Downing Street to say the \u2018loophole\u2019 would be closed.<\/p>\n<p class=\"mol-para-with-font\">Set up in March 2022, the Ukraine scheme allowed Ukrainian nationals and their family members to come to the UK if they had a relative who was a British citizen or settled in the UK.
