The UN has protested the US sanctions by invoking Albanese\u2019s immunity and calling for the sanctions to be dropped. MARK GARTEN\/UN PHOTO<\/p>\n<p>Two weeks after the United States <a href=\"https:\/\/www.state.gov\/releases\/office-of-the-spokesperson\/2025\/07\/sanctioning-lawfare-that-targets-u-s-and-israeli-persons\" target=\"_blank\" rel=\"noopener\">imposed sanctions<\/a> against <a href=\"https:\/\/en.wikipedia.org\/wiki\/Francesca_Albanese\" target=\"_blank\" rel=\"noopener\">Francesca Albanese<\/a>, the United Nations special rapporteur on the situation of human rights in the Occupied Palestinian Territory (OPT), the UN has invoked her immunity and called on the US to remove the sanctions against her.<\/p>\n<p>On July 9, 2025, the US Secretary of State, Marco Rubio, imposed sanctions against Albanese, citing oral and written statements she made in her official role within the UN mandate entrusted to her by the UN Human Rights Council. As a result, Albanese is now banned from traveling to the US and any property or other assets she has in the country or its banks may be frozen. The <a href=\"https:\/\/apnews.com\/article\/un-investigator-francesca-albanese-israel-gaza-famine-007fee19bac67a7da02eb153b2e66e03\" target=\"_blank\" rel=\"noopener\">same sanctions<\/a> may apply to her immediate family members.<\/p>\n<p>On the same day that Rubio designated Albanese for US sanctions, St\u00e9phane Dujarric, the UN spokesperson, <a href=\"https:\/\/news.un.org\/en\/story\/2025\/07\/1165359\" target=\"_blank\" rel=\"noopener\">said<\/a> that the imposition of sanctions on UN special rapporteurs is \u201cunacceptable\u201d and sets a \u201cdangerous precedent.\u201d Volker Turk, the UN high commissioner for human rights, <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/07\/comment-un-high-commissioner-human-rights-volker-turk-us-sanctions-against\" target=\"_blank\" rel=\"noopener\">urged<\/a> the US to reverse the sanctions and said that the attacks and threats against Albanese and other Human Rights Council mandate-holders \u201cmust stop.\u201d<\/p>\n<p>Ambassador Juerg Lauber, the president of the Council, <a href=\"https:\/\/www.ohchr.org\/en\/press-releases\/2025\/07\/statement-ambassador-jurg-lauber-president-united-nations-human-rights\" target=\"_blank\" rel=\"noopener\">emphasized<\/a> that special rapporteurs \u201care an essential instrument of the Council in fulfilling its mandate to promote and protect all human rights worldwide\u201d and called on all UN member states \u201cto refrain from any acts of intimidation or reprisal against them.\u201d<\/p>\n<p>While UN Secretary-General Ant\u00f3nio Guterres himself has not said anything publicly about the sanctions, the UN Legal Counsel, on behalf of the secretary-general, wrote to the US Mission to the UN last week, asserting Albanese\u2019s official UN mandate and maintaining her UN privileges and immunities.<\/p>\n<p>Pursuant to the <a href=\"https:\/\/www.un.org\/en\/ethics\/assets\/pdfs\/Convention%20of%20Privileges-Immunities%20of%20the%20UN.pdf\" target=\"_blank\" rel=\"noopener\">Convention<\/a> on Privileges and Immunities of the UN, Albanese enjoys the status of a UN expert on mission and is accorded the privileges and immunities \u201cnecessary for the independent exercise\u201d of her UN functions. In particular, she enjoys \u201cimmunity from legal process of every kind,\u201d including from the US sanctions.<\/p>\n<p>Like all other UN human rights special rapporteurs, Albanese is not paid for her service. Her immunity from legal process is purely functional and applies only \u201cin respect of words spoken or written and acts done\u201d in the course of her work. The immunity is granted \u201cin the interests of the United Nations\u201d and not for her personal benefit.<\/p>\n<p>In <a href=\"https:\/\/www.state.gov\/releases\/office-of-the-spokesperson\/2025\/07\/sanctioning-lawfare-that-targets-u-s-and-israeli-persons\" target=\"_blank\" rel=\"noopener\">Rubio\u2019s letter<\/a> of July 9, 2025, designating Albanese for US sanctions, he cites her support for the International Criminal Court (ICC) and her advocacy for criminal accountability for the war crimes and crimes against humanity being committed in Gaza and other parts of the OPT.<\/p>\n<p>According to Rubio, Albanese had recommended \u201cwithout a legitimate basis\u201d that the ICC issue arrest warrants against Israeli Prime Minister Benjamin Netanyahu and his former Minister of Defense Yoav Gallant whom the US has defined as protected persons pursuant to <a href=\"https:\/\/ofac.treasury.gov\/media\/933981\/download?inline\" target=\"_blank\" rel=\"noopener\">Executive Order (EO) 14203<\/a> issued by President Donald Trump in February 2025.<\/p>\n<p>More than a year ago, in May 2024, the prosecutor of the ICC, Karim Khan, had requested arrest warrants against <a href=\"https:\/\/www.icc-cpi.int\/news\/situation-state-palestine-icc-pre-trial-chamber-i-issues-warrant-arrest-mohammed-diab-ibrahim\" target=\"_blank\" rel=\"noopener\">Hamas leaders<\/a> and <a href=\"https:\/\/www.icc-cpi.int\/news\/situation-state-palestine-icc-pre-trial-chamber-i-rejects-state-israels-challenges\" target=\"_blank\" rel=\"noopener\">Israeli leaders<\/a> for alleged war crimes and crimes against humanity. Khan was <a href=\"https:\/\/www.icc-cpi.int\/about\/otp\/special-advisers-to-the-prosecutor\/panel-of-experts-in-international-law\/report-of-the-panel-of-experts-in-international-law\" target=\"_blank\" rel=\"noopener\">advised<\/a> by a distinguished panel of legal experts, including an Israeli \u2014 Judge Theodor Meron. Albanese was not a member of the panel.<\/p>\n<p>Far from lacking legitimacy, as Rubio alleged, the panel assessed that \u201cthere are reasonable grounds to believe\u201d that Netanyahu and Gallant are responsible for the crimes they are alleged to have committed.<\/p>\n<p>The ICC issued the requested warrants in November 2024. The court has terminated the cases against the Hamas leaders as they have all been assassinated by Israeli forces. The charges against Netanyahu and Gallant are proceeding; they include using starvation as a method of warfare; intentionally directing attacks against the civilian population; and committing murder, persecution and other inhumane acts.<\/p>\n<p>In his designation letter, Rubio also accused Albanese of \u201cwriting threatening letters to dozens of entities worldwide, including major American companies . . . and recommending the ICC pursue investigations and prosecutions of these companies and their executives.\u201d<\/p>\n<p>She had, in fact, written to these entities warning them of their potential liability for their complicity in what the International Court of Justice had deemed <a href=\"https:\/\/www.icj-cij.org\/case\/192\/provisional-measures\" target=\"_blank\" rel=\"noopener\">a plausible genocide<\/a> in Gaza and an <a href=\"https:\/\/www.icj-cij.org\/case\/186\" target=\"_blank\" rel=\"noopener\">unlawful occupation<\/a> of the entire OPT. \u00a0She then issued a <a href=\"https:\/\/www.amnesty.org\/en\/latest\/news\/2025\/07\/usa-sanctions-against-un-special-rapporteur-francesca-albanese-are-a-disgraceful-affront-to-international-justice\/\" target=\"_blank\" rel=\"noopener\">report<\/a> detailing how these entities have \u201cprofited from Israel\u2019s illegal occupation, its brutal system of apartheid and its ongoing genocide in Gaza.\u201d<\/p>\n<p>Albanese has been serving as UN special rapporteur since May 2022; signaling its approval of her work, the Human Rights Council renewed her for another three-year term in April 2025 \u2014 with overwhelming support from UN member states.<\/p>\n<p>Albanese has consistently <a href=\"https:\/\/www.youtube.com\/watch?v=_D65ptCU19c\" target=\"_blank\" rel=\"noopener\">condemned<\/a> all violence against civilians \u2014 Israeli civilians and Palestinian civilians. Given the duration and magnitude of Israel\u2019s mass atrocities in Gaza and the surge in Israeli settler violence in the West Bank and East Jerusalem, Albanese\u2019s courageous, undaunted defense of Palestinian lives and rights has resonated throughout the world.<\/p>\n<p>The ICC prosecutor was the first to be sanctioned, pursuant to Executive Order 14203 on June 5, followed by four ICC judges on June 6 and most recently Albanese on July 9. It is highly unlikely that the Trump administration will remove any of them from the sanctions list. However, while Guterres has no responsibility for or authority over the ICC prosecutor and judges, he is duty bound to defend Albanese\u2019s mandate as a UN expert on mission and to uphold her UN immunity from any and all legal process.<\/p>\n<p>Guterres, who has already been declared <a href=\"https:\/\/www.nytimes.com\/2024\/10\/02\/world\/middleeast\/israel-guterres-un-ban-persona-non-grata.html\" target=\"_blank\" rel=\"noopener\">persona non grata<\/a> by Israel, and the UN \u2014 which is struggling from <a href=\"https:\/\/democrats-appropriations.house.gov\/news\/press-releases\/slashing-funding-state-and-foreign-operations-unprecedented-22-percent\" target=\"_blank\" rel=\"noopener\">US budget cuts<\/a> \u2014 will soon face yet another difficult decision: risk further Israeli and American retaliation or protect UN mandates and UN mandate-holders.<\/p>\n<p>Regardless of his fears of retaliation, legitimate as they may be, Guterres must speak up and, if necessary, stand up for UN mandates and UN mandate-holders, including Albanese. She is entitled to the protection of the UN and its secretary-general.<\/p>\n<p>In two previous cases involving the immunity from legal process of UN human rights special rapporteurs, the International Court of Justice confirmed that the secretary-general has the primary responsibility and authority to determine whether such experts are acting within the scope of their functions and, where he so concludes, to protect them by asserting their immunity.<\/p>\n<p>Dumitru <a href=\"https:\/\/www.icj-cij.org\/sites\/default\/files\/case-related\/81\/6815.pdf\" target=\"_blank\" rel=\"noopener\">Mazilu<\/a> and Dato\u2019 Param <a href=\"https:\/\/www.icj-cij.org\/case\/100\" target=\"_blank\" rel=\"noopener\">Cumaraswamy<\/a> faced national legal process arising from their work as UN special rapporteurs in their own countries \u2014 Romania and Malaysia, respectively. When those governments failed to respect the UN immunity, Secretary-General Javier P\u00e9rez de Cu\u00e9llar spoke up for Mazilu, and Secretary-General Kofi Annan spoke up for Cumaraswamy in the UN Economic and Social Council. After the Council sought an advisory opinion from the ICJ, they stood up for them in the world court.<\/p>\n<p>Albanese is Italian, not American; as such, the US sanctions against her represent an even more extreme violation of the UN Convention, and as the UN spokesperson rightly noted, they set a \u201cdangerous precedent\u201d not only for Albanese as a UN expert but also for the UN itself.<\/p>\n<p>A dispute between the UN and the US seems inevitable.
