When European settlers arrived in the 17th and 18th centuries, many used marijuana as an ingredient in medicine for ailments like cholera, alcoholism, opiate addiction and asthma, according to the <a href=\"https:\/\/rockinst.org\/intheweeds\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rockefeller Institute of Government<\/a>.<\/p>\n<p>The first regulation of marijuana was passed in 1906, with the establishment of the <a href=\"https:\/\/www.visitthecapitol.gov\/exhibitions\/congress-and-progressive-era\/pure-food-and-drug-act\" target=\"_blank\" rel=\"noreferrer noopener\">Pure Food and Drug Act<\/a>. This legislation required over-the-counter drugs containing cannabis to be labeled.<\/p>\n<p>Just a few years later in 1910, 29 states passed marijuana prohibitions. And in 1937, Congress passed the <a href=\"https:\/\/www.cbp.gov\/about\/history\/did-you-know\/marijuana\" target=\"_blank\" rel=\"noopener\">Marihuana Tax Act<\/a> (an alternative spelling). The legislation didn&#8217;t criminalize marijuana but rather imposed punishable fines on people who didn&#8217;t pay necessary taxes, according to the <a href=\"https:\/\/rockinst.org\/intheweeds\/\" target=\"_blank\" rel=\"noreferrer noopener\">Rockefeller Institute of Government<\/a>. But in 1969, the <a target=\"_blank\" href=\"https:\/\/www.usatoday.com\/news\/politics\/supreme-court\/\" data-autotag=\"a173914f-749b-454a-81ed-e37783d9c6f6\" rel=\"noopener\">Supreme Court<\/a> overturned the act, as it was found to be a violation of the Fifth Amendment.<\/p>\n<p>Marijuana wasn&#8217;t banned federally until 1970 with the passage of the <a href=\"https:\/\/www.dea.gov\/drug-information\/csa\" target=\"_blank\" rel=\"noreferrer noopener\">Controlled Substances Act<\/a>, which classified marijuana as a Schedule 1 drug.<\/p>\n<p>Fast forward to 1996, California passed the <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displaySection.xhtml?sectionNum=11362.5.&amp;lawCode=HSC\" target=\"_blank\" rel=\"noreferrer noopener\">Compassionate Use Act<\/a>, which legalized medical marijuana in the state. More states eventually followed, but it wasn&#8217;t until 2012 that two states legalized weed for recreational purchase and consumption \u2212 Colorado and Washington.<\/p>\n<p>It can all be a lot to keep track of.<\/p>\n<p>As we approach <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2025\/04\/04\/easter-sunday-420-same-day\/82760535007\/\" target=\"_blank\" rel=\"noreferrer noopener\">4\/20<\/a> on April 20, here is where marijuana is legal \u2212 medically and recreationally \u2212 in the United States.<\/p>\n<p>Where is marijuana recreationally and medically legal?<\/p>\n<p>According to <a href=\"https:\/\/disa.com\/marijuana-legality-by-state\" target=\"_blank\" rel=\"noreferrer noopener\">DISA Global Solutions<\/a>, marijuana is legal for medical and recreational purchase and consumption in the following states:<\/p>\n<ul class=\"wp-block-list\">\n<li>Alaska<\/li>\n<li>Arizona<\/li>\n<li>California<\/li>\n<li>Colorado<\/li>\n<li>Connecticut<\/li>\n<li>Delaware<\/li>\n<li>Illinois<\/li>\n<li>Maine<\/li>\n<li>Maryland<\/li>\n<li>Massachusetts<\/li>\n<li>Michigan<\/li>\n<li>Minnesota<\/li>\n<li>Missouri<\/li>\n<li>Montana<\/li>\n<li>Nevada<\/li>\n<li>New Jersey<\/li>\n<li>New Mexico<\/li>\n<li>New York<\/li>\n<li>Ohio<\/li>\n<li>Oregon<\/li>\n<li>Rhode Island<\/li>\n<li>Vermont<\/li>\n<li>Virginia<\/li>\n<li>Washington<\/li>\n<li>Washington, D.C.<\/li>\n<\/ul>\n<p>Where is marijuana only medically legal?<\/p>\n<p>According to <a href=\"https:\/\/disa.com\/marijuana-legality-by-state\" target=\"_blank\" rel=\"noreferrer noopener\">DISA Global Solutions<\/a>, marijuana is only legal for medical purchase and consumption in the following states:<\/p>\n<ul class=\"wp-block-list\">\n<li>Alabama<\/li>\n<li>Arkansas<\/li>\n<li>Florida<\/li>\n<li>Louisiana<\/li>\n<li>Mississippi<\/li>\n<li>New Hampshire<\/li>\n<li>North Dakota<\/li>\n<li>Oklahoma<\/li>\n<li>Pennsylvania<\/li>\n<li>South Dakota<\/li>\n<li>Utah<\/li>\n<li>West Virginia<\/li>\n<\/ul>\n<p>Where is marijuana fully illegal?<\/p>\n<p>Marijuana is <a href=\"https:\/\/disa.com\/marijuana-legality-by-state\" target=\"_blank\" rel=\"noreferrer noopener\">illegal for medicinal and recreational use in just four states<\/a>: Idaho, Kansas, South Carolina and Wyoming.<\/p>\n<p>There are also some states were medical and recreational marijuana isn&#8217;t legalized, but is decriminalized.
