shipments of food and drink between Great Britain and Northern Ireland could remain in place for up to three years, the British Retail Consortium has warned.<\/p>\n<p>And with <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/supermarkets\/244.subject\" rel=\"intextlink_11 noopener\" target=\"_blank\">supermarkets<\/a> already warning red tape is affecting the supply of some goods, the sector was facing a \u201cconstant battle to maintain <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/availability\/2983.subject\" rel=\"intextlink_7 noopener\" target=\"_blank\">availability<\/a>\u201d, said BRC director of food &amp; <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/sustainability-and-environment\/171.subject\" rel=\"intextlink_12 noopener\" target=\"_blank\">sustainability<\/a> Andrew Opie.<\/p>\n<p>The third and final phase of <a href=\"https:\/\/www.thegrocer.co.uk\/news\/windsor-framework-ni-checks-set-for-this-week-despite-mandss-machins-complaints\/706235.article\" target=\"_blank\" rel=\"noopener\">the post-Brexit Windsor Framework<\/a>, mandating additional \u2018Not for EU\u2019 <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/labelling\/683.subject\" rel=\"intextlink_6 noopener\" target=\"_blank\">labelling<\/a> on a slew of food and drink products, came into force on 1 July.<\/p>\n<p>The final phase \u2013 covering products ranging from packed <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/fruit\/2836.subject\" rel=\"intextlink_3 noopener\" target=\"_blank\">fruit<\/a> &amp; veg to <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/fish\/79.subject\" target=\"_blank\" rel=\"intextlink_4 noopener\">fish<\/a>, <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/eggs-and-poultry\/141.subject\" target=\"_blank\" rel=\"intextlink_1 noopener\">eggs<\/a> and all chilled and <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/frozen\/83.subject\" rel=\"intextlink_5 noopener\" target=\"_blank\">frozen<\/a> composite products \u2013 was introduced despite the UK signing a \u2018reset\u2019 deal with the EU in May, which includes a new sanitary and phytosanitary (SPS) agreement.<\/p>\n<p>Products not carrying the labels are required to go through the framework\u2019s \u2018Red Lane\u2019 \u2013 designed for GB goods heading to Ireland and\/or the rest of the EU.<\/p>\n<p>But with no sign of any further detail on when the SPS deal will be implemented, supermarkets were increasingly concerned the checks were \u201cleading to reduced availability of some SKUs\u201d shipped over from the mainland, due to confusion over labelling and paperwork, <a href=\"https:\/\/www.thegrocer.co.uk\/news\/windsor-frameworks-final-phase-hitting-ni-availability-for-some-products\/707386.article\" target=\"_blank\" rel=\"noopener\">The Grocer reported last month.<\/a><\/p>\n<p>Opie admitted this week it would take \u201csignificant time to ensure alignment with the EU on food law, before they are happy to reduce the SPS checks for EU <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/exports\/1027.subject\" rel=\"intextlink_2 noopener\" target=\"_blank\">exports<\/a> and for moving food from GB to NI\u201d.<\/p>\n<p>\u201cThe problem has been a lack of visibility about changes in EU law which then impact on the framework, together with the time to implement changes, and the lack of guidance to ensure compliance,\u201d he added.<\/p>\n<p>\u201cWe will be told one thing by the UK <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/government-and-regulation\/2913.subject\" rel=\"intextlink_8 noopener\" target=\"_blank\">government<\/a> only for that to be revised as the EU want enhanced measures of compliance, and finally we are still unclear which bits of EU law apply in NI,\u201d Opie said.<\/p>\n<p>All this meant retailers faced \u201ca regular need to change how they send food from GB to NI, often at short notice and as they also rely on manufacturers making changes it is a constant battle to maintain availability\u201d, he argued.<\/p>\n<p>The Grocer understands while there are no obvious shortages on shelf, that the additional red tape on shipments across the Irish Sea is leading some supermarkets to pare back their offerings of some SKUs, for example by reducing choice by cutting the number of pack sizes.<\/p>\n<p>Opie said the BRC had asked the government to offer \u201cgreater visibility and sufficient notice of changes to current requirements\u201d, until greater clarity on the SPS deal was available.<\/p>\n<p>Defra was also urged to press the EU to adopt a \u201cmore pragmatic approach to compliance ahead of the implementation of the SPS deal\u201d.<\/p>\n<p>Finally, more clarity was also required on which <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/regulation\/222.subject\" rel=\"intextlink_10 noopener\" target=\"_blank\">regulations<\/a> retailers were \u201crequired to follow, with sufficient notice for implementation\u201d, he added, citing the uncertainty surrounding the planned rollout of the EU Deforestation <a class=\"intextlink\" href=\"https:\/\/www.thegrocer.co.uk\/government-and-regulation\/2913.subject\" rel=\"intextlink_9 noopener\" target=\"_blank\">Regulation<\/a>, which is due to come into force at the end of the year.<\/p>\n<p>Defra has said it \u201ccontinues to work closely with businesses across the United Kingdom to support them with the changes\u201d.<\/p>\n<p>\u201cFaithful implementation of the Windsor Framework is essential if we are to secure the benefits that a SPS agreement with the EU will bring,\u201d it told The Grocer last month.<\/p>\n<p>$(document).ready(function() {<br \/>\nif
