{"id":33593,"date":"2025-04-19T18:27:08","date_gmt":"2025-04-19T18:27:08","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/33593\/"},"modified":"2025-04-19T18:27:08","modified_gmt":"2025-04-19T18:27:08","slug":"supreme-court-will-consider-trumps-restrictions-on-birthright-citizenship","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/33593\/","title":{"rendered":"Supreme Court will consider Trump&#8217;s restrictions on birthright citizenship"},"content":{"rendered":"<p><img decoding=\"async\" style=\"position:absolute;top:0;left:0;right:0;bottom:0;width:100%;height:100%;z-index:2\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/04\/76503399007-spcl-fact-034-barron-trump-2.jpg\"\/><img decoding=\"async\" class=\"vidplayicon\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/04\/icon-play-alt-white.svg.svg+xml\" alt=\"play\" style=\"height:40px;margin:auto 18px auto 27px;width:40px\"\/><\/p>\n<p>Trump&#8217;s immigration plan won&#8217;t affect Barron Trump&#8217;s citizenship<\/p>\n<p>A viral post falsely claims that Donald Trump&#8217;s plan to end birthright citizenship could affect the citizenship status of his son, Barron Trump.<\/p>\n<p>WASHINGTON \u2212 The <a href=\"https:\/\/www.usatoday.com\/news\/politics\/supreme-court\/\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/news\/politics\/supreme-court\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court<\/a> on Thursday said it would weigh in on the Trump administration&#8217;s request that it be allowed to broadly enforce its new <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2025\/01\/21\/birthright-citizenship-trump-executive-order-aclu\/77557587007\/\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2025\/01\/21\/birthright-citizenship-trump-executive-order-aclu\/77557587007\/\" target=\"_blank\" rel=\"noreferrer noopener\">restrictions on birthright citizenship<\/a> while the policy is being litigated.<\/p>\n<p>The court said it will hear oral arguments on May 15.<\/p>\n<p>It&#8217;s the first challenge to the new administration&#8217;s policies that the justices have taken up for public discussion.<\/p>\n<p>\u201cI am so happy,&#8221; President <a target=\"_blank\" href=\"https:\/\/www.usatoday.com\/news\/politics\/donald-trump\/\" data-autotag=\"26f031d1-9924-4f10-b4e6-019d076113d5\" rel=\"noopener\">Donald Trump<\/a> said Thursday. &#8220;I think the case has been so misunderstood.\u201dThe administration had asked the court to scale back the nationwide actions that judges in Maryland, Massachusetts and Washington issued to pause Trump&#8217;s order limiting birthright citizenship.<\/p>\n<p>The Department of Justice <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/03\/13\/trump-supreme-court-birthright-executive-order-citizenship\/79302891007\/\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/03\/13\/trump-supreme-court-birthright-executive-order-citizenship\/79302891007\/\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> Trump should be able to enforce the policy for everyone except the people directly named in the lawsuits and those who live in states that have sued if the court thinks states have a legal right to challenge the order. Explaining Trump&#8217;s desired changes<\/a><\/p>\n<p>Rather than focusing on the validity of Trump&#8217;s executive action, the DOJ argued that a judge in one part of the country shouldn&#8217;t be able to block actions nationally.<\/p>\n<p>&#8220;Years of experience have shown that the Executive Branch cannot properly perform its functions if any judge anywhere can enjoin every presidential action everywhere,&#8221; Sarah Harris, an attorney with the DOJ, told the court.<\/p>\n<p>Washington state Attorney General Nicholas Brown countered that citizenship rules must be uniform across the country. A patchwork rule is &#8220;unworkable&#8221; for states and would leave tens of thousands of infants subject to removal or detention, even though the government has not shown it is likely to eventually win the court fight, he argued.<\/p>\n<p>&#8220;If any injunction warranted a nationwide scope, it is this one,&#8221; Brown wrote in his response to Trump&#8217;s appeal.<\/p>\n<p>`Blatantly unconstitutional&#8217;<\/p>\n<p>The first federal judge to issue an opinion, U.S. District Judge John Coughenour in Seattle,\u00a0<a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/elections\/2025\/01\/23\/judge-blocks-trump-birthright-order\/77908147007\/\" target=\"_blank\" rel=\"noreferrer noopener\">called Trump&#8217;s order<\/a>\u00a0&#8220;blatantly unconstitutional.&#8221;<\/p>\n<p>An appeals court refused to pause Coughenour&#8217;s nationwide injunction. Two other appeals courts likewise backed injunctions issued by federal judges in Maryland and Massachusetts.<\/p>\n<p>Trump <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/01\/30\/trump-supreme-court-will-uphold-ending-birthright-citizenship\/78060886007\/\" data-type=\"link\" data-id=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/01\/30\/trump-supreme-court-will-uphold-ending-birthright-citizenship\/78060886007\/\" target=\"_blank\" rel=\"noreferrer noopener\">has said<\/a> the <a target=\"_blank\" href=\"https:\/\/www.usatoday.com\/news\/politics\/supreme-court\/\" data-autotag=\"a173914f-749b-454a-81ed-e37783d9c6f6\" rel=\"noopener\">Supreme Court<\/a> will ultimately agree with his interpretation of the 14th Amendment&#8217;s citizenship promise, a change he said is needed to bolster security along the southern U.S. border.<\/p>\n<p>The amendment states that all &#8220;persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the state wherein they reside.&#8221;<\/p>\n<p>The Trump administration maintains that right was intended to help formerly enslaved people after the Emancipation Proclamation and doesn&#8217;t cover children of people who entered the country without proper authorization.<\/p>\n<p>\u201cIt\u2019s all about slavery, and if you look it at that way, we should win that case,&#8221; Trump said Thursday.<\/p>\n<p>The &#8220;incorrect position&#8221; that the government has relied on, the administration argues, has led to &#8220;birth tourism&#8221; \u2212 expectant mothers traveling to the United States to secure citizenship for their children.<\/p>\n<p>Twenty Republican attorneys general backed Trump&#8217;s Supreme Court appeal, as did gun rights groups.<\/p>\n<p>Attorneys for immigrant rights groups and five pregnant mothers who sued to protect birthright citizenship said Trump&#8217;s order violates the plain text of the Constitution, common law history, Supreme Court precedent and more than a century of consistent practice.<\/p>\n<p>&#8220;The Executive Branch has been complying with the settled interpretation of the Citizenship Clause for 125 years,&#8221;
