The Commission plans to finalize the proposal in Q4 of 2026, after which it will move through the European Union\u2019s legislative process.<\/li>\n<li>Part of the EU\u2019s <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/ip_25_550\" target=\"_blank\" rel=\"noopener\">Clean Industrial Deal<\/a> announced in February 2025, the CEA is meant to create a single European market for circular products \u2014 <a href=\"https:\/\/www.mckinsey.com\/featured-insights\/mckinsey-explainers\/what-is-circularity\" target=\"_blank\" rel=\"noopener\">designed to optimize the resources used<\/a> and minimize waste across its lifecycle \u2014 as well as secondary materials and waste. The <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/EN\/TXT\/?uri=CELEX%3A52025DC0085\" target=\"_blank\" rel=\"noopener\">Commission\u2019s proposal<\/a> also hopes to foster a larger supply of high quality recycled materials and reduce feedstock costs.<\/li>\n<li>The CEA is motivated by the current regulatory fragmentation of the European market for recycled materials and waste, according to the call for evidence. It also seeks to make 24% of the region\u2019s materials circular by 2030 and address the higher cost of recycled materials, which hurts their competitiveness with virgin materials.<\/li>\n<\/ul>\n<p>Dive Insight:<\/p>\n<p>One of CEA\u2019s priorities will be ensuring collection, recycling and demand for electronic waste, of which less than 40% is recycled in the EU, according to the call for evidence. <\/p>\n<p>The CEA could also make changes to extended producer responsibility schemes, criteria that allow waste to be reclassified as secondary raw materials and public procurement criteria in order to \u201cfoster the single market for waste, secondary raw materials and their use in products.\u201d Such laws are gaining steam in the U.S., and at least seven states have <a href=\"https:\/\/www.packagingdive.com\/news\/extended-producer-responsibility-packaging-laws-regulations-calendar\/727548\/\" target=\"_blank\" rel=\"noopener\">EPR laws for packaging<\/a> on the books with compliance deadlines over the next few years.\u00a0<\/p>\n<p>The Act is also meant to support other circularity initiatives in the Clean Industrial Deal, such as the Waste Framework Directive, <a href=\"https:\/\/www.esgdive.com\/news\/european-commission-sustainable-products-plan\/747022\/\" target=\"_blank\" rel=\"noopener\">Ecodesign for Sustainable Products Regulation<\/a> and <a href=\"https:\/\/www.packagingdive.com\/news\/ppwr-published-eu-journal\/737939\/\" target=\"_blank\" rel=\"noopener\">Packaging and Packaging Waste Regulation<\/a>, the Commission said.\u00a0<\/p>\n<p>\u201cThese initiatives cannot unfold their potential unless the barriers to circularity in the single market are removed and there is sufficient and cost-effective supply of high-quality, verifiable secondary raw materials,\u201d the Commission said in the evidence call.<\/p>\n<p>It is too early for the Commission to speculate on the CEA\u2019s potential impacts on third countries, a spokesperson said in an email to ESG Dive. But the text of the Clean Industrial Deal notes that the CEA could include \u201cmeasures to make recycling of critical raw materials waste within the Union more attractive than their export\u201d to support the <a href=\"https:\/\/www.esgdive.com\/news\/eu-passes-net-zero-industry-act-domestic-supply-climate-chain-ira-iija-chips\/707018\/\" target=\"_blank\" rel=\"noopener\">Critical Raw Materials Act.<\/a> Additionally, the European Parliament asked that the Clean Industrial Deal\u2019s circular economy provisions include \u201cexport monitoring\u201d of \u201cthose secondary raw materials that are strategic\u201d and to \u201ctackle any imbalance in their supply and demand, including by exploring export restrictions,\u201d in a June <a href=\"https:\/\/www.europarl.europa.eu\/doceo\/document\/TA-10-2025-0137_EN.html\" target=\"_blank\" rel=\"noopener\">statement addressed to the Commission<\/a>.\u00a0\u00a0<\/p>\n<p>European recycling industry groups have also called on the EU for increased protections for the European market. Plastics Recyclers Europe <a href=\"https:\/\/www.plasticsrecyclers.eu\/news\/crisis-in-eu-plastic-recycling-demands-immediate-action\/\" target=\"_blank\" rel=\"noopener\">released a May report<\/a> noting that their industry saw slowed growth in 2023, down to 6%, compared to 17% in 2021 and 10% in 2022. In a subsequent <a href=\"https:\/\/www.plasticsrecyclers.eu\/news\/safeguarding-europes-plastics-recycling-future\/\" target=\"_blank\" rel=\"noopener\">position paper,<\/a> the group demanded that \u201cthe persistent threat of low-cost, unverified imports of both virgin and recycled plastics be addressed urgently, as they distort the market, erode competitiveness and pose a risk to the EU\u2019s circular economy,\u201d according to a press release.\u00a0<\/p>\n<p>An April 2025 position paper on the CEA by the <a href=\"https:\/\/euric.org\/resource-hub\/reports-studies\/eu-recyclers-key-policy-asks-for-the-circular-economy-act\" target=\"_blank\" rel=\"noopener\">European Recycling Industries\u2019 Confederation<\/a> echoed that sentiment: \u201cThe EU market is being flooded with both imported virgin and recycled plastics \u2026 from third countries with lower environmental and labour standards.&#8221;<\/p>\n<p>Stakeholders, including NGOs, businesses, trade organizations and third country trading partners, are <a href=\"https:\/\/ec.europa.eu\/info\/law\/better-regulation\/have-your-say\/initiatives\/14812-Circular-Economy-Act_en\" target=\"_blank\" rel=\"noopener\">invited to weigh in<\/a> on the Circular Economy Act until Nov. 6, according to the call for evidence.
