{"id":337010,"date":"2025-08-11T23:56:10","date_gmt":"2025-08-11T23:56:10","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/337010\/"},"modified":"2025-08-11T23:56:10","modified_gmt":"2025-08-11T23:56:10","slug":"wikipedia-can-challenge-online-safety-act-if-strictest-rules-apply-to-it-says-judge-wikipedia","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/337010\/","title":{"rendered":"Wikipedia can challenge Online Safety Act if strictest rules apply to it, says judge | Wikipedia"},"content":{"rendered":"<p class=\"dcr-130mj7b\">The operator of <a href=\"https:\/\/www.theguardian.com\/technology\/wikipedia\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" target=\"_blank\" rel=\"noopener\">Wikipedia<\/a> has been given permission by a high court judge to challenge the Online Safety Act if it is categorised as a high-risk platform, which would impose the most stringent duties.<\/p>\n<p class=\"dcr-130mj7b\">The Wikimedia Foundation has said it might be forced to reduce how many people can access the site in order to comply with the regulations if it is classified <a href=\"https:\/\/www.theguardian.com\/technology\/2025\/apr\/24\/what-are-the-ofcom-measures-to-protect-children-online-and-will-they-work\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">as a category 1 provider<\/a> by Ofcom later this summer.<\/p>\n<p class=\"dcr-130mj7b\">As a non-profit, the site said, it \u201cwould face huge challenges to meet the large technological and staffing needs\u201d required to comply with the duties, which include user-verification requirements, stringent protections for users and regular reporting responsibilities to prevent the spread of harmful content.<\/p>\n<p class=\"dcr-130mj7b\">The Wikimedia Foundation calculated that the number of people in the UK who access Wikipedia would have to be reduced by about three-quarters in order for the site to not qualify as a category 1 service, which is defined as a large user-to-user platform that uses algorithmic contender recommendations.<\/p>\n<p class=\"dcr-130mj7b\">It said Wikipedia was different to other sites expected to be labelled as category 1 providers, such as Facebook, X and Instagram, because it was run by a charity and its users typically only encountered content that they sought out.<\/p>\n<p class=\"dcr-130mj7b\">Mr Justice Johnson refused Wikipedia\u2019s <a href=\"https:\/\/www.theguardian.com\/technology\/2025\/may\/08\/wikipedia-challenging-uk-law-it-says-exposes-it-to-manipulation-and-vandalism\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">legal challenge<\/a> in the high court on several grounds, but he noted that the site \u201cprovides significant value for freedom of speech and expression\u201d and added that the outcome did not give Ofcom or the government \u201ca green light to implement a regime that would significantly impede Wikipedia\u2019s operations\u201d.<\/p>\n<p class=\"dcr-130mj7b\">Any decision to make Wikipedia a category 1 provider would have to be \u201cjustified as proportionate if it were not to amount to a breach of the right to freedom of expression\u201d, he said, but he added that it would be \u201cpremature\u201d to rule on this since Ofcom had not yet determined that Wikipedia was a category 1 service.<\/p>\n<p class=\"dcr-130mj7b\">If Ofcom determines that Wikipedia is a category 1 service and this means Wikipedia is unable to operate as at present, Johnson suggested that the technology secretary, Peter Kyle, should \u201cconsider whether to amend the regulations or to exempt categories of service from the act\u201d and said Wikipedia could bring a further challenge if he did not.<\/p>\n<p class=\"dcr-130mj7b\">Phil Bradley-Schmieg, the lead counsel at the Wikimedia Foundation, said: \u201cWhile the decision does not provide the immediate legal protections for Wikipedia that we hoped for, the court\u2019s ruling emphasised the responsibility of Ofcom and the UK government to ensure Wikipedia is protected as the OSA [Online Safety Act] is implemented.<\/p>\n<p><a data-ignore=\"global-link-styling\" href=\"#EmailSignup-skip-link-10\" class=\"dcr-jzxpee\">skip past newsletter promotion<\/a><\/p>\n<p class=\"dcr-1xjndtj\">Our morning email breaks down the key stories of the day, telling you what\u2019s happening and why it matters<\/p>\n<p><strong>Privacy Notice: <\/strong>Newsletters may contain info about charities, online ads, and content funded by outside parties.
