Hodges ruling that legalized same-sex marriage.<\/li>\n<li>Legal experts believe the Supreme Court is unlikely to overturn the ruling.<\/li>\n<li>President Donald Trump&#8217;s stance on same-sex marriage has varied over the years, from supporting domestic partnerships to opposing same-sex marriage, and later saying he was &#8220;fine&#8221; with it.<\/li>\n<\/ul>\n<p>The <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/07\/24\/supreme-court-marriage-equality-overturn-obergefell\/85360954007\/\" target=\"_blank\" rel=\"noreferrer noopener\">U.S. Supreme Court<\/a> has officially been asked to overturn the 2015 decision that granted <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2024\/12\/16\/donald-trump-stance-gay-same-sex-marriage\/76426168007\/\" target=\"_blank\" rel=\"noreferrer noopener\">equal marriage rights to LGBTQ+ couples<\/a>.<\/p>\n<p>Kim Davis, a former Kentucky county clerk who refused to issue marriage licenses, filed an appeal on July 24 about the compensation she was ordered to pay to a gay couple she denied a license. She asked the court, which holds a conservative supermajority, to overturn <a href=\"https:\/\/www.usatoday.com\/story\/opinion\/voices\/2025\/06\/26\/obergefell-hodges-same-sex-marriage-supreme-court\/84290817007\/\" target=\"_blank\" rel=\"noreferrer noopener\">Obergefell v. Hodges<\/a>.<\/p>\n<p>But legal experts previously told USA TODAY that the court is unlikely to overturn that ruling. Also, President\u00a0<a href=\"https:\/\/www.usatoday.com\/news\/politics\/joe-biden\/\" target=\"_blank\" rel=\"noreferrer noopener\">Joe Biden<\/a>\u00a0signed the <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2022\/11\/29\/gay-marriage-rights-senate-vote-expected-respect-marriage-act\/10791064002\/\" target=\"_blank\" rel=\"noreferrer noopener\">Respect for Marriage Act<\/a> in 2022, which passed through Congress with bipartisan support and requires all states to recognize same-sex and interracial marriages.<\/p>\n<p class=\"related-link\"><strong style=\"margin-right:3px\">More: <\/strong><a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/07\/24\/supreme-court-marriage-equality-overturn-obergefell\/85360954007\/\" rel=\"noreferrer noopener\" target=\"_blank\">Kim Davis refused same-sex marriage license in 2015. Now she wants to cancel gay marriage.<\/a><\/p>\n<p>Where does Trump stand on same-sex marriage?<\/p>\n<p>The White House did not weigh in on the appeal request or the possibility of the right being taken away. But Trump has given varied stances on same-sex marriage.<\/p>\n<p>Trump expressed support for domestic partnerships in an\u00a0<a href=\"https:\/\/books.google.com\/books?id=smMEAAAAMBAJ&amp;pg=PA27&amp;dq=%22Donald+Trump%22+AND+%22gay+rights%22&amp;hl=en&amp;ei=-RWWTeCDEuLeiAKun8WdCQ&amp;sa=X&amp;oi=book_result&amp;ct=result&amp;resnum=6&amp;ved=0CE4Q6AEwBQ%20-%20v=onepage&amp;q=%22Donald%20Trump%22%20AND%20%22gay%20rights%22&amp;f=falselonghttp:\/\/books.google.com\/books?id=smMEAAAAMBAJ&amp;pg=PA27&amp;dq=%22Donald+Trump%22+AND+%22gay+rights%22&amp;hl=en&amp;ei=-RWWTeCDEuLeiAKun8WdCQ&amp;sa=X&amp;oi=book_result&amp;ct=result&amp;resnum=6&amp;ved=0CE4Q6AEwBQ#v=onepage&amp;q=%22Donald%20Trump%22%20AND%20%22gay%20rights%22&amp;f=false\" target=\"_blank\" rel=\"noreferrer noopener\">interview he did with The Advocate<\/a>\u00a0in 2000, as reported by\u00a0<a href=\"https:\/\/www.cbsnews.com\/news\/trump-harris-lgbtq-rights-2024\/\" target=\"_blank\" rel=\"noreferrer noopener\">CBS News<\/a>. The signal of support came at a time when many in the GOP\u00a0<a href=\"https:\/\/www.nytimes.com\/2001\/09\/26\/us\/house-approves-dc-s-law-on-rights-of-domestic-partners.html\" target=\"_blank\" rel=\"noreferrer noopener\">did not share such a stance<\/a>.<\/p>\n<p>Later, in 2011 he said on Fox News he was not &#8220;in <a href=\"https:\/\/www.politico.com\/story\/2011\/02\/trump-gays-yes-gay-marriage-no-049527\" target=\"_blank\" rel=\"noreferrer noopener\">favor of gay marriage<\/a>,&#8221; and in 2015, he told CNN he supported\u00a0<a href=\"https:\/\/www.youtube.com\/watch?v=8fT7Np6PFao\" target=\"_blank\" rel=\"noreferrer noopener\">&#8220;traditional marriage<\/a>.\u201d But days after being elected in 2016 in a &#8220;60 Minutes&#8221; interview, he said he was\u00a0<a href=\"https:\/\/www.nbcnews.com\/feature\/nbc-out\/trump-says-he-s-fine-gay-marriage-60-minutes-interview-n683606\" target=\"_blank\" rel=\"noreferrer noopener\">&#8220;fine&#8221; with same-sex marriage<\/a>, a far cry from the\u00a0<a href=\"https:\/\/www.presidency.ucsb.edu\/documents\/2016-republican-party-platform\" target=\"_blank\" rel=\"noreferrer noopener\">2016 GOP platform<\/a>, which critiqued the Supreme Court decision that granted the federal right.<\/p>\n<p>But throughout his first term and re-election campaign, he appointed some people with a history of advocating against same-sex marriage, including Supreme Court Justice Amy Coney Barrett, <a href=\"https:\/\/glaad.org\/gap\/donald-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">according to GLAAD<\/a>.<\/p>\n<p>During the 2024 presidential campaign, the GOP&#8217;s official platform removed explicit mentions of same-sex marriage, saying only &#8220;Republicans will promote a Culture that values the Sanctity of Marriage, the blessings of childhood, the foundational role of families, and supports working parents.&#8221;<\/p>\n<p>When asked by NBC News if Trump planned to roll back same-sex marriage, incoming press secretary Karoline Leavitt,\u00a0said &#8220;that was never a campaign promise that he made,\u201d the outlet <a href=\"https:\/\/www.nbcnews.com\/nbc-out\/trump-gay-marriage-fertility-treatments-inauguration-rcna181715\" target=\"_blank\" rel=\"noreferrer noopener\">reported in November 2024<\/a>.<\/p>\n<p>Trump&#8217;s record on LGBTQ+ issues in his second term<\/p>\n<p>Trump has made attacking the transgender community a central part of his second term. His executive orders have aimed to ban <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/05\/06\/supreme-court-trump-transgender-military\/83408713007\/\" target=\"_blank\" rel=\"noreferrer noopener\">transgender people from serving in the military<\/a>, bar <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/08\/05\/donald-trump-2028-olympics-los-angeles-transgender-testing\/85531661007\/\" target=\"_blank\" rel=\"noreferrer noopener\">transgender student athletes<\/a> from competing in women&#8217;s sports and <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/04\/19\/judge-orders-transgender-passports-despite-trump-policy\/83175632007\/\" target=\"_blank\" rel=\"noreferrer noopener\">limit passports to only recognize someone&#8217;s sex assigned at birth<\/a>.<\/p>\n<p>The Trump administration&#8217;s federal budget cuts have also resulted in <a href=\"https:\/\/www.usatoday.com\/story\/news\/nation\/2025\/07\/17\/lgbtq-988-suicide-hotline-risks-lives-advocates\/85199972007\/\" target=\"_blank\" rel=\"noreferrer noopener\">specialized services for LGBTQ+ youth<\/a> through <a href=\"https:\/\/988lifeline.org\/current-events\/the-lifeline-and-988\/\" target=\"_blank\" rel=\"noreferrer noopener\">988 Suicide &amp; Crisis Lifeline<\/a> being shut down in July.<\/p>\n<p>Also, while he promised to find a way to make <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/08\/05\/trump-ivf\/85505358007\/\" target=\"_blank\" rel=\"noreferrer noopener\">in vitro fertilization<\/a> more accessible, he has yet to release plans.<\/p>\n<p>Appeal to <a target=\"_blank\" href=\"https:\/\/www.usatoday.com\/news\/politics\/supreme-court\/\" data-autotag=\"a173914f-749b-454a-81ed-e37783d9c6f6\" rel=\"noopener\">SCOTUS<\/a> latest in long case following Obergefell v. Hodges<\/p>\n<p>The Supreme Court already declined to take up an appeal in Davis&#8217; case in 2020.<\/p>\n<p>Back in 2015 after the Obergefell ruling, Davis <a href=\"https:\/\/www.courier-journal.com\/story\/news\/politics\/2024\/01\/02\/same-sex-marriage-kentucky-clerk-told-to-pay-up-for-denying-licenses\/72087283007\/\" target=\"_blank\" rel=\"noreferrer noopener\">refused to issue marriage licenses<\/a> for same-sex couples as a county clerk in Kentucky. An evangelical Christian, she argued issuing those licenses would conflict with her religious beliefs, and even served a brief stint in jail for contempt of court.<\/p>\n<p>David Ermold and David Moore, a gay couple who Davis denied licenses, sued over the incident. In 2022, U.S. District Judge David Bunning\u00a0ruled Davis could not claim her own constitutional right as a defense in violating the rights of others when acting in an official capacity as an elected official.
