{"id":360934,"date":"2025-08-21T02:18:10","date_gmt":"2025-08-21T02:18:10","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/360934\/"},"modified":"2025-08-21T02:18:10","modified_gmt":"2025-08-21T02:18:10","slug":"confirmed-bmi-royalty-rate-from-terrestrial-us-radio-is-rising-by-nearly-24","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/360934\/","title":{"rendered":"Confirmed: BMI royalty rate from terrestrial US radio is rising by nearly 24%"},"content":{"rendered":"<p>Performance rights organization <a class=\"link-relationship\" title=\"Companies &gt; Broadcast Music, Inc (BMI) [372 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/companies\/broadcast-music-inc-bmi\/\" target=\"_blank\" rel=\"noopener\">BMI<\/a> hailed its new agreement with radio broadcasters on Tuesday (August 19), declaring that it included its \u201c<a class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/bmi-secures-largest-rate-increase-ever-for-radio-royalties-in-us\/\" target=\"_blank\" rel=\"noopener\">largest rate increase ever<\/a>\u201d for royalties paid on music played on the air in the US.<\/p>\n<p><a href=\"https:\/\/www.musicbusinessworldwide.com\/jobs\/\" target=\"_blank\" rel=\"noopener\"><img decoding=\"async\" src=\"\/files\/2025\/05\/MBW-jobs-MPU.jpg\"\/><\/a><\/p>\n<p>Now, MBW can confirm it is indeed a whopper of a raise.<\/p>\n<p>According to <a class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/files\/2025\/08\/BMI-rates-2017-2021.pdf\" target=\"_blank\" rel=\"noopener\">documents<\/a> filed with the US District Court for the Southern District of New York, AM\/FM radio stations will pay a headline rate of <strong>2.14%<\/strong> of their gross revenue for a blanket license to play songs represented by <strong>BMI<\/strong> for 2022 and 2023, rising gradually to <strong>2.20%<\/strong> for 2026-2029.<\/p>\n<p>Given that the <a class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/files\/2025\/08\/BMI-rates-2017-2021.pdf\" target=\"_blank\" rel=\"noopener\">previous agreement<\/a> between BMI and the radio stations represented by the <strong>Radio Music License Committee<\/strong> (<strong>RMLC<\/strong>) set a blanket fee rate of <strong>1.78%<\/strong> for the 2017-2021 period, that means there will ultimately be a <strong>23.6%<\/strong> increase in the rate radio stations pay for playing BMI-represented music on the air.<\/p>\n<p>The vast majority of that money (around 85%) will be distributed to the songwriters and music publishers who own the publishing rights to the songs represented by <strong>BMI<\/strong>.<\/p>\n<p>The agreement between BMI and the RMLC applies to <strong>8,895<\/strong> commercial radio stations.<\/p>\n<p>It includes discounts for digital revenue made by radio stations in the gross revenue calculation: a <strong>30%<\/strong> discount for revenue from display ads\/sponsorships on the stations\u2019 websites and apps, and a <strong>25%<\/strong> discount for revenue made from stations\u2019 streaming services.<\/p>\n<p>In the US, radio stations pay royalties on <strong>song rights<\/strong> but not on rights to music recordings, meaning artists and labels aren\u2019t paid for terrestrial radio broadcasts of their music.<\/p>\n<p>BMI\u2019s increase is likely to represent a not-insubstantial windfall for song copyright owners.<\/p>\n<p>In June, the <strong>National Music Publishers\u2019 Association<\/strong> (<a class=\"link-relationship\" title=\"Companies &gt; National Music Publishers&#039; Association (NMPA) [291 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/companies\/national-music-publishers-association-nmpa\/\" target=\"_blank\" rel=\"noopener\">NMPA<\/a>) said that US music publishing wholesale revenue <a class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/us-music-publishing-revenue-jumped-13-4-to-7bn-in-2024-outpacing-the-growth-of-rate-of-recorded-music\/\" target=\"_blank\" rel=\"noopener\">hit <strong>$7.04 billion<\/strong><\/a> in 2024.<\/p>\n<p>The NMPA estimates that\u00a0<strong>8%<\/strong>\u00a0of that revenue came from radio, which implies around\u00a0<strong>$563 million<\/strong> in US radio revenue for publishers\u00a0in 2024.<\/p>\n<p><a class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/files\/2025\/08\/Screenshot-2025-08-20-at-15.10.41.jpg\" target=\"_blank\" rel=\"noopener\"><img class=\"lazyload\" bad-src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/08\/Screenshot-2025-08-20-at-15.10.41-80x45.jpg\"  data-\/><\/a>Source: NMPA<\/p>\n<p>Meanwhile, <strong>S&amp;P Global<\/strong> <a class=\"link-external\" href=\"https:\/\/www.spglobal.com\/market-intelligence\/en\/news-insights\/research\/radio-tv-station-annual-outlook-2024\" target=\"_blank\" rel=\"noopener\">estimates<\/a> that traditional radio stations in the US made <strong>$11.24 billion<\/strong> in ad revenue in 2024. (That figure includes talk and sports stations, as well as music-led networks.)<\/p>\n<p>That said, terrestrial radio revenues in the US are shrinking as advertising dollars shift to digital.<\/p>\n<p>The 2024 revenue was down <strong>3.7%<\/strong> from the previous year, per S&amp;P Global, which forecasts revenues will shrink further to <strong>$10.08 billion<\/strong> by 2029.<\/p>\n<p>Shortly after BMI announced it had struck a deal with the RMLC, another major PRO \u2013 <a class=\"link-relationship\" title=\"Companies &gt; American Society of Composers, Authors, and Publishers (ASCAP) [383 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/companies\/american-society-of-composers-authors-and-publishers-ascap\/\" target=\"_blank\" rel=\"noopener\">ASCAP<\/a> \u2013 announced it too had <a class=\"link-internal\" href=\"https:\/\/www.musicbusinessworldwide.com\/ascap-secures-higher-rates-in-settlement-with-us-radio-broadcasters\/\" target=\"_blank\" rel=\"noopener\">struck a deal with the RMLC<\/a>.<\/p>\n<p>Court records show that ASCAP and the RMLC moved on August 15 to have their ongoing case over royalty rates dismissed, but the court filings didn\u2019t disclose the terms of that agreement.<\/p>\n<p>BMI and ASCAP are generally considered to be the two largest PROs operating in the United States, but the field has seen some new entrants in recent years, including <strong><a class=\"link-relationship\" title=\"People &gt; Irving Azoff [115 articles]\" href=\"https:\/\/www.musicbusinessworldwide.com\/people\/irving-azoff\/\" target=\"_blank\" rel=\"noopener\">Irving Azoff<\/a><\/strong>\u2019s <strong>Global Music Rights<\/strong> (<strong>GMR<\/strong>). According to a <a class=\"link-external\" href=\"https:\/\/www.insideradio.com\/free\/bmi-rates-to-be-impacted-by-court-ruling-on-royalty-rates\/article_f93bd230-8c59-11ef-92ea-c7fe537e7022.html\" target=\"_blank\" rel=\"noopener\">report<\/a> at Inside Radio, GMR\u2019s own deal with radio stations may have influenced the BMI deal. The federal court adjudicating between BMI and the RMLC allowed GMR\u2019s deal to be entered into evidence in the case.<\/p>\n<p>Until recently, both BMI and ASCAP operated on a not-for-profit basis, and BMI itself was owned by a consortium of radio stations.
