{"id":362086,"date":"2025-08-21T13:02:12","date_gmt":"2025-08-21T13:02:12","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/362086\/"},"modified":"2025-08-21T13:02:12","modified_gmt":"2025-08-21T13:02:12","slug":"isak-legal-leverage-over-newcastle-to-force-transfer-as-free-agent-in-2026-revealed","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/362086\/","title":{"rendered":"Isak &#8216;legal leverage&#8217; over Newcastle to force transfer as &#8216;free agent&#8217; in 2026 revealed"},"content":{"rendered":"<p>Alexander Isak and his representatives could invoke Article 17 to force a move to Liverpool next summer as a free agent, when Newcastle would be due far less than the \u00a3110m Reds bid in compensation.<\/p>\n<p>Isak released a statement on Tuesday confirming he has no intention of playing for Newcastle again as a result of \u2018broken promises\u2019.<\/p>\n<p><strong><a href=\"https:\/\/www.football365.com\/news\/newcastle-refuse-to-be-bullied-into-liverpool-sale-by-alexander-isak-statement\" target=\"_blank\" rel=\"noopener\">Isak said on Instagram<\/a><\/strong>: \u201cI\u2019ve kept quiet for a long time while others have spoken.<\/p>\n<p>\u201cThat silence has allowed people to push their own version of events, even though they know it doesn\u2019t reflect what was really said and agreed behind closed doors.<\/p>\n<p>\u201cThe reality is that promises were made and the club has known my position for a long time. To now act as if these issues are only emerging is misleading.<\/p>\n<p>\u201cWhen promises are broken and trust is lost, the relationship can\u2019t continue. We do not foresee these conditions being met.\u201d<\/p>\n<p>It leaves Isak in limbo, with Liverpool unlikely to bid again until doors are opened that Newcastle insist will remain closed.<\/p>\n<p>But <strong><a rel=\"noopener\" href=\"https:\/\/www.espn.co.uk\/football\/story\/_\/id\/46010345\/fifa-rule-article-17-isak-leverage-newcastle-liverpool-transfers\" target=\"_blank\">ESPN\u2019s Gabriele Marcotti has revealed<\/a><\/strong> the \u2018legal leverage\u2019 Isak and his camp hold over Newcastle, which he believes \u2018explains why they have been so aggressive in trying to engineer a move out of the club\u2019.<\/p>\n<p>As Marcotti explains, Article 17 is the key. FIFA were pressured into adding the article to their regulations by the European Commission 20 years ago as they believed the transfer system restricted the freedom of players to change jobs like ordinary people.<\/p>\n<p>For a long time, until last October\u2019s judgement on Lassana Diarra, the conditions were deemed too restrictive and the compensation set to be paid so uncertain that Article 17 wasn\u2019t seen as a realistic course of action for players to force exits from clubs.<\/p>\n<p>But the Diarra judgement forced FIFA to rewrite their rules, which are \u2018definitely more player friendly than the previous ones\u2019, writes Marcotti.<\/p>\n<blockquote>\n<p>\u2018For a start, several significant hurdles have been removed. Previously, FIFA could withhold the player\u2019s transfer certificate until the matter was resolved. No more. The club who signed an Article 17 player had to prove they didn\u2019t collude with him to cause the breach of contract. That\u2019s gone, too. No\u2026 Newcastle, Isak, his agent, Saudis, the media all cop the blame<\/a><\/strong><br \/><strong>\ud83d\udc49 <a href=\"https:\/\/www.football365.com\/news\/liverpool-transfer-verbally-agreed-advanced-stage-isak-allowed-to-go-three-conditions-met\" target=\"_blank\" rel=\"noopener\">Liverpool transfer \u2018verbally agreed\u2019 at \u2018advanced stage\u2019 as Isak \u2018allowed to go\u2019 if three conditions met<\/a><\/strong><br \/><strong>\ud83d\udc49 <a href=\"https:\/\/www.football365.com\/news\/alexander-isak-let-down-liverpool-newcastle-opinion\" target=\"_blank\" rel=\"noopener\">Alexander Isak should be raging at Liverpool, not Newcastle United<\/a><\/strong><\/p>\n<p>The rules state that the compensation is calculated based on the wages Isak would have earned in his last two seasons (\u00a312.5m), his remaining value on Newcastle\u2019s books (\u00a320m) and the cost of signing a replacement.<\/p>\n<p>Article 17 can be invoked within 15 days of the final game of the season and only by players who have had a full three years under contract \u2013 a condition Isak has already met.<\/p>\n<p>There\u2019s no fixed amount, with the figure arrived at on a case-by-case basis, and Newcastle could appeal and win more compensation, but as Marcotti crucially reveals, that appeal wouldn\u2019t stop Isak playing for a new club.<\/p>\n<p>He adds:<\/p>\n<blockquote>\n<p>\u2018The wheels of compensation tribunals grind slowly: a final judgment could take 18 months to 2 years, but under FIFA\u2019s tweaked rules, the player would be free to play for his new club straight away.
