The Government&#13;<br \/>\npassed legislation on 14 July to bring Deferred Payment Credit&#13;<br \/>\n(DPC), commonly known as BNPL, under regulation starting 15 July&#13;<br \/>\n2026 for third-party lenders, and on 18 July the Financial Conduct&#13;<br \/>\nAuthority (FCA) published a Consultation Paper (CP25\/23) on the&#13;<br \/>\nproposed regulatory regime for BNPL.<\/p>\n<p><a href=\"http:\/\/www.mondaq.com\/redirection.asp?article_id=1668912&amp;company_id=18610&amp;redirectaddress=https:\/\/www.addleshawgoddard.com\/link\/5e3b47b86151404dad3196ed0b30b4f4.aspx\" target=\"_blank\" rel=\"noopener\">Read more here on the FCA&#8217;s proposed regime&#13;<br \/>\nfor BNPL and the upcoming milestones<\/a><\/p>\n<p>Motor Commission Supreme Court Judgment &#8211; Hopcraft and another&#13;<br \/>\nv Close Brothers Limited<\/p>\n<p>On Friday 1 August, the UK Supreme Court handed down its&#13;<br \/>\nlong-awaited judgment in the conjoined appeals of Hopcraft v&#13;<br \/>\nClose Brothers, Johnson v FirstRand Bank t\/a MotoNovo Finance, and&#13;<br \/>\nWrench v FirstRand Bank t\/a MotoNovo Finance ([2025] UKSC 33).&#13;<br \/>\nThe Court held that car dealers arranging motor finance do not owe&#13;<br \/>\nfiduciary duties to customers, meaning lenders are not liable for&#13;<br \/>\nbribery or dishonest assistance. However, undisclosed commissions&#13;<br \/>\nmay still render agreements unfair under section 140A of the&#13;<br \/>\nConsumer Credit Act, depending on the facts.
