Islamic law is allowed for arbitrations if both parties agree to it. In a recent case, two men had signed a contract stating that, in the case of conflicts, an arbitration tribunal <a data-link-tracking=\"InArticle|Link\" title=\"GB News stars revolt as UK government &#039;hires Sharia Law expert&#039;\" href=\"https:\/\/www.express.co.uk\/showbiz\/tv-radio\/2087623\/gb-news-revolt-sharia-court-law\" target=\"_blank\" rel=\"noopener\">would decide &#8220;based on Islamic law<\/a>&#8230;in accordance with equity in the matter to the best knowledge and belief&#8221;.\u00a0<\/p>\n<p>The arbitration tribunal concluded that the plaintiff must pay \u20ac320,000 (\u00a3277,000), so he brought his suit before the Vienna Regional Court for Civil Matters. He <a data-link-tracking=\"InArticle|Link\" title=\"Brits warned as &#039;deeply worrying&#039; UK Sharia law job advert sparks fury\" href=\"https:\/\/www.express.co.uk\/news\/uk\/2088111\/brits-warned-uk-sharia-law-job-advert\" target=\"_blank\" rel=\"noopener\">questioned the application of Islamic law<\/a> given that it can be interpreted differently by different people, and argued that it went against Austrian law.<\/p>\n<p>However, the secular court upheld the arbitration tribunal&#8217;s decision, ruling that the original outcome did not go against Austrian fundamental values.<\/p>\n<p>Islamic legal provisions could be &#8220;effectively agreed upon in an arbitration agreement&#8221; for property claims, the Regional Court added.<\/p>\n<p>Michael Schilchegger, an MP and speaker on constitutional law for <a data-link-tracking=\"InArticle|Link\" title=\"What EU chiefs are banking on after right-wing Austrian surge sparks fears in...\" href=\"https:\/\/www.express.co.uk\/news\/politics\/1955129\/eu-right-wing-austrian-brussels\" target=\"_blank\" rel=\"noopener\">the right-wing Austrian Freedom Party<\/a>, called it a &#8220;sad day for the secular constitutional state&#8221;.<\/p>\n<p>He said: &#8220;This opens the door even wider for political Islam.\u00a0The ruling elevates Islamic parallel societies in Austria and weakens those forces that do not want to submit to Islam. A sad day for the secular constitutional state.&#8221;<\/p>\n<p>Fellow party member Manfred Haimbuchner said Sharia law &#8220;violates all moral standards&#8221; of Austria.<\/p>\n<p>He added: &#8220;Sharia law is incompatible with the Austrian understanding of law and violates all moral standards that I am familiar with.
