{"id":369582,"date":"2025-08-24T11:11:16","date_gmt":"2025-08-24T11:11:16","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/369582\/"},"modified":"2025-08-24T11:11:16","modified_gmt":"2025-08-24T11:11:16","slug":"cost-of-former-ceo-employment-dispute-at-childrens-health-ireland-exceeds-e160000-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/369582\/","title":{"rendered":"Cost of former CEO employment dispute at Children\u2019s Health Ireland exceeds \u20ac160,000 \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">The costs of an employment dispute involving the former chief executive at <a href=\"https:\/\/www.irishtimes.com\/tags\/children-s-health-ireland-chi-at-crumlin\/\" rel=\"noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/children-s-health-ireland-chi-at-crumlin\/\" target=\"_blank\">Children\u2019s Health Ireland<\/a> (CHI), the group that runs paediatric hospitals in Dublin, are now known to be more than \u20ac160,000.<\/p>\n<p class=\"c-paragraph paywall \">The issue relates to proposals for a third term for former chief executive Eil\u00edsh Hardiman, which had clashed with Government policy on term limits. <\/p>\n<p class=\"c-paragraph paywall \">CHI said it has now paid \u20ac39,911 as one party to a mediation process dealing with the future role of Ms Hardiman.<\/p>\n<p class=\"c-paragraph paywall \">A meeting of the D\u00e1il <a href=\"https:\/\/www.irishtimes.com\/tags\/public-accounts-committee\/\" rel=\"noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/public-accounts-committee\/\" target=\"_blank\">Public Accounts Committee<\/a> (Pac) last month was told Ms Hardiman\u2019s legal costs of \u20ac123,000 were paid by the office of the Chief State Solicitor.<\/p>\n<p class=\"c-paragraph paywall \">The hospital group told The Irish Times that the amount of \u20ac39,911 \u201crelates solely to CHI\u2019s legal costs as one party to the mediation process\u201d. The Chief State Solicitor\u2019s Office did not pay CHI\u2019s legal fees, it said.<\/p>\n<p class=\"c-paragraph paywall \">The employment issue arose last year after the then minister for health, <a href=\"https:\/\/www.irishtimes.com\/tags\/stephen-donnelly\/\" target=\"_self\" rel=\"noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/stephen-donnelly\/\">Stephen Donnelly<\/a>, invoked Government policy that the chief executives of non-commercial State organisations should serve no more than two consecutive terms. He would not agree to sanction a third term for Ms Hardiman as CHI chief executive.<\/p>\n<p class=\"c-paragraph paywall \">The Irish Times reported last year that CHI\u2019s board had wanted to reappoint Ms Hardiman for another term but this was rejected by Mr Donnelly.<\/p>\n<p class=\"c-paragraph paywall \">In a letter to the minister in December 2023, the then board chairman, Dr Jim Browne, said CHI was \u201csurprised and disappointed\u201d that its proposal to reappoint Ms Hardiman had not been accepted. <\/p>\n<p class=\"c-paragraph paywall \">He argued it would take months to recruit a new chief executive and that the board believed stability and continuity of leadership were needed as the organisation prepared for the move to the new national children\u2019s hospital.<\/p>\n<p class=\"c-paragraph paywall \">At the Pac meeting in July Ms Hardiman said she had initiated legal action on the issue.<\/p>\n<p class=\"c-paragraph paywall \">The issue centred on a clash between Government policy governing term limits for chief executives and whether, under provisions of employment law, Ms Hardiman was entitled to a long-term position.<\/p>\n<p class=\"c-paragraph paywall \">\u201cThe board, in October 2023, sought a third term after my two previous consecutive five-year fixed-term contracts,\u201d Ms Hardiman told the committee. <\/p>\n<p class=\"c-paragraph paywall \">\u201cIt is Government practice and policy for non-commercial State board CEOs to be appointed for no more than two concurrent five-year terms. The minister applied that policy, which is within his right to do, and that was accepted by the board. Because it is an employment matter and because it was two fixed terms, the contract automatically became a contract of indefinite duration.\u201d<\/p>\n<p class=\"c-paragraph paywall \">Following a mediation process, Ms Hardiman was <a href=\"https:\/\/www.irishtimes.com\/politics\/2025\/05\/15\/childrens-health-pay-public-accounts\/\" target=\"_self\" rel=\"noopener\" title=\"https:\/\/www.irishtimes.com\/politics\/2025\/05\/15\/childrens-health-pay-public-accounts\/\">appointed in April last year to a new post<\/a> of strategic programme director at CHI on her previous salary.<\/p>\n<p class=\"c-paragraph paywall \">Fianna F\u00e1il TD S\u00e9amus McGrath had sought clarity on the amounts paid out in respect of legal fees as well as on any other external or professional services in relation to the mediation process.<\/p>\n<p class=\"c-paragraph paywall \">He criticised the amount paid out as part of the resolution.<\/p>\n<p class=\"c-paragraph paywall \">\u201cWhen CHI was before the Public Accounts Committee recently, they were not able to provide full details of the entire professional fees associated with the dispute resolution process involving the former chief executive,\u201d he said this weekend. <\/p>\n<p class=\"c-paragraph paywall \">\u201cWe now know some additional fees, which brings the disclosed amount so far to an extraordinary figure. I will be further questioning if this is the entirety of the fees involved as I believe more clarification is needed.
