You can\u00a0<a href=\"https:\/\/connect.cma.gov.uk\/44007\/widgets\/131813\/documents\/89783\" rel=\"noreferrer noopener\" style=\"box-sizing: border-box; background-color: transparent; color: rgb(55, 112, 202); text-decoration-line: none; cursor: pointer;\" target=\"_blank\">find the revised draft guidance here<\/a>.\u00a0<\/p>\n<p>This consultation follows an earlier consultation in 2024 and reflects updates introduced by the<strong>\u00a0Digital Markets, Competition and Consumers Act 2024 (DMCCA)<\/strong>, wider legislative changes, and developments in CMA practice. The new draft also consolidates several existing documents into a single piece of guidance.<\/p>\n<p><strong>What is changing?\u00a0<\/strong><\/p>\n<p>At the centre of the proposals is the CMA\u2019s new\u00a0<strong>\u20184Ps\u2019 framework<\/strong>\u00a0&#8211; pace, predictability, proportionality and process. The authority has set out a series of adjustments it believes will make its markets regime clearer and more efficient.\u00a0<\/p>\n<p>Among the proposed changes are the introduction of\u00a0<strong>Project Roadmaps,<\/strong>\u00a0which would outline key stages, timelines, and engagement points at the outset of each market study or investigation. The CMA also intends to make greater use of\u00a0<strong>sector expertise<\/strong>\u00a0to support its analysis, and to hold more regular\u00a0<strong>\u2018state of play\u2019 meetings<\/strong>\u00a0and early updates to give businesses greater visibility on how investigations are progressing.\u00a0<\/p>\n<p>The consultation also outlines plans for more structured engagement with affected parties, including launch webinars and teach-in sessions, and a revised approach to interim reports. At the same time, the CMA is considering ways to\u00a0<strong>streamline its processes\u00a0<\/strong>by tailoring project timings, limiting the publication of certain working papers, and introducing measures to shorten overall investigation timescales.\u00a0<\/p>\n<p>There are also proposed updates to the CMA\u2019s approach to<strong>\u00a0remedies.<\/strong>\u00a0These include greater use of undertakings in lieu of market investigations, sunset clauses for orders, clearer processes for monitoring compliance, and guidance on how remedies can be reviewed or withdrawn. The guidance also reflects new powers granted under the DMCCA, such as the ability to run remedy trials, amend or revoke outdated remedies, and accept undertakings earlier in the process.\u00a0<\/p>\n<p>Finally, the CMA proposes to<strong>\u00a0consolidate six existing guidance documents\u00a0<\/strong>into this new regime guidance, aiming to create a single source of information for businesses and stakeholders.\u00a0<\/p>\n<p><strong>Consultation questions\u00a0<\/strong><\/p>\n<p>The CMA is inviting views on:\u00a0<\/p>\n<ul>\n<li>Whether the proposed changes are clear and useful.\u00a0<\/li>\n<li>Areas of the draft that may need further clarification.\u00a0<\/li>\n<li>The proposal to update and consolidate the guidance.\u00a0<\/li>\n<\/ul>\n<p><strong>How to respond\u00a0<\/strong><\/p>\n<p>The consultation closes at 5pm on 1 October 2025.
