{"id":392700,"date":"2025-09-02T19:47:16","date_gmt":"2025-09-02T19:47:16","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/392700\/"},"modified":"2025-09-02T19:47:16","modified_gmt":"2025-09-02T19:47:16","slug":"nhs-nurses-tribunal-over-trans-doctors-use-of-changing-room-hears-final-evidence-uk-news","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/392700\/","title":{"rendered":"NHS nurse\u2019s tribunal over trans doctor\u2019s use of changing room hears final evidence | UK news"},"content":{"rendered":"<p class=\"dcr-130mj7b\">An employment tribunal brought by an <a href=\"https:\/\/www.theguardian.com\/society\/nhs\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" target=\"_blank\" rel=\"noopener\">NHS<\/a> Fife nurse who objected to sharing a changing room with a transgender doctor has concluded its evidence with conflicting interpretations of how the supreme court\u2019s landmark ruling on sex affects the case.<\/p>\n<p class=\"dcr-130mj7b\">Sandie Peggie, who has worked as a nurse for more than 30 years, <a href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cy8p41z972vo\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">contends she was subject to unlawful harassment<\/a> under the Equality Act when she was expected to share a changing room with Dr Beth Upton.<\/p>\n<p class=\"dcr-130mj7b\">After closing submissions were heard on Monday and Tuesday in Dundee, the judge Sandy Kemp had been expected to begin his deliberations. Instead, the tribunal was thrown into chaos after a last-minute application from NHS Fife\u2019s lawyers to amend their pleadings.<\/p>\n<p class=\"dcr-130mj7b\">The tribunal began in February and reconvened in July to hear further evidence. It has been followed closely across the UK to see how <a href=\"https:\/\/www.theguardian.com\/society\/2025\/apr\/16\/critics-of-trans-rights-win-uk-supreme-court-case-over-definition-of-woman\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">April\u2019s supreme court ruling<\/a> that \u201cwoman\u201d and \u201csex\u201d in the Equality Act refer only to a biological woman and to biological sex should be applied in practice. It is likely to be used as a template for other legal actions.<\/p>\n<p class=\"dcr-130mj7b\">The application by NHS Fife could delay the outcome for months while Kemp considers it, along with any resulting appeals. Peggie\u2019s lawyer said the nurse was \u201cin tears\u201d at the prospect of further hearings.<\/p>\n<p class=\"dcr-130mj7b\">The case centres around a disputed incident which took place in a changing room at Victoria hospital in Kirkcaldy on Christmas Eve 2023, after which Upton made an allegation of bullying and harassment, leading to Peggie\u2019s suspension.<\/p>\n<p class=\"dcr-130mj7b\">In July, NHS Fife confirmed Peggie had been <a href=\"https:\/\/www.theguardian.com\/society\/2025\/jul\/16\/nurse-sandie-peggie-cleared-of-misconduct-in-trans-doctor-changing-room-row-in-scotland\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">cleared of the separate gross misconduct allegations<\/a> after an 18-month internal process.<\/p>\n<p class=\"dcr-130mj7b\">Summing up her case on Monday, Peggie\u2019s lawyer Naomi Cunningham repeatedly referenced the supreme court case brought by the gender-critical campaign group For Women <a href=\"https:\/\/www.theguardian.com\/uk\/scotland\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" target=\"_blank\" rel=\"noopener\">Scotland<\/a>. She told the tribunal: \u201cTrans women are men. That reality is enshrined in law.\u201d<\/p>\n<p class=\"dcr-130mj7b\">But Jane Russell KC, representing Fife NHS board and Upton, argued that the ruling \u201csays that service providers \u2013 it doesn\u2019t cover employers \u2013 can, but do not have to, exclude [trans women from single-sex facilities] by making use of the exceptions in schedule 3 of the Equality Act.\u201d<\/p>\n<p class=\"dcr-130mj7b\">She added: \u201cThere is no authority that says an employer must do this.\u201d<\/p>\n<p class=\"dcr-130mj7b\">Cunningham, who chairs the board of trustees for the gender-critical group Sex Matters, told the tribunal that excluding Upton was \u201cthe inevitable consequence\u201d of the For Women Scotland judgment.<\/p>\n<p class=\"dcr-130mj7b\">\u201cTrans-identifying men who possess gender recognition certificates (GRCs) are for certain purposes deemed to be women. But without a GRC they are both legally and factually simply men,\u201d she said.<\/p>\n<p class=\"dcr-130mj7b\">Upton had no GRC and therefore \u201cmust be excluded\u201d from women-only spaces, Cunningham added.<\/p>\n<p class=\"dcr-130mj7b\">She described NHS Fife as being \u201cin the grip of a delusion\u201d, and said the board had \u201ctaken on gender identity belief as its institutional position\u201d. It had then subjected the nurse to a \u201cheresy hunt\u201d when she challenged this, she said.<\/p>\n<p class=\"dcr-130mj7b\">Russell said Peggie had faced disciplinary action not because of her gender-critical beliefs, but because of the \u201cobjectionable and inappropriate\u201d way she expressed them. During the Christmas Eve altercation, Russell said Peggie had \u201crepeatedly\u201d misgendered Upton and that her reference to the convicted rapist Isla Bryson was \u201can outrageously harmful hurtful and damaging slur\u201d.<\/p>\n<p class=\"dcr-130mj7b\">\u201cThe claimant\u2019s behaviour in confronting the young doctor in a professional setting in such a way and so unpleasantly is behaviour that ought not to be served protection of the Equality Act,\u201d Russell argued.<\/p>\n<p class=\"dcr-130mj7b\">As a mark of the significance of the case, which has already cost NHS Fife nearly \u00a3220,500, a number of national groups were granted permission to intervene, including Sex Matters and the trans-led advocacy organisation TransLucent.<\/p>\n<p class=\"dcr-130mj7b\">Aspects of the case have played out in parallel on social media. Cunningham accused the board of seeking to \u201cdrive a wedge between [Peggie] and her lesbian daughter\u201d after witnesses claimed she was uncomfortable with her daughter\u2019s sexuality.
