{"id":392964,"date":"2025-09-02T22:10:20","date_gmt":"2025-09-02T22:10:20","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/392964\/"},"modified":"2025-09-02T22:10:20","modified_gmt":"2025-09-02T22:10:20","slug":"epping-asylum-hotel-supreme-court-appeal-denied","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/392964\/","title":{"rendered":"Epping asylum hotel Supreme Court appeal denied"},"content":{"rendered":"<p>David FreezerBBC News, Essex<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/09\/grey-placeholder.png\" class=\"sc-d1200759-0 dkIvM hide-when-no-script\" aria-label=\"image unavailable\"\/><img decoding=\"async\"   src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/09\/6eeac1b0-882d-11f0-b391-6936825093bd.jpg.webp.webp\" loading=\"eager\" alt=\"EPA\/Shutterstock A middle aged man with white hair stands in front of a court and speaks into microphones while wearing a blue suit and tie with a white shirt.\" class=\"sc-d1200759-0 dvfjxj\"\/>EPA\/Shutterstock<\/p>\n<p>Epping Forest District Council leader Chris Whitbread, speaking outside the Royal Court of Justice in London last month<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">A council seeking to stop an Epping hotel from housing asylum seekers has lost a legal attempt to appeal to the Supreme Court.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Epping Forest District Council had secured a temporary injunction from the High Court which would have forced migrants to leave The Bell Hotel in Epping, Essex, by 12 September.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">That was overturned <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c8e1zd98k9no\" class=\"sc-f9178328-0 bGFWdi\" rel=\"noopener\">by Court of Appeal judges last week<\/a> and has been followed by the same court ruling the case cannot go to the Supreme Court, although the council said it can now make a direct request to the higher court.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">After months of demonstrations at the hotel, Conservative council leader Chris Whitbread called for protesters to consider stepping away as the town was &#8220;under great strain&#8221;.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/09\/grey-placeholder.png\" class=\"sc-d1200759-0 dkIvM hide-when-no-script\" aria-label=\"image unavailable\"\/><img decoding=\"async\"   src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/09\/a91627c0-882e-11f0-8cfa-8fe72bd3f079.jpg.webp.webp\" loading=\"lazy\" alt=\"PA A large crowd of demonstrators, some of whom are waving flags and signs, get close to a line of police officers during a protest march.\" class=\"sc-d1200759-0 dvfjxj\"\/>PA<\/p>\n<p>Demonstrators protest to stop a police van leaving after a protester was detained by police during a march in Epping on Sunday<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">The council had argued at the High Court that the site owner, Somani Hotels, had breached planning rules by not notifying the local authority of its plans for The Bell.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">But the company and the Home Office \u2013 which places migrants at the site \u2013 successfully overturned the injunction at the Court of Appeal.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">A full High Court hearing to discuss a permanent injunction <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/live\/c1ej52299lqt\" class=\"sc-f9178328-0 bGFWdi\" rel=\"noopener\">is scheduled for October<\/a>.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">However, in the meantime, the council is considering applying directly to the Supreme Court &#8211; the UK&#8217;s highest court of appeal &#8211; about the temporary injunction being denied.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Mr Whitbread said: &#8220;We believe the Court of Appeal decision to overturn the interim injunction for the closure of The Bell Hotel was wrong.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">&#8220;However, this is not the end of the matter. We consider we have a strong case for a final injunction&#8230;  expected to be heard some time in early October.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">&#8220;In the meantime, the council is keeping all our options open, including seeking permission from the Supreme Court to appeal against the judgment of the Court of Appeal.&#8221;<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">The council said it was given &#8220;no reasons&#8221; by the Court of Appeal for denying permission for the case to be taken to the Supreme Court.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">There are 138 asylum seekers housed at the Bell, with dozens of people <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c4gerg74y71o\" class=\"sc-f9178328-0 bGFWdi\" rel=\"noopener\">arrested in connection with disorder near the hotel<\/a>, many of whom have since been charged.<\/p>\n<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/09\/grey-placeholder.png\" class=\"sc-d1200759-0 dkIvM hide-when-no-script\" aria-label=\"image unavailable\"\/><img decoding=\"async\"   src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/09\/0a594b70-882f-11f0-8cfa-8fe72bd3f079.jpg.webp.webp\" loading=\"lazy\" alt=\"EPA\/Shutterstock A blue sign with large white writing advertising a hotel is shown with five police officers standing in front of it and with police vans seen in the background.\" class=\"sc-d1200759-0 dvfjxj\"\/>EPA\/Shutterstock<\/p>\n<p>The district council is trying to stop the use of The Bell Hotel for the housing of asylum seekers<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">With many children returning to school for the first day of term on Wednesday, Conservative councillor Mr Whitbread urged potential protesters to show restraint as local people were &#8220;under great strain&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">&#8220;I support the right of local people to peacefully protest,&#8221;
