At its core, experts say the law reflects America\u2019s long-standing belief that law enforcement should remain in civilian hands, separate from military power.<\/p>\n<p>President <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-newsom-los-angeles-national-guard-d6c8450a3ac2de34e669ef0836d22cbc\" target=\"_blank\" rel=\"noopener\">Donald Trump<\/a> has tested the law\u2019s limits in the first few months of his second term, as he <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/ice-noem-trump-chicago-immigrant-pritzker-7b0e2e4589a570f1776335903619940b\" target=\"_blank\" rel=\"noopener\">expands the footprint<\/a> of the U.S. military on domestic soil.<\/p>\n<p>Here\u2019s what to know about the law.<\/p>\n<p>Posse Comitatus Act stops military from enforcing US law<\/p>\n<p>The criminal statute prohibits military enforcement of domestic law. It also prevents the military from investigating local crimes, overriding local law enforcement or compelling certain behavior.<\/p>\n<p>There are key exceptions. Congress can vote to suspend the act, or the president can order it suspended in defense of the Constitution. The Insurrection Act of 1807 allows the president to deploy troops during invasions, rebellions or when local authorities can\u2019t maintain order. <\/p>\n<p>National Guard members are under state authority and commanded by governors, so they\u2019re generally exempt. However, the Posse Comitatus Act applies to National Guard forces when they\u2019re \u201cfederalized,\u201d meaning the president puts them under his control. That\u2019s what Trump did <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/los-angeles-protests-national-guard-trump-14c9dda32663d7d2c45f2b1c5a1d219c\" target=\"_blank\" rel=\"noopener\">in California<\/a> over the governor\u2019s objections. <\/p>\n<p>The military is allowed to share intelligence and certain resources if there\u2019s an overlap with civilian law enforcement jurisdiction, according to the Library of Congress. There\u2019s also an exception for the U.S. Coast Guard, which has some law enforcement responsibilities.<\/p>\n<p>Law was enacted after the Reconstruction era<\/p>\n<p>The law was enacted in 1878 following the post-Civil War era known as Reconstruction. At that time, segregationist lawmakers didn\u2019t want the U.S. military from blocking Jim Crow laws that imposed racial segregation.<\/p>\n<p>But the spirit of the law has roots going all the way back to the Revolutionary War, when the nation\u2019s founders were scarred by the British monarchy\u2019s absolute military control, said William C. Banks, a professor at the Syracuse University College of Law. <\/p>\n<p>\u201cWe have a tradition in the United States \u2014 which is more a norm than a law \u2014 that we want law enforcement to be conducted by civilians, not the military,\u201d Banks said.<\/p>\n<p>Courts have rarely interpreted the Posse Comitatus Act, leaving much of its scope shaped by executive branch policy and military regulations rather than judicial precedent.<\/p>\n<p>Steve Vladeck, a law professor at Georgetown University, notes that this lack of legal rulings makes the law unusual.<\/p>\n<p>\u201cThere is no authoritative precedent on exactly where these lines are, and so that\u2019s why over the years the military\u2019s own interpretation has been so important,\u201d Vladeck said.<\/p>\n<p>New tests for the law<\/p>\n<p>A federal judge has ruled that the Trump administration <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/trump-newsom-los-angeles-national-guard-d6c8450a3ac2de34e669ef0836d22cbc\" target=\"_blank\" rel=\"noopener\">violated federal law<\/a> by sending troops to accompany federal agents on immigration raids <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/california-immigration-raid-troops-military-2d81f5c35f9d11db9e32234e03480497\" target=\"_blank\" rel=\"noopener\">in Los Angeles<\/a> this summer.
