{"id":395814,"date":"2025-09-03T23:48:21","date_gmt":"2025-09-03T23:48:21","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/395814\/"},"modified":"2025-09-03T23:48:21","modified_gmt":"2025-09-03T23:48:21","slug":"met-police-chief-calls-for-law-change-after-graham-linehan-arrest","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/395814\/","title":{"rendered":"Met Police chief calls for law change after Graham Linehan arrest"},"content":{"rendered":"<p class=\"sc-9a00e533-0 hxuGS\">The head of the Metropolitan Police has called on the government to &#8220;change or clarify&#8221; the law following the arrest of comedian Graham Linehan over posts he made online.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">The 57-year-old was arrested under the Public Order Act on Monday on suspicion of inciting violence in relation to posts about trans people on X.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">On Wednesday, Met Commissioner Sir Mark Rowley defended the officers involved, but said he recognised &#8220;concern caused by such incidents given differing perspectives on the balance between free speech and the risks of inciting violence in the real world&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Sir Keir Starmer said the police must &#8220;focus on the most serious issues&#8221; when asked in the Commons about the arrest.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">His arrest has prompted a backlash from some public figures and politicians, who have said it raises questions about free speech in the UK.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Earlier on Wednesday, Health Secretary Wes Streeting said the government <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cx2922w73e1o\" class=\"sc-f9178328-0 bGFWdi\" rel=\"noopener\">needed to &#8220;look at&#8221; the relevant legislation following the arrest<\/a>, adding ministers &#8220;want the police to focus on policing streets rather than tweets&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Linehan has said his arrest at Heathrow was related to three posts on X from April.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">The first post he wrote: &#8220;If a trans-identified male is in a female-only space, he is committing a violent, abusive act. Make a scene, call the cops and if all else fails, punch him in the balls.&#8221;<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Linehan has been bailed under investigation and has not been charged with an offence.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">In his statement on Wednesday, Sir Mark said the decision to arrest Linehan &#8220;was made within existing legislation &#8211; which dictates that a threat to punch someone from a protected group could be an offence&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Sir Mark said his officers &#8220;had reasonable grounds to believe an offence had been committed,&#8221; but that police more broadly had &#8220;been left between a rock and a hard place&#8221; when investigating online speech.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">He continued: &#8220;I don&#8217;t believe we should be policing toxic culture wars debates and officers are currently in an impossible position.&#8221;<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Sir Mark said police will have to &#8220;make similar decisions in future unless the law and guidance is changed or clarified&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">He said he hopes this happens &#8220;without delay&#8221;, but said the Met would be taking immediate action to update how it decides which cases warrant a police investigation.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Sir Mark said: &#8220;As an immediate way of protecting our officers from the situation we find ourselves in today, we will be putting in place a more stringent triaging process to make sure only the most serious cases are taken forward in future \u2013 where there is a clear risk of harm or disorder.&#8221;<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Linehan, who came to prominence after writing sitcoms Father Ted and the IT Crowd, and has since become a vocal activist who is highly critical of the trans-rights movement.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">In an online article recounting his arrest, Linehan said he was detained by five armed officers who were waiting for him at Heathrow Airport, where he was returning to from the US.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">He said he was taken into custody for questioning and later escorted to hospital after a health check revealed he was suffering from high blood pressure levels.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">The Irish comedian also faces a charge of harassment related to a separate incident. He denies that alleged offence and is due to appear in court on Thursday.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">As well as acknowledgement from the government that public order laws may need to be reviewed, Shami Chakrabarti, a Labour peer and former director of civil liberties group Liberty, said speech offences &#8220;do need an overarching review&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Chakrabarti said some offences related to alarm and distress were &#8220;too broad&#8221; but added &#8220;inciting violence must always be a crime&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Linehan&#8217;s arrest has been seized on by several senior opposition figures in Westminster, who said it was a waste of police resources and would have a chilling effect on free speech.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Conservative Party leader Kemi Badenoch said &#8220;sending five officers to arrest a man for a tweet isn&#8217;t policing, it&#8217;s politics&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Reform UK leader Nigel Farage gave evidence to a Congressional committee hearing on free speech in Washington DC on Wednesday, <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/ce9rzngd9k2o\" class=\"sc-f9178328-0 bGFWdi\" rel=\"noopener\">in which he raised Linehan&#8217;s arrest<\/a>, saying: &#8220;At what point did we become North Korea? <\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">&#8220;I think the Irish comedy writer found that out two days ago at Heathrow Airport.&#8221;<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">The backlash to Linehan&#8217;s arrest came as senior figures on the right of American politics continued to criticise free speech protections in the UK, including Vice President JD Vance.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">He has raised concerns about the UK&#8217;s Online Safety Act, which the British government says is needed to protect children from harm on the internet, and has claimed free speech in Europe is &#8220;in retreat&#8221;.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Other figures associated with Donald Trump, including his former ally Elon Musk, have also been vocal about free speech in the UK, including over the case of Lucy Connolly.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">She was jailed after <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/ce83pj1ggmeo\" class=\"sc-f9178328-0 bGFWdi\" rel=\"noopener\">pleading guilty to stirring up racial hatred against asylum seekers<\/a> following the Southport attack last year, but has been framed as an innocent victim of overzealous policing by some politicians.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Farage said he had hoped Connolly would accompany him to the US but that she was &#8220;banned&#8221; from making the trip due to her conviction.<\/p>\n","protected":false},"excerpt":{"rendered":"The head of the Metropolitan Police has called on the government to &#8220;change or clarify&#8221; the law following&hellip;\n","protected":false},"author":2,"featured_media":395815,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[3,4],"tags":[12,16,15],"class_list":{"0":"post-395814","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-uk","8":"category-united-kingdom","9":"tag-news","10":"tag-uk","11":"tag-united-kingdom"},"share_on_mastodon":{"url":"https:\/\/pubeurope.com\/@uk\/115143043023251780","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts\/395814","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/comments?post=395814"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts\/395814\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/media\/395815"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/media?parent=395814"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/categories?post=395814"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/tags?post=395814"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
