{"id":395868,"date":"2025-09-04T00:18:10","date_gmt":"2025-09-04T00:18:10","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/395868\/"},"modified":"2025-09-04T00:18:10","modified_gmt":"2025-09-04T00:18:10","slug":"how-this-afghan-family-ended-up-held-by-ice-in-bureaucratic-limbo","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/395868\/","title":{"rendered":"How this Afghan family ended up held by ICE in bureaucratic limbo"},"content":{"rendered":"<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In response to questions from the BBC about the family&#8217;s case, a senior official with the US Department of Homeland Security (DHS) says, &#8220;ICE would happily return them to their origin country&#8221; should they request a voluntary departure.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">They add that the US &#8220;is NOT going to pass off illegal aliens seeking asylum from our country to Canada and vice versa. This is part of being good neighbors and partners&#8221;.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Adam Sadinsky, one of the family&#8217;s Canadian lawyers, said Canada has an opportunity to allow this family to be reunited.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;We don&#8217;t want Canada to be complicit in this treatment, and the potential result that they could be sent to any number of countries with their own abysmal human rights record,&#8221; he tells the BBC.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Mr Sadinsky also argues that allowing them to enter Canada would be in line with the Safe Third Country Agreement, which contains exemptions aimed at reuniting families.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">In a statement to the BBC, Immigration, Refugees and Citizenship Canada says it would not comment on the family&#8217;s case, citing privacy legislation.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">The case poses a conundrum for Canadian officials, says immigration lawyer Richard Kurland.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">Mr Kurland, who is not involved with their case, told the BBC that allowing entry to the family could set a precedent for others in ICE detention with ties to Canada. &#8220;How can you say &#8216;yes&#8217; to just one family, and then, &#8216;no&#8217; to everyone else?&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">But he adds that he believes both Canada and the US have a responsibility to at least ensure the family is not sent back to Afghanistan.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;It&#8217;s cruel for the US not to rule out the Kabul flight,&#8221; he said. &#8220;The Americans know what is in store, because they were right there in Kabul for over 20 years.&#8221;<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">For now, Asal and her family in Canada continue to agonise about the case, wishing for a reunion.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">&#8220;Trust me when I say that I cannot sleep most of the night,&#8221; she said.<\/p>\n<p class=\"ssrcss-1q0x1qg-Paragraph e1jhz7w10\">But she is hopeful Canadian officials come through and &#8220;that they will not leave us alone in this situation&#8221;.<\/p>\n","protected":false},"excerpt":{"rendered":"In response to questions from the BBC about the family&#8217;s case, a senior official with the US Department&hellip;\n","protected":false},"author":2,"featured_media":395869,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[5311],"tags":[49,978,659],"class_list":{"0":"post-395868","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-united-states","8":"tag-united-states","9":"tag-us","10":"tag-usa"},"share_on_mastodon":{"url":"https:\/\/pubeurope.com\/@uk\/115143160948177623","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts\/395868","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/comments?post=395868"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts\/395868\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/media\/395869"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/media?parent=395868"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/categories?post=395868"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/tags?post=395868"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
