{"id":395983,"date":"2025-09-04T01:19:23","date_gmt":"2025-09-04T01:19:23","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/395983\/"},"modified":"2025-09-04T01:19:23","modified_gmt":"2025-09-04T01:19:23","slug":"sandie-peggie-raises-further-legal-action-against-nhs-fife","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/395983\/","title":{"rendered":"Sandie Peggie raises further legal action against NHS Fife"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/09\/grey-placeholder.png\" class=\"sc-d1200759-0 dkIvM hide-when-no-script\" aria-label=\"image unavailable\"\/><img decoding=\"async\"   src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/09\/4c431f40-88b9-11f0-84dc-236142004de6.jpg.webp.webp\" loading=\"eager\" alt=\"BBC Sandie Peggie smiles and laughs while standing outside - she is wearing a pink jacket and has blonde hair\" class=\"sc-d1200759-0 dvfjxj\"\/>BBC<\/p>\n<p>Sandie Peggie is claiming harassment and victimisation under the Equality Act<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">A nurse who was suspended after an exchange with a trans doctor in a female changing room has raised a new legal claim against NHS Fife.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Sandie Peggie&#8217;s action is separate from her <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cm2vy2gkywmo\" class=\"sc-f9178328-0 bGFWdi\" rel=\"noopener\">ongoing case with the health board<\/a> and Dr Beth Upton, whom she took to an employment tribunal. <\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">She alleged harassment and victimisation under the Equality Act 2010 relating to her gender critical beliefs.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Ms Peggie&#8217;s fresh claim arises from three senior staff opposing a decision by another manager to lift her suspension in March last year.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Ms Peggie&#8217;s legal team said this only became known to Ms Peggie during evidence <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/c307ez5l4gqo\" class=\"sc-f9178328-0 bGFWdi\" rel=\"noopener\">given as part of the tribunal<\/a>.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">They said further claims of harassment and victimisation will be made against both the health board and specific employees over the coming months.   <\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">NHS Fife have denied their treatment of the nurse was unlawful.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Ms Peggie and Dr Upton <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cx2q8zzx0d7o\" class=\"sc-f9178328-0 bGFWdi\" rel=\"noopener\">had a row on Christmas Eve 2023<\/a> over the use of female changing facilities at the Victoria Hospital in Kirkcaldy.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">The dispute led to Ms Peggie being suspended and then taking NHS Fife to a tribunal.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">It began in February and heard from more than 15 witnesses, including <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cp3le58k858o\" class=\"sc-f9178328-0 bGFWdi\" rel=\"noopener\">Dr Kate Searle<\/a>, Dr Maggie Currer and Esther Davidson &#8211; the three senior managers that Ms Peggie has now raised legal proceedings against.    <\/p>\n<p>Timeline of the Sandie Peggie tribunal<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Margaret Gribbon, the solicitor for Ms Peggie, said the latest legal action &#8211; covering NHS Fife and the three managers &#8211; was raised on 6 August.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">She added: &#8220;All four respondents&#8217; legal defences to the claim are expected to be received within the next fortnight. <\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">&#8220;The claim arises from these senior managers&#8217; opposition to the decision by another FHB manager in March 2024 to lift Sandie&#8217;s suspension. <\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">&#8220;Sandie only became aware of this matter when the suspension review manager gave evidence at her tribunal hearing in July.&#8221;<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Ms Gribbon stated that the claim was one of alleged harassment and victimisation under the Equality Act 2010.<\/p>\n<p>&#8216;Irresponsible and unsafe&#8217;<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">She also said further claims relating to Ms Peggie undergoing a disciplinary hearing and a controversial media statement released by NHS Fife in July would follow.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">On 18 July the health board <a target=\"_self\" href=\"https:\/\/www.bbc.co.uk\/news\/articles\/cvg98nwrqpdo\" class=\"sc-f9178328-0 bGFWdi\" rel=\"noopener\">published the four-page document<\/a> while evidence was being heard in the tribunal.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">It claimed that the employment tribunal had resulted in threats of physical harm and sexual violence against NHS staff.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Scotland&#8217;s information commissioner David Hamilton later criticised NHS Fife for the statement, and the fact the document set out in detail the costs of the tribunal.<\/p>\n<p class=\"sc-9a00e533-0 hxuGS\">Ms Peggie&#8217;s junior counsel Charlotte Elves said at the time that the statement caused &#8220;some concern&#8221;
