The boss of a popular Scots pub<\/a> has been ordered to pay \u00a318,000 to a white female worker he unfairly sacked after she won a discrimination case against him<\/a>.<\/p>\n Ahmed Soliman was found to have told aspiring actor Sky Sinclair she \u201cliked white people better\u201d and described the blonde haired, blue eyed duty manager as \u201cAryan\u201d at the Old Toll Bar in Glasgow – one of the city\u2019s oldest watering holes.<\/p>\n An employment tribunal heard Mr Soliman asked the 34-year-old \u201chow was Germany?\u201d, leaving her feeling she was being accused of being \u201cracist <\/a>or associated with Nazi ideology\u201d.<\/p>\n Employment Judge Shona MacLean said Mr Soliman\u2019s comments \u201cconstituted unwanted conduct\u201d and found he had discriminated against his employee due to race and sex.<\/p>\n She said: \u201cTwo comments related to race and one related to sex.<\/p>\n \u201cThe race related remarks were unsolicited. (Mr Soliman) appeared to derive satisfaction from the claimant\u2019s discomfort. \u201cEven if that was not the purpose, viewed objectively it was reasonable in my view to have that effect.<\/p>\n \u201cAs the business owner, his comments on the claimant\u2019s race and appearance placed her in a difficult position.\u201d<\/p>\n At a Glasgow tribunal the worker accused Mr Soliman of \u201cviolating her dignity\u201d and creating a \u201cdegrading, intimidating, humiliating and offensive environment\u201d before she was unfairly dismissed by the company without notice or written reasons in April last year.<\/p>\n The hearing proceeded in Mr Soliman\u2019s absence due to ill health, where he was found to have made a string of comments to his employee.<\/p>\n It heard Ms Sinclair had been working at the Kinning Park pub for around a year when Mr Soliman said in 2023: \u201cYou look very Aryan with your blue eyes and blond hair\u201d. Ms Sinclair took the comment as a joke but felt \u201cuncomfortable and unsure how to respond\u201d.<\/p>\n Later that year, after Ms Sinclair had bought a coffee for a white colleague, Mr Soliman was said to have asked: \u201cIs that for me?\u201d and when he was told it was not, he added: \u201cOh yeh forgot you like white people better\u201d. He was then said to have asked: \u201cHow was Germany?\u201d.<\/p>\n The judgement said: \u201cThe claimant had no connection with Germany and interpreted the comment, in light of the earlier remark, as suggesting that she was racist or associated with Nazi ideology.\u201d<\/p>\n In October that year, Ms Sinclair accused her boss of making a \u201cthreatening\u201d comment to a colleague in a group chat and said there was often a \u201ctense atmosphere\u201d when he was at work.<\/p>\n The tribunal heard that Mr Soliman replied that he was \u201cnot blaming staff for quiet periods but he needed to control spending and felt a lack of feedback was insulting and hurtful\u201d.<\/p>\n Ms Sinclair said Mr Soliman went on to delete a message in which she asked for support and when she enquired with another manager why it had happened she was told that it was because she had said Mr Soliman came across as threatening.<\/p>\n The judgement said: \u201cThe manager reported that (Mr Soliman) had commented, \u2018You just get some females like that\u2019.<\/p>\n \u201cThe claimant felt anxious about this comment.
