{"id":410068,"date":"2025-09-09T09:21:09","date_gmt":"2025-09-09T09:21:09","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/410068\/"},"modified":"2025-09-09T09:21:09","modified_gmt":"2025-09-09T09:21:09","slug":"immigration-white-paper-changes-actions-businesses-should-take-general-immigration","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/410068\/","title":{"rendered":"Immigration White Paper Changes: Actions Businesses Should Take &#8211; General Immigration"},"content":{"rendered":"<p>Further proposals set out in the Immigration White Paper are&#13;<br \/>\nexpected to be implemented by the end of 2025 at the latest.&#13;<br \/>\nBusinesses should consider how the upcoming changes to the&#13;<br \/>\nimmigration system could impact them and take actions now to&#13;<br \/>\nmitigate.<\/p>\n<p>Some of the<a href=\"http:\/\/www.mondaq.com\/redirection.asp?article_id=1675356&amp;company_id=3442&amp;redirectaddress=https:\/\/www.lewissilkin.com\/en\/insights\/2025\/05\/12\/uk-government-releases-immigration-white-paper-aimed-at-lowering-net-migration\" target=\"_blank\" rel=\"noopener\"><strong>Government&#8217;s Immigration White Paper&#13;<br \/>\nproposals<\/strong><\/a>relating to work routes were<a href=\"http:\/\/www.mondaq.com\/redirection.asp?article_id=1675356&amp;company_id=3442&amp;redirectaddress=https:\/\/www.lewissilkin.com\/en\/insights\/2025\/07\/03\/new-uk-immigration-work-route-restrictions-from-22-july-2025\" target=\"_blank\" rel=\"noopener\"><strong>rolled out from 22 July 2025<\/strong><\/a>.&#13;<br \/>\nThese have already produced a significant impact on businesses by&#13;<br \/>\nmaking sponsorship more costly and by removing the eligibility of&#13;<br \/>\nmost occupations below bachelor degree skill level.<\/p>\n<p>The Government has promised a raft of further changes before the&#13;<br \/>\nend of the year, however some could come earlier, especially as&#13;<br \/>\nthere is usually an Autumn update to the Immigration Rules.<\/p>\n<p>In this article, we analyse the potential impact of these&#13;<br \/>\nchanges on you as a business and suggest actions to mitigate them.&#13;<br \/>\nThe recommended immediate actions<a href=\"http:\/\/www.mondaq.com\/redirection.asp?article_id=1675356&amp;company_id=3442&amp;redirectaddress=https:\/\/www.lewissilkin.com\/en\/insights\/2025\/07\/03\/new-uk-immigration-work-route-restrictions-from-22-july-2025\" target=\"_blank\" rel=\"noopener\"><strong>outlined in our earlier&#13;<br \/>\narticle<\/strong><\/a>also continue to apply, noting that the&#13;<br \/>\nprocessing times for sponsor licence requests (including for&#13;<br \/>\nadditional Certificate of Sponsorship (CoS) allocations) are taking&#13;<br \/>\ntime to be processed and you may need to use the priority&#13;<br \/>\nservice.<\/p>\n<p><strong>Immigration Skills Charge rise<\/strong><\/p>\n<p>The Immigration Skills Charge (ISC) for Skilled Worker and&#13;<br \/>\nSenior or Specialist Worker sponsors is due to rise by 32 per&#13;<br \/>\ncent.<\/p>\n<p>This will mean an uplift:<\/p>\n<ul>&#13;<\/p>\n<li>From \u00a3364 to \u00a3480 per year for small and charitable&#13;<br \/>\nsponsors; and<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>From \u00a31,000 to \u00a31,320 per year for medium and large&#13;<br \/>\nsponsors.<\/li>\n<p>&#13;\n<\/ul>\n<p><strong>Potential impact:<\/strong><\/p>\n<ul>&#13;<\/p>\n<li>Adding up to \u00a31,600 to the cost of sponsoring a five-year&#13;<br \/>\nvisa under the affected routes.<\/li>\n<p>&#13;\n<\/ul>\n<p><strong>Suggested actions:<\/strong><\/p>\n<ul>&#13;<\/p>\n<li>Review your sponsorship pipeline<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Make applications early (if an applicant is not exempt from&#13;<br \/>\nISC)<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Sponsor for the longest term appropriate to the contract (up to&#13;<br \/>\na maximum of five years).<\/li>\n<p>&#13;\n<\/ul>\n<p>Especially at this time of year, workers with Student route&#13;<br \/>\npermission may be asking you to consider sponsorship. Individuals&#13;<br \/>\nswitching from the Student route to Skilled Worker are ISC exempt,&#13;<br \/>\nbut those who are switching from the Graduate route are not.<\/p>\n<p><strong>Higher English language requirements for work route&#13;<br \/>\napplicants and dependants<\/strong><\/p>\n<p>For main applicants on work routes with an English language&#13;<br \/>\nrequirement, the proficiency threshold will increase from level B1&#13;<br \/>\n(intermediate) on the Common European Framework of Reference for&#13;<br \/>\nLanguages (CEFR), to level B2 (upper intermediate).<\/p>\n<p>Adult work route dependants will be required to meet stepped&#13;<br \/>\nEnglish language proficiency criteria. This will be CEFR level A1&#13;<br \/>\n(beginner) for their initial application, rising to level A2&#13;<br \/>\n(elementary) at extension stage and level B2 (upper intermediate)&#13;<br \/>\nat settlement.<\/p>\n<p><strong>Potential impact:<\/strong><\/p>\n<ul>&#13;<\/p>\n<li>Delayed or halted applications where applicants are unable to&#13;<br \/>\nmeet the English language requirement in the first instance, for&#13;<br \/>\nexample if they fail an English language test; and<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Concerns that dependants may not meet the new English language&#13;<br \/>\nrequirements may affect the worker&#8217;s decision to relocate to&#13;<br \/>\nthe UK.<\/li>\n<p>&#13;\n<\/ul>\n<p><strong>Suggested actions:<\/strong><\/p>\n<ul>&#13;<\/p>\n<li>Review your recruitment pipeline and consider making&#13;<br \/>\napplications ahead of the changes. This will remove the immediate&#13;<br \/>\nrisk, and will also maximise the likelihood of the individuals will&#13;<br \/>\nfall within the scope of any transitional arrangements that may&#13;<br \/>\napply;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Sponsor for the longest term appropriate to the contract (up to&#13;<br \/>\na maximum of five years) to give any affected dependants the&#13;<br \/>\nmaximum possible time to improve their proficiency; and<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Consider using the Senior or Specialist Worker route (which&#13;<br \/>\ndoes not have an English language requirement) as an alternative on&#13;<br \/>\na case-by-case basis.<\/li>\n<p>&#13;\n<\/ul>\n<p><strong>New requirements for work route dependants<\/strong><\/p>\n<p><a href=\"https:\/\/assets.publishing.service.gov.uk\/media\/6821f334ced319d02c906103\/restoring-control-over-the-immigration-system-web-optimised.pdf\" target=\"_blank\" rel=\"noopener\"><strong>The White Paper<\/strong><\/a>confirms that&#13;<br \/>\na new family route policy will be unveiled before the end of the&#13;<br \/>\nyear. This will cover (among other groups) the family members of&#13;<br \/>\nindividuals on work routes.<\/p>\n<p><strong>Potential impact:<\/strong><\/p>\n<ul>&#13;<\/p>\n<li>Changes to the relationship requirements, with more scrutiny of&#13;<br \/>\nwhether the relationship is genuine and subsisting;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Higher English language requirements (see section above for&#13;<br \/>\nmore detail);<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Increased financial requirements, with a view to aligning these&#13;<br \/>\nacross family routes; and<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Tightening the suitability requirements for dependants (hese&#13;<br \/>\nbroadly cover issues of criminality and past conduct).<\/li>\n<p>&#13;\n<\/ul>\n<p>The full impact will only be known once the specifics of the new&#13;<br \/>\nfamily policy have been published.<\/p>\n<p><strong>Suggested actions:<\/strong><\/p>\n<ul>&#13;<\/p>\n<li>Consider making any upcoming applications involving dependants&#13;<br \/>\nas soon as possible under the existing Rules \u2013 doing so will&#13;<br \/>\nalso ensure that any affected individuals can benefit from any&#13;<br \/>\ntransitional arrangements that are implemented.<\/li>\n<p>&#13;\n<\/ul>\n<p><strong>Earned settlement and earned citizenship<\/strong><\/p>\n<p>The default qualifying period for settlement in most routes is&#13;<br \/>\ndue to rise (with some exceptions) from five years to ten years.&#13;<br \/>\nIndividuals who can meet points-based criteria relating to their&#13;<br \/>\ncontributions to society and the economy may be eligible to settle&#13;<br \/>\nearlier than ten years. The criteria for citizenship eligibility&#13;<br \/>\nwill be amended to align with the implementation of earned&#13;<br \/>\nsettlement.<\/p>\n<p>The consultation process is due to begin sometime during the&#13;<br \/>\nAutumn, and any changes likely to be implemented next year.<\/p>\n<p><strong>Potential impact<\/strong><\/p>\n<p>The proposals on earned settlement and earned citizenship have&#13;<br \/>\nnot yet been formulated, and there is no clarity on what&#13;<br \/>\ntransitional arrangements may apply. However, the following&#13;<br \/>\npotential impacts are already clear:<\/p>\n<ul>&#13;<\/p>\n<li>There may be a need to sponsor affected workers for longer,&#13;<br \/>\nwhich will create an additional cost burden for your business;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Your sponsored workers and their families will need to pay more&#13;<br \/>\nimmigration-related fees due to the additional extensions required&#13;<br \/>\nto meet the qualifying period for settlement;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Immigration restrictions associated with the affected&#13;<br \/>\nindividuals&#8217; immigration status may be extended, potentially&#13;<br \/>\nlimiting access to financial products (such as mortgages), career&#13;<br \/>\nopportunities and higher education; and<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>A delay to achieving settlement will, in many cases, lead to a&#13;<br \/>\ncorresponding delay in qualifying for British citizenship.<\/li>\n<p>&#13;\n<\/ul>\n<p><strong>Suggested actions:<\/strong><\/p>\n<ul>&#13;<\/p>\n<li>Review your internal policies on whether and how you support&#13;<br \/>\napplications for settlement;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Consider encouraging those who are eligible for settlement (or&#13;<br \/>\ncitizenship, if this is the individual&#8217;s ultimate goal) to&#13;<br \/>\napply as soon as they can;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Consider responding to the planned consultation opportunities;&#13;<br \/>\nand<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>Consider flagging the changes and consultation opportunities to&#13;<br \/>\naffected staff\u2013 this may help them to plan their path to&#13;<br \/>\nsettlement and citizenship most efficiently.<\/li>\n<p>&#13;\n<\/ul>\n<p>Note that EU Settlement Scheme (EUSS) participants will not be&#13;<br \/>\naffected by the earned settlement proposals, but may be affected by&#13;<br \/>\nthe implementation of earned citizenship. They may therefore wish&#13;<br \/>\nto apply for settled status and\/or citizenship as soon as they are&#13;<br \/>\neligible.
