The council will propose an \u2018Article 4\u2019 legal order, which would give local people more influence over proposals for HMOs across the borough.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">A council can use an \u2018Article 4 Direction\u2019 to stop the \u2018over-concentration\u2019 of HMOs by withdrawing certain \u201cpermitted development rights\u201d for property owners. This means property owners must apply for planning permission to convert a family home into a small HMO, rather than being able to do so without permission.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">In effect, HMO applications would be subject to the same local planning decisions as other developments and local residents would be able to engage with a consultation process.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Currently, HMO applications can use \u2018permitted planning\u2019 rights and be approved without input from the planning authority or the local community. This means any change of use from a dwelling house to a small HMO can occur without the need for planning permission and the council has no control over which properties are used.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\"><a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.liverpoolecho.co.uk\/all-about\/sefton\" target=\"\" aria-label=\"\" tabindex=\"0\" rel=\"noopener\">Sefton<\/a> Council\u2019s proposal comes just a couple of months after the Liverpool <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.liverpoolecho.co.uk\/\" target=\"_self\" aria-label=\"\" tabindex=\"0\" rel=\"noopener\">ECHO<\/a> reported on a similar order for <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.liverpoolecho.co.uk\/all-about\/aintree\" target=\"\" aria-label=\"\" tabindex=\"0\" rel=\"noopener\">Aintree<\/a> when hundreds of campaigners <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.liverpoolecho.co.uk\/news\/liverpool-news\/campaign-achieves-groundbreaking-moment-fight-31891079\" target=\"_self\" aria-label=\"\" tabindex=\"0\" rel=\"noopener\">fought for more autonomy in local decision-making<\/a>. The council announced today (September 10) that it is now seeking to apply Article 4 to the whole borough, as residents have continued to raise concerns about HMOs.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Councillor Marion Atkinson, Leader of Sefton Council, said: \u201cSince taking action across the borough, and more latterly in Aintree, we have seen a huge number of people come forward in support of what we have done. Residents in other parts of the borough are now calling for similar action, which is why we have decided to take this unusual step.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">\u201cHMOs do play a role in our community, and this move would not prevent an HMO from being created \u2013 instead it puts an extra check and balance in place by requiring planning permission so local people can have a say on any plans that are put forward.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">\u201cThe key thing is that local people should have an input into what\u2019s happening in their community, and we think this is something that should be tackled nationally but for the time being this would be us as a council doing all that we can to listen to our residents.\u201d<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\">Article 4 Directions are already in operation and apply in certain parts of Sefton, including <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.liverpoolecho.co.uk\/all-about\/southport\" target=\"\" aria-label=\"\" tabindex=\"0\" rel=\"noopener\">Southport<\/a>, <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.liverpoolecho.co.uk\/all-about\/bootle\" target=\"\" aria-label=\"\" tabindex=\"0\" rel=\"noopener\">Bootle<\/a>, Seaforth, <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.liverpoolecho.co.uk\/all-about\/litherland\" target=\"\" aria-label=\"\" tabindex=\"0\" rel=\"noopener\">Litherland<\/a> and <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.liverpoolecho.co.uk\/all-about\/waterloo\" target=\"\" aria-label=\"\" tabindex=\"0\" rel=\"noopener\">Waterloo<\/a>, and have done so for some time.
