Russia has filed an appeal challenging the International Civil Aviation Organization’s (ICAO) decision that blamed it for shooting down Malaysia Airlines Flight 17 over Ukraine in 2014.<\/p>\n

In May, the ICAO’s Council found Russia responsible for shooting down the MH17<\/a> on July 17, 2014, with the loss of 298 lives, including 38 Australians citizens or residents.<\/p>\n

Moscow’s appeal submitted to the International Court of Justice contested ICAO’s decision “on all grounds, including on grounds of jurisdiction, applicable law, factual findings and fatal procedural violations”.<\/p>\n

The Russian Foreign Ministry confirmed it would appeal the decision in a statement late Thursday local time.<\/p>\n

The ICAO’s decision marked the first time the global aviation body decided a dispute between governments.<\/p>\n

The decision followed the 2016 conclusion by a Dutch-led international investigation that the Amsterdam to Kuala Lumpur airliner was shot down from Ukrainian territory held by separatist rebels using a Buk missile system delivered from Russia.<\/p>\n

Moscow has denied any involvement in the MH17 tragedy.<\/p>\n

The Russian Foreign Ministry charged that the global aviation agency had failed to carry out a “comprehensive, thorough and independent” international probe into the crash.<\/p>\n

Russia said the report relied instead on the “highly questionable conclusions” of the criminal investigation “carried out under the auspices of an interested party, the Netherlands, and on the basis of adulterated facts that were mostly provided by another interested party, Ukraine”.<\/p>\n

“We hope that the International Court of Justice will take an entirely impartial stance on this high-profile case,” the ministry said.<\/p>\n

Australia and Netherlands launched ICAO case<\/p>\n

The case with the ICAO was launched in 2022 by Australia and the Netherlands.<\/p>\n

Malaysian Airlines Flight MH17 departed from Amsterdam for Kuala Lumpur on July 17, 2014, and was shot down over eastern Ukraine as fighting raged between pro-Russian separatists and Ukrainian forces.<\/p>\n

In November 2022, Dutch judges convicted two Russian men and a Ukrainian man in absentia of murder for their role in the attack<\/a>.<\/p>\n

Speaking after the ruling in May, Australian Foreign Minister Penny Wong urged the ICAO to move swiftly to determine remedies.<\/p>\n

“This is a historic moment in the pursuit of truth, justice and accountability for the victims of the downing of Flight MH17, and their families and loved ones,” she said in a statement.<\/p>\n

“We call upon Russia to finally face up to its responsibility for this horrific act of violence and make reparations for its egregious conduct, as required under international law.<\/p>\n
