Tyler Phythian, 18, has been charged with murdering Daniel Gardner following a house fire in Highters Heath<\/p>\n

A second man has been charged with murder after a dad died following a Birmingham<\/a> house fire.<\/p>\n

Daniel Gardner died following the blaze at a property in Saxons Way in Highters Heath last Friday (September 19) shortly after 1am.<\/p>\n

Six ambulance service<\/a> crews attended the scene and gave the 37-year-old advanced life support.<\/p>\n

He was then taken to hospital under emergency conditions but sadly died a short while after arriving at hospital.<\/p>\n

Now Tyler Phythian, aged 18, of Cherrywood Road in Bordesley Green has been charged with murder.<\/p>\n

He is set to appear at Birmingham Magistrates\u2019 Court on Tuesday (September 23) morning.<\/p>\n

Stephen Dale, 47, also of Cherrywood Road in Bordesley Green was charged with murder on Sunday (September 21) and appeared before city magistrates on Monday.<\/p>\n

Earlier Daniel\u2019s family paid tribute to a \u2018devoted son, daddy, brother, and nephew\u2019.<\/p>\n

In a tribute they said: \u201cWords cannot describe the unbearable pain and devastation we all feel.<\/p>\n

\u201cYou gave everything and never expected anything in return.<\/p>\n

\u201cGives me comfort that you are with Nan & Grandad now who will once again look after you for me.<\/p>\n

\u201cMy heart will always be broken but I hope I can find the strength to carry on without you.<\/p>\n

\u201cAll my love is with you Dan. Miss you every minute of the day. Mum & Nick Ryan & Liv Elliot & Charlie Lynn & Phi.\u201d<\/p>\n

A spokesperson for West Midlands Police<\/a> said: \u201cWe were called alongside fire and ambulance colleagues to the property on Saxons Way, Highters Heath, shortly before 1.10am on 19 September.<\/p>\n

\u201cDaniel, aged 37, was found seriously injured and taken to hospital for treatment but tragically died a short time later.<\/p>\n

\u201cOur thoughts remain with Daniel\u2019s family at this tragic time and we continue to offer them our full support as our investigation continues.<\/p>\n
