{"id":474010,"date":"2025-10-04T17:19:30","date_gmt":"2025-10-04T17:19:30","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/474010\/"},"modified":"2025-10-04T17:19:30","modified_gmt":"2025-10-04T17:19:30","slug":"labour-considering-charging-workers-for-employment-tribunal-claims-sources-say-employment-tribunals","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/474010\/","title":{"rendered":"Labour considering charging workers for employment tribunal claims, sources say | Employment tribunals"},"content":{"rendered":"<p class=\"dcr-130mj7b\">Workers could be charged a fee to take their bosses to court under plans being explored by <a href=\"https:\/\/www.theguardian.com\/politics\/labour\" data-link-name=\"in body link\" data-component=\"auto-linked-tag\" target=\"_blank\" rel=\"noopener\">Labour<\/a> as it faces pressure from businesses lobbying to water down its landmark changes to employment rights.<\/p>\n<p class=\"dcr-130mj7b\">In a development described by unions as a \u201cdisaster\u201d, sources in Westminster said ministers were looking at reviving a proposal made by the last Conservative government to impose fees on employment tribunal claims.<\/p>\n<p class=\"dcr-130mj7b\">A source close to the government said a plan was agreed in chancellor Rachel Reeves\u2019s June spending review, as part of efforts to find savings in the Ministry of Justice budget, in a drive to recover some of the costs of running the service.<\/p>\n<p class=\"dcr-130mj7b\">Under the leadership of the then prime minister, Rishi Sunak, the Conservatives proposed a <a href=\"https:\/\/www.gov.uk\/government\/consultations\/introducing-fees-in-the-employment-tribunals-and-the-employment-appeal-tribunal\/introducing-fees-in-the-employment-tribunals-and-the-employment-appeal-tribunal\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">\u00a355 fee for workers making an employment tribunal claim<\/a> in early 2024, in plans thrown up in the air by Keir Starmer\u2019s general election victory.<\/p>\n<p class=\"dcr-130mj7b\">However, sources said budget pressures and efforts to tackle an overwhelmed tribunals service had led ministers to look again at the plan. \u201cIt has been kicking about in terms of the Ministry of Justice inheritance,\u201d said a government source. \u201cObviously, the spending settlement has meant that a lot of people are looking for revenue raisers.\u201d<\/p>\n<p class=\"dcr-130mj7b\">A separate Labour source said a plan had been made to reintroduce fees before the end of the current parliament, but warned it would be \u201ccounterproductive\u201d given the government\u2019s <a href=\"https:\/\/www.theguardian.com\/uk-news\/2025\/aug\/31\/why-zero-hours-workers-welcome-labour-rights-bill\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">pledge to strengthen workers\u2019 rights<\/a>. \u201cThe unions will go bananas,\u201d they added.<\/p>\n<p class=\"dcr-130mj7b\">It is understood David Lammy, who replaced Shabana Mahmood as justice secretary in last month\u2019s reshuffle, is reviewing his department\u2019s policies before a decision is made.<\/p>\n<p class=\"dcr-130mj7b\">Unions argued that tribunal fees would risk pricing workers out of accessing justice. Paul Nowak, the general secretary of the TUC, said: \u201cEveryone should be able to enforce their rights at work. Reintroducing tribunal fees would be a gift for bad bosses and price many low-paid workers out of justice \u2013 especially women.<\/p>\n<p class=\"dcr-130mj7b\">\u201cTribunal fees were a disaster when they were introduced under the Tories. They blocked genuine claims from going forward and cost more to administer than they raise.\u201d<\/p>\n<p class=\"dcr-130mj7b\">A Ministry of Justice spokesperson said the government had \u201cinherited a justice system in crisis\u201d with huge court and tribunal backlogs and widespread funding and sustainability pressures. \u201cDecision-making about the department\u2019s spending and fees for the next few years following this summer\u2019s spending review is ongoing,\u201d they said.<\/p>\n<p class=\"dcr-130mj7b\">Employment tribunals are the primary vehicle for workplace justice, ruling on disputes between workers and employers on issues ranging from equal pay to unfair dismissal and discrimination.<\/p>\n<p class=\"dcr-130mj7b\">Making a claim had been free since tribunals were established in the 1960s, until David Cameron\u2019s coalition government introduced charges in 2013 under the Tories\u2019 austerity drive \u2013 provoking <a href=\"https:\/\/www.theguardian.com\/money\/2013\/jul\/29\/protest-employment-tribunal-fees\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">protests by trade unions<\/a>.<\/p>\n<p class=\"dcr-130mj7b\">Fees were then scrapped in 2017 after the <a href=\"https:\/\/www.theguardian.com\/money\/2017\/jul\/26\/union-supreme-court-fees-unfair-dismissal-claims\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">supreme court ruled they were unlawful<\/a>, following a case brought by the Unison trade union. Labour under Jeremy Corbyn had also made scrapping fees a 2017 manifesto pledge, arguing that they protect unscrupulous bosses and \u201cliterally price people of of justice\u201d.<\/p>\n<p class=\"dcr-130mj7b\">With significant delays and a shortage of qualified judges, the UK\u2019s employment tribunal backlog has ballooned, with a queue of <a href=\"https:\/\/www.gov.uk\/government\/statistics\/tribunals-statistics-quarterly-january-to-march-2025\/tribunal-statistics-quarterly-january-to-march-2025\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">45,000 single open cases<\/a> at the end of March. Business leaders have also warned Labour\u2019s plans to boost workers rights could further overwhelm the service. It will also extend the time limit for bringing most tribunal claims from three months to six.<\/p>\n<p class=\"dcr-130mj7b\">Ministers have pledged to implement the package \u201cin full\u201d after Starmer\u2019s reshuffle fuelled unease among unions following the <a href=\"https:\/\/www.theguardian.com\/politics\/2025\/sep\/05\/angela-rayner-resignation-letter-in-full\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">resignation of Angela Rayner<\/a>, who had championed the plan.<\/p>\n<p class=\"dcr-130mj7b\">Under Rishi Sunak, the Tories estimated that a \u201cmodest fee\u201d of \u00a355 could generate up to \u00a31.7m a year in revenue, helping to cover some of the \u00a380m annual running cost of the service.<\/p>\n<p class=\"dcr-130mj7b\">While those in financial hardship would be offered fee remission, the previous government acknowledged charges could deter some workers. When fees were in place between 2013 and 2017 the number of quarterly applications fell by about two-thirds.<\/p>\n<p class=\"dcr-130mj7b\">Employees who bring tribunal claims currently do not have to pay a fee to make a claim. However, they do face potential legal fees in preparing the claim and representation at trial. Employees typically do not have to pay employers\u2019 costs if they have a reasonable case.<\/p>\n<p class=\"dcr-130mj7b\">Reeves <a href=\"https:\/\/www.theguardian.com\/politics\/2025\/jun\/11\/spending-review-reeves-vows-to-renew-britain-with-big-rises-for-nhs-housing-and-defence\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">set out her spending review<\/a> \u2013 including prioritising investment in health and defence \u2013 in June, including cuts to budgets across several government departments.
