The terrorism charge against Kneecap rapper Mo Chara, real name Liam \u00d3g \u00d3 hAnnaidh, was thrown out last month<\/strong><\/a>.<\/p>\n The Belfast rapper had been charged with a terrorism offence for\u00a0allegedly displaying a Hezbollah flag and shouting \u201cup Hamas, up Hezbollah\u201d at a gig in London last November. \u00a0<\/p>\n Chief Magistrate Paul Goldspring\u00a0sitting at Woolwich Crown Court\u00a0told the court that the charge against \u00d3 hAnnaidh\u00a0was \u201cunlawful\u201d and \u201cnull\u201d.<\/p>\n Now, in a statement (via\u00a0BBC<\/strong><\/a>), a Crown Prosecution Service (CPS) spokesperson said: \u201cWe are appealing the decision to dismiss this case as we believe there is an important point of law which needs to be clarified.\u201d<\/p>\n Kneecap have responded to the reports that prosecutors will appeal against the decision. In a post titled \u201cA Message to the Police (British) State\u201d, they called the news \u201cunsurprising\u201d.<\/p>\n The band\u2019s statement reads: \u201cNews of a CPS appeal against the ruling of their own judge is unsurprising. He ruled the charge was \u2018unlawful and null\u2019 and it was. It is unsurprising, because the whole process has not been driven by the police or courts, it has been driven by politicians backed up by the British media. This is political policing”.<\/p>\n They continued: \u201cThere is no \u2018important point of law\u2019. The CPS have submitted nothing new in their appeal. What there is though, is a state-wide witch-hunt against Palestinian solidarity. The media were gleefully informed about this appeal before we were.\u201d<\/p>\n The trio described it as a \u201cmassive waste of taxpayers\u2019 money, of police time, of court time,\u201d before adding: \u201cWe are NOT the story. Yesterday, 104 Palestinians were murdered in Gaza and hundreds more maimed as Israel commits genocide\u2026 This is aided and supported by the British state. We will fight you in your court again. We will win again.\u201d<\/p>\n After Chara\u2019s terror charge was dropped last month, he described the case as a \u201cdistraction\u201d and said he was\u00a0considering taking legal action himself against the British state<\/strong><\/a>.<\/p>\n Speaking to Virgin Media, he said that legal action was \u201cdefinitely something we\u2019re going to look into.\u201d<\/p>\n Kneecap have consistently denied supporting either Hamas or Hezbollah and said that they do not incite or condone violence, despite\u00a0criticism for their politically-charged live shows<\/strong><\/a>.<\/p>\n The band has\u00a0denied accusations of anti-Semitism<\/strong><\/a>, claiming that those attacking the band \u201cweaponize\u201d the false accusation to \u201cdistract, confuse, and provide cover for genocide.\u201d<\/p>\n Kneecap has frequently\u00a0used their platform at various music festivals<\/strong><\/a>\u00a0to speak out not against the Jewish people but against Israel’s war in Gaza.<\/p>\n Since Hamas\u2019 attack on Israeli citizens on October 7, 2023, multiple UN human rights experts\u00a0have stated that Israel\u2019s military actions in Gaza amount to genocide<\/strong><\/a>, with the International Court of Justice finding claims of genocide plausible.\u00a0The Integrated Food Security Phase Classification\u00a0announced that people in the Gaza Strip are\u00a0officially facing \u201ca man-made\u201d famine<\/strong><\/a>\u00a0in the territory.<\/p>\n Israel has rejected the genocide accusations and maintain that its operations are lawful acts of self-defence. Claims Kneecap have vocally rebuked.
