Some legal experts say so."},"content":{"rendered":"<p class=\"mb-4 text-lg md:leading-8 break-words\">WASHINGTON \u2013 The <a href=\"https:\/\/www.yahoo.com\/news\/articles\/former-fbi-director-james-comey-231507125.html\" data-ylk=\"slk:federal indictment;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" target=\"_blank\" rel=\"noopener\">federal indictment<\/a> of former <a href=\"https:\/\/www.yahoo.com\/news\/articles\/former-fbi-director-james-comey-132716966.html\" data-ylk=\"slk:FBI Director James Comey;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" target=\"_blank\" rel=\"noopener\">FBI Director James Comey<\/a> could face significant legal challenges \u2013 and potential dismissal \u2013 due to questions about how the Trump administration appointed the prosecutor who obtained it, constitutional law experts and Democratic lawmakers say.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">One former Justice Department official, Ed Whelan, says there\u2019s \u201ca fatal legal flaw\u201d in Comey\u2019s Sept. 25 indictment because the department lacked the legal authority to appoint White House official Lindsey Halligan as the U.S. attorney for the Eastern District of Virginia.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In that capacity, Halligan was the only prosecutor to sign off on the grand jury indictment against Comey on <a href=\"https:\/\/www.yahoo.com\/news\/articles\/know-charges-against-former-fbi-133635511.html\" data-ylk=\"slk:two counts of lying to Congress;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" target=\"_blank\" rel=\"noopener\">two counts of lying to Congress<\/a> and obstructing an official proceeding.<\/p>\n<p>Former FBI director James Comey indicted on two counts<\/p>\n<p>1 of 20<\/p>\n<p>Investigative Journalist Richard Esposito and Author James Comey, former FBI Director, speak at the Barnes &amp; Noble Upper West Side on May 19, 2025 in New York City. Bush, told USA TODAY in an Oct. 6 interview.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">If that\u2019s the case, Whelan and others said, it could knock out the case before it gets to trial. Comey is scheduled to be arraigned, and to enter a plea, Oct. 9 in the Alexandria, Va. district, just outside the capital.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Whelan, who holds the Antonin Scalia Chair in Constitutional Studies at the\u00a0<a href=\"https:\/\/eppc.org\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Ethics and Public Policy Center;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Ethics and Public Policy Center<\/a>, first made his claim in two <a href=\"https:\/\/www.nationalreview.com\/bench-memos\/was-lindsey-halligan-validly-appointed-as-united-states-attorney\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Sept. 26 blog posts;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Sept. 26 blog posts<\/a> for National Review, a conservative magazine, the day after Comey\u2019s indictment.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Liz Oyer, the former Justice Department pardon attorney under Trump, said she believes &#8220;there&#8217;s a strong argument that she was not lawfully appointed.&#8221;<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cAnd if she was not lawfully appointed, the indictment would likely be invalid,&#8221; Oyer told USA TODAY, &#8220;since she&#8217;s the only person who signed the indictment.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Oyer also said that because the statute of limitations to bring these particular charges against Comey expired Sept. 30, \u201cThat means that if this indictment is thrown out, it cannot be fixed\u201d or resubmitted.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cComey\u2019s lawyers will certainly raise this argument,\u201d Oyer said, \u201cand if the judge agrees, he could throw out the case before it even gets to a jury.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Some Trump critics are taking up the argument. irginia Sen. Tim Kaine, a Democrat, referenced <a href=\"https:\/\/x.com\/timkaine\/status\/1970974058469888395\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Whelan&#039;s blog posts on X;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Whelan&#8217;s blog posts on X<\/a> when he posted: &#8220;Here&#8217;s a question. Can <a href=\"https:\/\/www.usatoday.com\/news\/politics\/donald-trump\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Donald Trump;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Donald Trump<\/a> even appoint an interim U.S. Attorney in the Eastern District of Virginia to carry out his retribution spree?&#8221;<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">While Comey has said he is innocent and will fight the charges, a lawyer representing him had no comment to USA TODAY about whether they plan to attack the validity of the indictment \u2013 or Halligan\u2019s appointment \u2013 in court.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Justice Department spokesman Chad Gilmartin also had no comment on the validity of Halligan&#8217;s appointment and the Comey indictment. Halligan\u2019s office did not respond to requests for comment and the White House referred questions about the matter to DOJ.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Halligan brought the charges after Attorney General <a href=\"https:\/\/www.usatoday.com\/news\/politics\/pam-bondi\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Pam Bondi;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Pam Bondi<\/a> tapped her to replace another Trump administration appointee, Interim U.S. Attorney Erik Siebert.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\"><a href=\"https:\/\/www.usatoday.com\/news\/politics\/donald-trump\/\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:President Donald Trump;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">President Donald Trump<\/a> says he fired Siebert \u2212 Siebert says he resigned \u2212 after the prosecutor declined to seek an indictment of Comey. He and his legal team <a href=\"https:\/\/www.brennancenter.org\/our-work\/analysis-opinion\/comey-indictment-shows-danger-subservient-prosecutors\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:reportedly believed there was a lack;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">reportedly believed there was a lack<\/a> of sufficient evidence.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">The appointment of Halligan \u2212 a former insurance lawyer with no prosecutorial background who was previously a personal defense attorney for Trump and then aide in his White House \u2212 occurred just days before the five-year statute of limitations was to run out on Sept. 30 on charges accusing Comey of making false statements to Congress back in September 2020.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Her appointment also came soon after Trump personally took to social media to demand that Comey be indicted, along with other of his perceived political enemies.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In a\u00a0<a href=\"https:\/\/truthsocial.com\/@realDonaldTrump\/115239044548033727\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Sept. 20 post on Truth Social;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Sept. 20 post on Truth Social<\/a>, Trump <a href=\"https:\/\/www.yahoo.com\/news\/articles\/trump-says-hes-unaware-ex-173500556.html\" data-ylk=\"slk:addressed Bondi publicly;elm:context_link;itc:0;sec:content-canvas;outcm:mb_qualified_link;_E:mb_qualified_link;ct:story;\" class=\"link  yahoo-link\" target=\"_blank\" rel=\"noopener\">addressed Bondi publicly<\/a>, saying Comey was &#8220;guilty as hell,&#8221; without explaining what Comey was allegedly guilty of. &#8220;We can\u2019t delay any longer,&#8221; and &#8220;JUSTICE MUST BE SERVED, NOW!!!&#8221; Trump said.<\/p>\n<p><strong>Only one interim US Attorney appointment allowed?<\/strong><\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">According to Whelan, the Justice Department <a href=\"https:\/\/nam11.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fstorage.courtlistener.com%2Frecap%2Fgov.uscourts.njd.578930%2Fgov.uscourts.njd.578930.61.1.pdf&amp;data=05%7C02%7CJMeyer%40usatoday.com%7C59ddb0ee18224fb45ad508de02a941f1%7Cbc924c8d3e164e88bf26d7fcfb14f2d5%7C0%7C0%7C638951123476644107%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=foECDWoQMP600QiEy6%2BDjIuScNYWk7GNXmS05ihmwNo%3D&amp;reserved=0\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:cannot lawfully appoint a second;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">cannot lawfully appoint a second<\/a> interim U.S. attorney after appointing a first one whose term has expired.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">He cites <a href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/28\/546\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:Section 546(d) of Title 28;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">Section 546(d) of Title 28<\/a>\u00a0of the United States Code, which authorizes an attorney general to appoint an interim United States attorney for a term of 120 days. After that, only \u201cthe district court for such district may appoint a United States attorney to serve until the vacancy is filled.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">In Siebert\u2019s case, his term expired 120 days after <a href=\"https:\/\/www.justice.gov\/usao-edva\/pr\/erik-siebert-appointed-interim-us-attorney-eastern-district-virginia\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:his Jan. 21 appointment;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">his Jan. 21 appointment<\/a> by Acting Attorney General James McHenry, on or about May 21. After that, Whelan said, Eastern District of Virginia judges appointed him to continue to serve.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Whelan also cited as evidence a Nov. 13, 1986, memo by <a href=\"https:\/\/nam11.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fstorage.courtlistener.com%2Frecap%2Fgov.uscourts.njd.578930%2Fgov.uscourts.njd.578930.61.1.pdf&amp;data=05%7C02%7CJMeyer%40usatoday.com%7C59ddb0ee18224fb45ad508de02a941f1%7Cbc924c8d3e164e88bf26d7fcfb14f2d5%7C0%7C0%7C638951123476644107%7CUnknown%7CTWFpbGZsb3d8eyJFbXB0eU1hcGkiOnRydWUsIlYiOiIwLjAuMDAwMCIsIlAiOiJXaW4zMiIsIkFOIjoiTWFpbCIsIldUIjoyfQ%3D%3D%7C0%7C%7C%7C&amp;sdata=foECDWoQMP600QiEy6%2BDjIuScNYWk7GNXmS05ihmwNo%3D&amp;reserved=0\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:conservative Supreme Court Justice Samuel Alito;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">conservative Supreme Court Justice Samuel Alito<\/a>, who at the time was a senior Office of Legal Counsel lawyer in the administration of President Ronald Reagan. OLC, as the office is called, guides the Justice Department and the broader U.S. government on what\u2019s legal.<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Alito wrote that \u201cafter the expiration of the 120-day period further interim appointments are to be made by the court rather than by the Attorney General.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cThus it would appear that Congress intended to confer on the Attorney General only the power to make one interim appointment; a subsequent interim appointment would have to be made by the district court\u201d overseeing that prosecutorial jurisdiction, Alito wrote.<\/p>\n<p><strong>If Trump fired Siebert, &#8216;That makes the office vacant&#8217;<\/strong><\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Pro-Trump <a href=\"https:\/\/x.com\/TrentMcCotter\/status\/1973221183421292803\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:lawyer Trent McCotter disagreed;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">lawyer Trent McCotter disagreed<\/a> with Whelan&#8217;s analysis. He responded to Whelan on X that because Trump fired Siebert, \u201cThat makes the office vacant.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">\u201cIf you&#8217;re right,\u201d he told Whelan, \u201cthe AG&#8217;s appointment power would literally never reset once 120 days expire.\u201d<\/p>\n<p class=\"mb-4 text-lg md:leading-8 break-words\">Siebert\u2019s appointment by the court \u201c<a href=\"https:\/\/x.com\/TrentMcCotter\/status\/1973221745600635233\" rel=\"nofollow noopener\" target=\"_blank\" data-ylk=\"slk:reset the 120 day clock;elm:context_link;itc:0;sec:content-canvas\" class=\"link \">reset the 120 day clock<\/a>,\u201d argued McCotter, a former Justice Department prosecutor.
