{"id":498385,"date":"2025-10-14T08:57:11","date_gmt":"2025-10-14T08:57:11","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/498385\/"},"modified":"2025-10-14T08:57:11","modified_gmt":"2025-10-14T08:57:11","slug":"military-spouse-suing-department-of-defense-over-book-bans","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/498385\/","title":{"rendered":"Military spouse suing Department of Defense over book bans"},"content":{"rendered":"<p>The ACLU sued the administration in April, saying book bans at schools for military kids were unconstitutional. &#8216;Nearly 600 books are still missing.&#8217;<\/p>\n<p><img decoding=\"async\" style=\"position:absolute;top:0;left:0;right:0;bottom:0;width:100%;height:100%;z-index:2\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/10\/86605283007-usatsi-27273667.jpg\"\/><img decoding=\"async\" class=\"vidplayicon\" src=\"https:\/\/www.gannett-cdn.com\/appservices\/universal-web\/universal\/icons\/icon-play-alt-white.svg\" alt=\"play\" style=\"height:40px;margin:auto 18px auto 27px;width:40px\"\/><\/p>\n<p>Banned Books Week tackles freedom of expression<\/p>\n<p>Banned Books Week brings focus to the question of why books are being pulled from schools and library shelves.<\/p>\n<ul>\n<li>The ACLU sued the administration in April on behalf of six military families, alleging that book bans and curriculum changes at schools for military children were unconstitutional.<\/li>\n<li>The changes followed President Donald Trump&#8217;s executive orders related to race, gender, education and the military issued shortly after he took office in January.<\/li>\n<\/ul>\n<p>By early February, Jessica Henninger realized something had drastically changed at her daughters&#8217; <a href=\"https:\/\/www.dodea.edu\/americas\/southeast\/fort-campbell-schools\" target=\"_blank\" rel=\"noreferrer noopener\">school at the Fort Campbell military base<\/a> in Kentucky.<\/p>\n<p>First, she said, she received an email from one of her daughter&#8217;s teachers asking for students to return their library books and saying the library would be closed indefinitely.<\/p>\n<p>Around the same time, a Black History Month project \u2013 a living wax museum in which her other daughter was planning to depict the poet Maya Angelou \u2013 also was canceled.\u00a0<\/p>\n<p>The changes came days after the <a href=\"https:\/\/www.war.gov\/News\/Releases\/Release\/Article\/4050331\/identity-months-dead-at-dod\/\" target=\"_blank\" rel=\"noreferrer noopener\">Pentagon issued guidance<\/a> not to use official resources to mark cultural awareness months, such as Black History Month. According to the guidance, labeled &#8220;Identity Months Dead at DoD,&#8221; &#8220;efforts to divide the force \u2013 to put one group ahead of another \u2013 erode camaraderie and threaten mission execution.&#8221;<\/p>\n<p>The school her daughters attend is operated by the federal government as part of the\u00a0Department of Defense Education Activity, often referred to as DoDEA. More than 67,000 students attend class at DoDEA locations in the United States and 11 other countries, <a href=\"https:\/\/www.dodea.edu\/about\/about-dodea\" target=\"_blank\" rel=\"noreferrer noopener\">according to its website<\/a>.\u00a0<\/p>\n<p>Henninger described a \u201chelpless\u201d feeling amid the changes.<\/p>\n<p>\u201cIn DoDEA, our children\u2019s education can be changed by an executive order from the president of the United States,\u201d she said.<\/p>\n<p>Henninger took her concerns to the American Civil Liberties Union, which <a href=\"https:\/\/www.aclu.org\/press-releases\/dodea-book-bans\" target=\"_blank\" rel=\"noopener\">filed suit in April<\/a>, saying the administration&#8217;s actions violated the First Amendment.\u00a0<\/p>\n<p>The<a href=\"https:\/\/www.aclu-ky.org\/app\/uploads\/2025\/04\/ek_v_dodea_-_2025.04.15_ecf_001_-_complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"> complaint said <\/a>parents received an email Feb. 10 saying that DoDEA staff had &#8220;reviewed&#8221; books related to race and gender and that such books would not be available to students. The complaint asked the judge to order officials to reinstate the removed books and to bar War Secretary <a target=\"_blank\" href=\"https:\/\/www.usatoday.com\/news\/politics\/pete-hegseth\/\" data-autotag=\"7a3e49b2-c1f5-4415-b05a-1f91470d2e86\" rel=\"noopener\">Pete Hegseth<\/a> and DoDEA Director <a href=\"https:\/\/www.dodea.edu\/about\/about-dodea\/command\/dr-beth-schiavino-narvaez\" target=\"_blank\" rel=\"noreferrer noopener\">Beth Schiavino-Narvaez<\/a> from ordering further removals from school libraries and curricula.\u00a0<\/p>\n<p>As of early October, there had been no ruling on the case, nor on a separate ACLU filing <a href=\"https:\/\/www.aclu.org\/press-releases\/dodea-book-bans-preliminary-injunction\" target=\"_blank\" rel=\"noreferrer noopener\">requesting a preliminary injunction<\/a> that would prevent DoDEA schools from removing books and curricula while litigation continues.\u00a0\u00a0<\/p>\n<p>&#8220;Students in DoDEA schools have been back in the classroom for nearly two months, but nearly 600 books are still missing,&#8221; ACLU senior staff attorney <a href=\"https:\/\/www.aclu.org\/bio\/emerson-sykes\" target=\"_blank\" rel=\"noreferrer noopener\">Emerson Sykes<\/a> said Oct. 8 during Banned Books Week, an <a href=\"https:\/\/www.ala.org\/bbooks\/banned\" target=\"_blank\" rel=\"noreferrer noopener\">annual event<\/a> to spread awareness of book censorship around the country. &#8220;We are eagerly awaiting the time that they&#8217;ll finally be able to read books that reflect their experiences and communities.&#8221;<\/p>\n<p>Sykes told USA TODAY in June that the government should not use politics to direct what students can study.<\/p>\n<p>&#8220;It\u2019s quite obvious that these (restrictions) were not reasonably related to a legitimate pedagogical concern but in fact were about implementing a ban on ideas the government finds politically incorrect or politically difficult.&#8221; That, according to Sykes, \u201cbecomes a First Amendment problem.\u201d<\/p>\n<p>The Pentagon told USA TODAY it does not comment on pending litigation.\u00a0<\/p>\n<p>Book bans, parents\u2019 rights a hot-button issue in 2025\u00a0<\/p>\n<p>The scale of the ban, in addition to its implementation at federally run schools, makes the lawsuit \u201creally the first of its kind,\u201d said <a href=\"https:\/\/pen.org\/profile\/kasey-meehan\/\" target=\"_blank\" rel=\"noreferrer noopener\">Kasey Meehan<\/a>, program director for PEN America\u2019s Freedom to Read initiative.\u00a0<\/p>\n<p>The organization, which is part of <a href=\"https:\/\/bannedbooksweek.org\/sponsors\/\" target=\"_blank\" rel=\"noreferrer noopener\">the coalition that sponsors Banned Books Week<\/a>, has monitored bans around the country since 2021. Meehan said <a href=\"https:\/\/www.usatoday.com\/story\/news\/education\/2022\/09\/19\/banned-books-week-schools-removed-books-2-500-times-since-2021\/10386845002\/\" target=\"_blank\" rel=\"noreferrer noopener\">the effort to ban books started at the local level<\/a> as parents addressed school boards with their concerns over the books in school libraries, which then led to statewide efforts <a href=\"https:\/\/www.cfpublic.org\/education\/2025-08-19\/federal-judge-overturns-large-part-of-floridas-book-ban-law\" target=\"_blank\" rel=\"noreferrer noopener\">and legislation<\/a>.\u00a0\u00a0<\/p>\n<p>Now, with President <a target=\"_blank\" href=\"https:\/\/www.usatoday.com\/news\/politics\/donald-trump\/\" data-autotag=\"26f031d1-9924-4f10-b4e6-019d076113d5\" rel=\"noopener\">Donald Trump<\/a> back in office, the movement has <a href=\"https:\/\/www.usatoday.com\/story\/entertainment\/books\/2025\/06\/18\/trump-administration-impact-books-reading\/84050696007\/\" target=\"_blank\" rel=\"noreferrer noopener\">been embraced at the federal level<\/a>, Meehan said.\u00a0\u00a0<\/p>\n<p>Florida and Texas had the highest number of book bans in the 2024-2025 school year, <a href=\"https:\/\/pen.org\/banned-books-week\/\" target=\"_blank\" rel=\"noreferrer noopener\">according to PEN America data<\/a>. The organization recorded more than 6,800 cases of book bans in that school year.\u00a0<\/p>\n<p>Books were also at the heart of Mahmoud v. Taylor, a case in which religious parents of students in a public school district in Maryland <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/04\/20\/supreme-court-lgbtq-storybooks-religion\/83123106007\/\" target=\"_blank\" rel=\"noreferrer noopener\">sought to opt their children out<\/a> from reading books with LGBTQ+ themes at school.\u00a0<\/p>\n<p>The <a href=\"https:\/\/www.usatoday.com\/story\/news\/politics\/2025\/06\/27\/supreme-court-decision-lgbtq-books-schools\/83814746007\/\" target=\"_blank\" rel=\"noreferrer noopener\">Supreme Court ruled in favor of the parents<\/a> in June, <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/24-297_4f14.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">saying that not allowing opt-outs<\/a> \u201cplaces an unconstitutional burden on the parents\u2019 rights to the free exercise of their religion.\u201d\u00a0<\/p>\n<p>Henninger sees a \u201creally important distinction to make\u201d between the two cases.\u00a0<\/p>\n<p>\u201cOpting your children out of something and saying: \u2018No thank you. I would not like my child to be a part of that discussion\u2019 is a completely different thing than deciding for every child in the school that they shouldn\u2019t be allowed to learn about that topic.\u201d\u00a0\u00a0<\/p>\n<p>Parents should be able to control their children\u2019s education \u201cto an extent,&#8221; Henninger said, adding that the executive branch is overstepping in its efforts to do the same.\u00a0<\/p>\n<p>\u201cIt\u2019s a slippery slope if you\u2019re going to start saying that the federal government can dictate what is allowed and what is not allowed to be taught to our children,\u201d she said. \u201cYou\u2019re opening up the door there to a lot of executive overreach and politicization of an education system, which is just not something that is ever okay.\u201d\u00a0<\/p>\n<p>Sykes, the ACLU attorney, told USA TODAY in June that the government should not use politics to limit what students can study. \u201cIt\u2019s quite obvious that these (restrictions) were not reasonably related to a legitimate pedagogical concern but in fact were about implementing a ban on ideas the government finds politically incorrect or politically difficult.\u201d That, according to Sykes, \u201cbecomes a First Amendment problem.\u201d<\/p>\n<p>Military members have had varying opinions about the administration&#8217;s actions and her lawsuit, Henninger said. Though there may be political disagreements, she said, they are ultimately more united by their unique shared experience of military life.\u00a0\u00a0<\/p>\n<p>\u201cWe can\u2019t let that kind of thing get in the way of friendships and a support system that is really, really important in this kind of living.\u201d<\/p>\n<p class=\"exclude-from-newsgate\">BrieAnna Frank is a First Amendment reporter at USA TODAY.
