{"id":502803,"date":"2025-10-16T00:30:20","date_gmt":"2025-10-16T00:30:20","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/502803\/"},"modified":"2025-10-16T00:30:20","modified_gmt":"2025-10-16T00:30:20","slug":"why-did-britains-case-against-two-alleged-chinese-spies-collapse","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/502803\/","title":{"rendered":"Why did Britain&#8217;s case against two alleged Chinese spies collapse?"},"content":{"rendered":"<p class=\"paragraph_paragraph__iYReA\">Allegations that two suspected Chinese spies were working in Britain&#8217;s parliament sent shock waves around Westminster and the United Kingdom after the men&#8217;s arrest in 2023.<\/p>\n<p class=\"paragraph_paragraph__iYReA\"><a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2024-04-23\/uk-police-charge-two-men-with-spying-for-china\/103756654\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/103756654\" target=\"_blank\" rel=\"noopener\">That shock<\/a> morphed into surprise and scrutiny, after charges against the pair were sensationally dropped last month.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The British government has come under sustained criticism since the case collapsed, with critics saying the Starmer government is worried about upsetting China.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Here&#8217;s what the case is about and why it has proved controversial.<\/p>\n<p>What is the UK Chinese spying case?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Christopher Cash, a former director of the China Research Group think-tank, and Christopher Berry, who was a researcher for a senior MP, were arrested by British police in March 2023 on suspicion of spying for China.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The <a class=\"Link_link__kR0xA Link_link__5eL5m ScreenReaderOnly_srLinkHint__OysWz Link_showVisited__C1Fea Link_showFocus__ALyv2\" href=\"https:\/\/www.abc.net.au\/news\/2024-04-23\/uk-police-charge-two-men-with-spying-for-china\/103756654\" data-component=\"Link\" data-uri=\"coremedia:\/\/article\/103756654\" target=\"_blank\" rel=\"noopener\">men were charged<\/a> with an offence under the 1911 Official Secrets Act (OSA) in April 2024, after allegedly passing politically sensitive information to a Chinese intelligence agent known as &#8220;Alex&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Both have denied any wrongdoing, and China has always maintained the case was entirely fabricated and a malicious slander.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In an unexpected move, Britain&#8217;s Crown Prosecution Service (CPS) dropped the charges on September 15, a month before the trial was due to start.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">It said the case no longer met the evidential threshold.<\/p>\n<p>Why did the spying case collapse?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Since the case was dropped, UK Prime Minister Keir Starmer&#8217;s Labour government has been accused by the Conservative Party of undermining the prosecution in order to avoid upsetting China, with which it is seeking better economic ties.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Opposition leader Kemi Badenoch told UK parliament on Wednesday that the collapse was &#8220;unbelievable&#8221;, adding that it &#8220;all stinks of a cover up&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">She blamed the collapse on government ministers who were &#8220;too weak to stand up to China&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Critics have particularly singled out Britain&#8217;s National Security Adviser Jonathan Powell because of what they say are his ties to China.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The UK Labour government has rejected these accusations, saying Mr Powell played no role in deciding the content of the evidence.<\/p>\n<p><img decoding=\"async\" alt=\"Keir Starmer delivering an address at a lectern in a wood-panelled room with British flags. \" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/10\/8e5d529bb4e8b6d2ef235fa004c22f06\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Keir Starmer says all decisions made in relation to the case have been independent of his government. (Reuters: James Manning\/pool)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;Suggestions that the government concealed evidence, withdrew witnesses, or restricted the ability of witnesses to draw on particular bits of evidence are all untrue,&#8221; UK Security Minister Dan Jarvis said in his statement to the House of Commons.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Sir Keir said the decision to drop the case was made independently by the CPS and that ministers were disappointed it had not gone ahead.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">He also denied claims, pushed by the Conservative Party, now in opposition, that officials privately lobbied for the charges to be dropped over fears a prosecution could prompt China to pull its investment in the UK.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">However, the CPS said that prior to the prosecution being dropped, it had repeatedly asked the government for new evidence that it believed was necessary for the case to go ahead.<\/p>\n<p>What is at the centre of the case?<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Two words are key to the issue.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Under the OSA, a law brought in to deal with German spying before World War I, it is an offence to communicate documents which might be useful to &#8220;an enemy&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">At the time when the men were charged, Britain&#8217;s then-Conservative government had classified China as an &#8220;epoch-defining challenge&#8221; but stopped short of officially labelling it a threat.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">However, politicians and the intelligence agencies had regularly warned about the threat of Chinese espionage and activities designed to influence British politicians, businesses and academia.<\/p>\n<p><img decoding=\"async\" alt=\"Woman walks past entrance to London's Westminster Magistrates Court.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/10\/4ff75a2e59c103a05110fbff11c657f2\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Christopher Berry and Christopher Cash were acquitted after the case was dropped in September. (AP:\u00a0Frank Augstein)<\/p>\n<p class=\"paragraph_paragraph__iYReA\">In July 2024, in a separate case which involved a team of Bulgarians later found guilty of spying for Russia, London&#8217;s Court of Appeal determined that an enemy under the OSA meant a country which &#8220;represents a current threat to the national security of the UK&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Following that ruling, the CPS said it had sought new evidence from the government, but that none of the additional witness statements obtained stated that China was a threat to national security at the time of the offence.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The government said the statements, provided by a deputy national security adviser without any involvement from Mr Powell, had to state the official position at the time of the charge under the then Conservative administration.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The CPS said it was now up to the government whether to make those statements public.<\/p>\n<p><img decoding=\"async\" alt=\"Kemi Badenoch pointing across the dispatch box in the British House of Commons.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/10\/fc44933df434b4b4de25c254cb6a27a9\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Kemi Badenoch has used the issue to put pressure on the government over its relationship with China.
