{"id":504381,"date":"2025-10-16T14:42:13","date_gmt":"2025-10-16T14:42:13","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/504381\/"},"modified":"2025-10-16T14:42:13","modified_gmt":"2025-10-16T14:42:13","slug":"people-on-state-pension-affected-by-dwp-rule-change-can-apply-for-compensation","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/504381\/","title":{"rendered":"People on State Pension affected by DWP rule change can apply for compensation"},"content":{"rendered":"<p>Adult Dependency Increases were extra amounts paid to pensioners who had a dependent spouse below State Pension age.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\">The Department for Work and Pensions (DWP) is inviting pensioners who lived abroad between April 6, 2010 and April 6, 2020, who feel they may have been \u2018adversely affected\u2019 by the ending of the <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.dailyrecord.co.uk\/all-about\/state-pension\" target=\"_blank\" aria-label=\"State PensionLink opens in a new tab.\" tabindex=\"0\" rel=\"noopener\">State Pension<\/a> Adult Dependency Increase (ADI), to contact them as they could be eligible for compensation.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\"><a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.gov.uk\/guidance\/the-ending-of-state-pension-adult-dependency-increase-adi?utm_medium=email&amp;utm_campaign=govuk-notifications-topic&amp;utm_source=3e3be4dc-c449-4d6f-83b0-879fdd8ede11&amp;utm_content=immediately#full-publication-update-history\" target=\"_blank\" aria-label=\"Adult Dependency IncreasesLink opens in a new tab.\" tabindex=\"0\" rel=\"noopener\">Adult Dependency Increases<\/a> were extra amounts of money paid to State Pensioners who had a dependent spouse below State Pension age. No new claims for ADI were allowed over the 10-year period already mentioned (April 6, 2010 &#8211; April 6, 2020).<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\">The DWP informed people living in Great Britain and abroad that their ADI would be ending. However, earlier this year the <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.dailyrecord.co.uk\/lifestyle\/money\/older-people-could-due-dwp-35056036\" target=\"_blank\" aria-label=\"Parliamentary and Health Service OmbudsmanLink opens in a new tab.\" tabindex=\"0\" rel=\"noopener\">Parliamentary and Health Service Ombudsman<\/a> (PHSO) found that DWP did not communicate this information in a reasonable timeframe to people living abroad and that this was maladministration.<\/p>\n<p>READ MORE: <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.dailyrecord.co.uk\/lifestyle\/money\/frozen-state-pension-uprating-expats-36040037\" data-tmdatatrack=\"read-more\" data-tmdatatrack-articleid=\"36040037\" data-tmdatatrack-source=\"editorial\" tabindex=\"0\" target=\"_blank\" rel=\"noopener\">State Pension uprating will not be paid to thousands of older people in April<\/a>READ MORE: <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.dailyrecord.co.uk\/lifestyle\/money\/new-state-pension-uprating-april-36070255\" data-tmdatatrack=\"read-more\" data-tmdatatrack-articleid=\"36070255\" data-tmdatatrack-source=\"editorial\" tabindex=\"0\" target=\"_blank\" rel=\"noopener\">Full list of New and Basic State Pension weekly payments due from April<\/a><\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\">The PHSO found no fault in the way DWP communicated with people living in Great Britain.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\">DWP said: \u201cIf you feel you were adversely affected by the removal of an ADI, due to when you received notification after 6 April 2010 that it was going to end, then you may be eligible for compensation.\u201d<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\">The <a class=\"TextLink_text-link__dBSS0 TextLink_enabled__dJF3l\" href=\"https:\/\/www.ombudsman.org.uk\/news-and-blog\/news\/dwp-failings-left-ex-pat-dark-about-ps3000-year-pension-cut\" target=\"_blank\" aria-label=\"PHSO reportLink opens in a new tab.\" tabindex=\"0\" rel=\"noopener\">PHSO report<\/a> said: \u201cThe number of those who were living abroad and entitled to ADI is unknown but in May 2019, a year before ADI ended, DWP told Parliament that 10,817 people were still in receipt of ADI.\u201d<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\">Commenting at the time of the published report in January, Rebecca Hilsenrath, Parliamentary and Health Service Ombudsman, said: \u201cPoor communication from Government departments damages trust in public services.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\">\u201cDWP has a history of failing to communicate pension policy changes clearly and failing to learn from its mistakes.\u201d<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\">Ms Hilsenrath highlighted the case of Adrian Furnival, 82, and his wife Sheila, 67, who moved to Brittany in 1994, however, Adrian found out in 2018 through the annual DWP uprating letter that from 2020 he would no longer receive Adult Dependency Increase payments.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\">The PHSO said this meant he would be over \u00a3250 a month worse off.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\">The Ombudsman added: \u201cIn Adrian\u2019s case, this meant that, without the right information, he lost the opportunity to prepare for his retirement. It also caused him unnecessary financial worry.<\/p>\n<p class=\"Paragraph_paragraph-text__PVKlh \" data-tmdatatrack=\"content-unit\" data-tmdatatrack-type=\"paragraph\" publication=\"dailyrecord\">\u201cAnyone who believes they have had a similar experience to Adrian should contact DWP.
