{"id":508294,"date":"2025-10-18T02:06:32","date_gmt":"2025-10-18T02:06:32","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/508294\/"},"modified":"2025-10-18T02:06:32","modified_gmt":"2025-10-18T02:06:32","slug":"lords-plot-to-derail-labours-trans-guidance-on-single-sex-spaces","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/508294\/","title":{"rendered":"Lords plot to derail Labour\u2019s trans guidance on single-sex spaces"},"content":{"rendered":"<p>A group of peers is at the centre of a House of Lords plot to derail guidance protecting women\u2019s single-sex spaces, leaked documents have revealed.<\/p>\n<p>The group, which includes a former head of Stonewall and one of its founder members, is seeking to scupper rules drawn up by the Equality and Human Rights Commission (EHRC) by delaying the government\u2019s process until a new chair of the regulator is appointed.<\/p>\n<p>A source told The Times that Lord Collins of Highbury, the government\u2019s equalities spokesman in the House of Lords, had been involved in \u201cstrategy development\u201d with the group. Neither he nor the Office for Equality and Opportunity has denied the claim, repeatedly refusing to say whether he had met or been contacted by the group.<\/p>\n<p>The women\u2019s and equalities minister, Bridget Phillipson, received the updated rules last month. <\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">They are understood to restrict the ability of trans people to access services of their chosen gender and follow an April Supreme Court ruling to clarify that, under the Equality Act 2010, the term \u201cwoman\u201d refers to biological sex.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">Collins told the Lords this week, <a href=\"https:\/\/www.thetimes.com\/uk\/politics\/article\/delays-trans-guidance-gyms-single-sex-tlrl5085r\" class=\"link__RespLink-sc-1ocvixa-0 csWvlP\" target=\"_blank\" rel=\"noopener\">during a debate on the delay<\/a> to the laying of the guidance, that \u201cwe have to consider this matter seriously and take into account all possible risks and issues to ensure that we have a legally proofed code that is understood by everyone\u201d.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">He said there had not been a \u201cdelayed process\u201d and that Phillipson would need time to \u201ctake a fully informed decision\u201d. <\/p>\n<p><img decoding=\"async\" alt=\"A protester holds a large trans pride flag outside Downing Street during a demonstration in support of trans rights.\" loading=\"lazy\" src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/10\/\/7df8c0b6-4c57-4ebe-aab8-74cb5378eeb2.jpg\" class=\"responsive-sc-1nnon4d-0 bAbKns\"\/><\/p>\n<p>Trans protesters outside Downing Street<\/p>\n<p>VUK VALCIC\/SOPA IMAGES\/LIGHTROCKET \/GETTY IMAGES<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">Under the Equality Act, once the code is approved, it will be laid in parliament for 40 days before it becomes statutory. There is no requirement for politicians to be able to debate the code, although some MPs and peers, including <a href=\"https:\/\/www.thetimes.com\/uk\/politics\/article\/labour-deputy-leadership-bridget-phillipson-lucy-powell-8l3gfq6bn\" class=\"link__RespLink-sc-1ocvixa-0 csWvlP\" target=\"_blank\" rel=\"noopener\">Phillipson\u2019s deputy leadership rival, Lucy Powell<\/a>, said they should be able to do so.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">The guidance was updated after the Supreme Court ruling that said that a woman was defined biologically in reference to the Equality Act and that this definition applied to any organisation that provided services to the public.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">It has not yet been laid in parliament, however, and Phillipson has been accused of <a href=\"https:\/\/www.thetimes.com\/uk\/politics\/article\/single-sex-trans-bridget-phillipson-fdwdzw25r\" class=\"link__RespLink-sc-1ocvixa-0 csWvlP\" target=\"_blank\" rel=\"noopener\">delaying its release<\/a> in a bid to save her Labour deputy leadership campaign, which she has denied.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">It is understood the group of peers met in parliament on Wednesday after a debate in the Lords on the guidance.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">Among those in the group is Baroness Hunt, who previously led <a href=\"https:\/\/www.thetimes.com\/uk\/article\/stonewall-tried-to-silence-warnings-of-weak-evidence-for-trans-healthcare-n299v00c3\" class=\"link__RespLink-sc-1ocvixa-0 csWvlP\" target=\"_blank\" rel=\"noopener\">Stonewall\u2019s \u201cno debate\u201d approach<\/a> on transgender rights. It warned that the EHRC\u2019s interpretations carried \u201cweight far beyond the courtroom\u201d.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">The strategy outlined plans to present the group as \u201cconstructive partners\u201d while pushing for additional due diligence on the guidance, which critics suggested was a move designed to delay implementation. <\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">It said they would push the government to \u201cuse the forthcoming appointment of a new chair and additional commissioners as an opportunity to restore balance and credibility to the EHRC\u2019s leadership\u201d. <\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">Baroness Falkner, the current chair of the EHRC, who has advocated for women\u2019s rights in the debate on gender, will step down at the end of November. Her replacement, <a href=\"https:\/\/www.thetimes.com\/uk\/politics\/article\/mps-openly-hostile-to-starmers-pick-as-equalities-watchdog-chief-03wbdk5ck\" class=\"link__RespLink-sc-1ocvixa-0 csWvlP\" target=\"_blank\" rel=\"noopener\">Mary-Ann Stephenson<\/a>, has already faced criticism from transgender activists over her gender-critical views.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">The EHRC is also due to appoint at least three new commissioners in the coming months and the document suggested the group would attempt to lobby the watchdog\u2019s new chair and commissioners to water down its guidance.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">The strategy said this would create \u201crisk and opportunity\u201d. It said: \u201cWith the right leadership and balance of commissioners, the EHRC can be pulled back to the middle ground: credible, authoritative and committed to upholding equality for all communities.\u201d<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">It also identified \u201copportunities over the next parliament\u201d, including pressuring the government to \u201cundertake thorough consultation and legal due diligence before the EHRC\u2019s draft statutory guidance is laid before parliament\u201d. The document warns that without this, ministers risk being \u201csaddled with a document that is both harmful in practice and vulnerable to challenge in the courts\u201d.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">Peers were encouraged to table written and oral questions to ensure ministers confirm that the guidance has undergone proper consultation, legal review, and equality impact assessments, and to raise concerns about \u201cbalance and credibility\u201d in upcoming EHRC appointments.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">The group includes a number of peers including Hunt, the Stonewall co-founder <a href=\"https:\/\/www.thetimes.com\/uk\/politics\/article\/peer-apologises-hustings-cancelled-michael-cashman-rosie-duffield-cwh0mzx32\" class=\"link__RespLink-sc-1ocvixa-0 csWvlP\" target=\"_blank\" rel=\"noopener\">Lord Cashman<\/a>, the former Labour health minister Baroness Thornton, the former Scottish Labour leader Baroness Alexander, the Lib Dem peer Baroness Barker, Baroness Chakrabarti, Baroness Ramsey and Baroness Donaghy.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">All of those mentioned were contacted for comment. Government sources insisted the group would have no bearing on the timing of the guidance being laid in parliament.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">Claire Coutinho, the shadow equalities minister, said: \u201cIt\u2019s outrageous, though hardly surprising, that peers with links to Stonewall are trying to delay this crucial guidance. Women and girls deserve protection, not dither and delay.<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">\u201cBridget Phillipson needs to get on with the day job and publish the EHRC guidance immediately.\u201d<\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">Maya Forstater, the chief executive of the charity Sex Matters, said it was \u201cdevastating to see a group of peers in the House of Lords plotting to thwart the law\u201d. <\/p>\n<p class=\"responsive__Paragraph-sc-1pktst5-0 gaEeqC\">She said: \u201cThe Supreme Court has spelled out what the Equality Act means, and that women\u2019s rights depend on recognising that everyone is either male or female, and no one can change sex.
