{"id":522177,"date":"2025-10-23T12:41:12","date_gmt":"2025-10-23T12:41:12","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/522177\/"},"modified":"2025-10-23T12:41:12","modified_gmt":"2025-10-23T12:41:12","slug":"new-yorks-war-on-the-gig-economy-will-lead-to-higher-prices","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/522177\/","title":{"rendered":"New York\u2019s War on the Gig Economy Will Lead to Higher Prices"},"content":{"rendered":"<p>The New York City Council <a href=\"https:\/\/www.cbsnews.com\/newyork\/news\/grocery-food-delivery-worker-bills-nyc\" target=\"_blank\" rel=\"noreferrer noopener\">recently voted<\/a> to have the city\u2019s minimum wage rate for app-based restaurant delivery drivers cover grocery drivers as well. Now it appears determined to go even further.<\/p>\n<p>The council is considering whether to <a href=\"https:\/\/nypost.com\/2025\/09\/23\/opinion\/city-council-aims-to-destroy-food-delivery-in-order-to-save-it\" target=\"_blank\" rel=\"noreferrer noopener\">scrap<\/a> the at-will employment arrangement\u2014which allows either workers or employers to terminate the relationship at any time and for any reason\u2014under which the city\u2019s gig economy has operated since its inception. Doing so threatens the future of gig work in New York and will result in higher food delivery prices for New Yorkers.<\/p>\n<p class=\"cta-heading\" style=\"line-height: 28px;\">Finally, a reason to check your email.<\/p>\n<p class=\"cta-subheading\" style=\"line-height: 22px;\">Sign up for our <strong>free newsletter<\/strong> today.<\/p>\n<p>The proposed <a href=\"https:\/\/legistar.council.nyc.gov\/LegislationDetail.aspx?ID=7480055&amp;GUID=265D0ED3-FB2F-48B9-AF70-79973B11E094\" target=\"_blank\" rel=\"noreferrer noopener\">bill<\/a> purports to protect gig-based delivery drivers by requiring app operators to establish \u201cjust cause\u201d before deactivating a driver\u2019s account on their network. Platforms would need to provide 14 days\u2019 notice of any such action. The bill also sets up an arbitration process through which drivers can contest their deactivation.<\/p>\n<p>What constitutes \u201cjust cause?\u201d The bill would require the platforms to prove that there are \u201cbona fide economic reasons\u201d for deactivation. This can only be done by offering up business records showing \u201ca proportionate reduction in volume of sales or profit within the fiscal quarter prior to the deactivation.\u201d There\u2019s no clear indication as to what constitutes a \u201cproportionate reduction,\u201d but the bill necessarily takes that determination out of the hands of the companies and puts it into the hands of bureaucrats and arbitrators.<\/p>\n<p>The bill\u2019s sponsors frame the legislation as a response to a flurry of deactivations, with <a href=\"https:\/\/nypost.com\/2024\/07\/14\/business\/nyc-food-delivery-workers-losing-jobs-after-minimum-wage-hike-report\" target=\"_blank\" rel=\"noreferrer noopener\">reports<\/a> of up to 50 to 70 delivery drivers being deactivated per day. The uptick mostly appears to trace back to December 2023, when New York became the <a href=\"https:\/\/www.nrn.com\/restaurant-labor\/new-york-city-passes-nation-s-first-minimum-wage-for-delivery-workers\" target=\"_blank\" rel=\"noreferrer noopener\">first<\/a> city in the United States to enact a minimum wage for app-based restaurant delivery drivers. This law caused a host of <a href=\"https:\/\/nypost.com\/2024\/07\/14\/business\/nyc-food-delivery-workers-losing-jobs-after-minimum-wage-hike-report\" target=\"_blank\" rel=\"noreferrer noopener\">adverse effects<\/a>\u2014not least to drivers themselves.<\/p>\n<p>Once the minimum-wage law went into effect, the platforms incurred higher labor costs, which soon led them to migrate to a shift-based approach. The waitlist to become a driver on popular platforms such as UberEats grew to <a href=\"https:\/\/nypost.com\/2024\/07\/14\/business\/nyc-food-delivery-workers-losing-jobs-after-minimum-wage-hike-report\" target=\"_blank\" rel=\"noreferrer noopener\">tens of thousands<\/a>, and the platforms became leery of lackluster drivers taking spots from more productive individuals on the waitlist. As a result, platforms had an incentive to deactivate the accounts of idle or subpar delivery drivers.<\/p>\n<p>In other words, one misguided government policy (the minimum-wage ordinance) created unintended consequences (deactivations). Now city officials are trying to respond by instituting another misguided policy: eliminating at-will employment. This one-way ratchet effect is part of a larger push by the progressive Left to <a href=\"https:\/\/www.city-journal.org\/article\/free-the-gig-economy\" target=\"_blank\" rel=\"noreferrer noopener\">redefine gig work<\/a> from contracting arrangements to full-scale employment.<\/p>\n<p>For years, the Left has sought to <a href=\"https:\/\/www.nationalaffairs.com\/publications\/detail\/a-flexible-worker-agenda\" target=\"_blank\" rel=\"noreferrer noopener\">reclassify<\/a> all gig workers from independent contractors who enjoy flexible working arrangements to traditional employees. This battle continues to rage in <a href=\"https:\/\/www.city-journal.org\/article\/stop-punishing-gig-workers-california\" target=\"_blank\" rel=\"noreferrer noopener\">state capitals across the country<\/a>. Meantime, the Left is attempting to press its gig-workers-as-employees agenda through other means, like eliminating at-will employment status.<\/p>\n<p>The more policymakers treat gig workers like traditional employees\u2014through reclassification, minimum-wage mandates, and curbs on at-will employment\u2014the less flexibility drivers have. But flexibility is the Number One benefit drivers <a href=\"https:\/\/www.nationalaffairs.com\/publications\/detail\/a-flexible-worker-agenda\" target=\"_blank\" rel=\"noreferrer noopener\">look for<\/a> in choosing gig work.<\/p>\n<p>These policies also inevitably raise the cost of food delivery for consumers. The recent minimum-wage ordinance <a href=\"https:\/\/nypost.com\/2024\/07\/14\/business\/nyc-food-delivery-workers-losing-jobs-after-minimum-wage-hike-report\" target=\"_blank\" rel=\"noreferrer noopener\">raised<\/a> food prices by 10 percent in New York. <a href=\"https:\/\/reason.com\/2024\/03\/16\/seattle-law-mandating-higher-delivery-driver-pay-is-a-disaster\" target=\"_blank\" rel=\"noreferrer noopener\">Other cities<\/a> that have instituted minimum-wage rules for delivery drivers have seen similar food-price spikes.<\/p>\n<p>Facing restrictions in their ability to weed out less productive drivers, the platforms will again be forced to bear higher labor costs. These will, in turn, be passed along to New Yorkers ordering their favorite takeout.
