{"id":535921,"date":"2025-10-29T18:04:16","date_gmt":"2025-10-29T18:04:16","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/535921\/"},"modified":"2025-10-29T18:04:16","modified_gmt":"2025-10-29T18:04:16","slug":"france-adopts-bill-defining-rape-as-non-consensual-act","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/535921\/","title":{"rendered":"France adopts bill defining rape as non-consensual act"},"content":{"rendered":"<p>PARIS (AP) \u2014 France\u2019s Senate gave its final approval on Wednesday to a bill defining rape and other sexual assault as any non-consensual sexual act, a move that comes after the landmark drugging and rape trial that shook France and <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/france-gisele-pelicot-rape-sexual-violence-4da8a8c5ca1b8fba85759ce4e9c0b77a\" rel=\"nofollow noopener\" target=\"_blank\">turned Gis\u00e8le Pelicot into a global icon<\/a>.<\/p>\n<p>Senators voted 327-0 in favor of the bill, with 15 abstentions.<\/p>\n<p>The bill was presented in January following the conviction of 51 men for the rape and abuse of Gis\u00e8le Pelicot in a case which spurred <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/france-pelicot-trial-rape-culture-b846c0258e90daed7989693ef308547c\" rel=\"nofollow noopener\" target=\"_blank\">a national reckoning over rape culture in France<\/a>.<\/p>\n<p>Marie-Charlotte Garin and V\u00e9ronique Riotton, lawmakers for the Greens and President Emmanuel Macron\u2019s centrist party, respectively, who championed the bill, wrote: \u201cIt\u2019s time to take action and take a new step forward in the fight against sexual violence.\u201d<\/p>\n<p>The bill states that \u201cany non-consensual sexual act constitutes sexual assault.\u201d <\/p>\n<p>Consent is defined as \u201cfreely given, informed, specific, prior and revocable\u201d and assessed \u201cin the light of the circumstances.\u201d The text says it \u201ccannot be inferred solely from the silence or the lack of reaction of the victim.\u201d <\/p>\n<p>The bill also specifies that there is no consent if the sexual act is committed with \u201cviolence, coercion, threat or surprise.\u201d<\/p>\n<p>    <a class=\"AnchorLink\" id=\"more-section-display-name\"\/><\/p>\n<p>    <a class=\"Link\" aria-label=\"French appeals court revisits shocking Gis\u00e8le Pelicot rape case\" href=\"https:\/\/apnews.com\/article\/france-rape-gisele-pelicot-appeals-93956ee072543b4a46301fdc1c8ca82a\" target=\"_blank\" rel=\"noopener\"><\/p>\n<p><img decoding=\"async\" class=\"Image\" alt=\"Gisele Pelicot arrives to an appeals court set to hear the case of a man challenging his conviction, less than a year after the landmark verdict in a drugging and rape trial that shook France, Monday, Oct. 6, 2025 in Nimes, southern France. The far right voted against it.<\/p>\n<p>The Senate\u2019s approval is the last step before the bill becomes law via official publication.<\/p>\n<p>France rejoins many other European nations that have similar consent-based laws on rape, including neighboring Germany, Belgium and Spain.<\/p>\n<p>Until now, rape under French law was defined as penetration or oral sex using \u201cviolence, coercion, threat or surprise.\u201d France has taken other steps in recent years to toughen punishment for sexual misconduct, including <a class=\"Link AnClick-LinkEnhancement\" data-gtm-enhancement-style=\"LinkEnhancementA\" href=\"https:\/\/apnews.com\/article\/france-to-set-age-sexual-consent-15-7559acf85daea29ce5f2fa6221f4e491\" rel=\"nofollow noopener\" target=\"_blank\">setting 15 as the age of consent<\/a>. <\/p>\n<p>In December, Pelicot\u2019s ex-husband and 50 other men were convicted of sexually assaulting her between 2011 and 2020 while she was under chemical submission. <\/p>\n<p>Dominique Pelicot was sentenced to 20 years in prison, while sentences for other defendants ranged from three to 15 years imprisonment.
