{"id":561501,"date":"2025-11-10T13:57:11","date_gmt":"2025-11-10T13:57:11","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/561501\/"},"modified":"2025-11-10T13:57:11","modified_gmt":"2025-11-10T13:57:11","slug":"appeal-over-bungalow-thrown-out-by-inspector","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/561501\/","title":{"rendered":"Appeal over bungalow thrown out by inspector"},"content":{"rendered":"<p>\n  Sandwell Council rejected a planning application to build the two-bed bungalow in Castle Close, Cradley Heath, saying a near five-metre retaining wall would leave neighbours feeling \u201cenclosed.\u201d\n<\/p>\n<p>\n  An appeal over the decision was then made to the government\u2019s planning inspectorate but the move has been dismissed.\u00a0\n<\/p>\n<p>\n  The government planning inspector agreed with Sandwell Council saying the near five metre wall and fence would be \u2018significantly overbearing\u2019.\n<\/p>\n<p>\n  A report outlining the decision said: \u201cAs a result, the outlook from the rear elevations [of the homes in] Perry Park Road looking across their short, gently rising, rear gardens, and from those gardens themselves, would become markedly more enclosed.\u00a0\n<\/p>\n<p>\n  \u201cThe retaining wall and fence would be tall, domineering features which would loom over those properties, leading to a significant sense of overbearance, to the significant detriment of the occupiers\u2019 living conditions.\n<\/p>\n<p>\n  Rejecting the application, planners at Sandwell Council said the retaining wall and fence was \u201cpoorly designed\u201d and would be an \u201cabrupt and dominant feature\u201d for those living in Perry Park Road.\u00a0\n<\/p>\n<p>\n  As a result it would result in an \u201cunacceptable sense of enclosure and loss of outlook,\u201d the council said.\n<\/p>\n<p>\n  Eight people had objected to the plans saying it would result in a loss of privacy and also lead to a loss of a wildlife habitat.\n<\/p>\n<p>\n  Some objectors also pointed to landslides in nearby High Haden Road, less than a mile away, where new homes on a recently built estate were \u2018cut off\u2019 by a huge mound of earth blocking the road.\n<\/p>\n<p>\n  A report outlining the objection said: \u201cThe local planning authority are therefore of the opinion that the scale, massing and height of the proposed boundary retaining wall and fencing is of a poor design presenting an abrupt and dominant feature to the properties on Perry Park Road resulting in an unacceptable sense of enclosure and loss of outlook.\u201d\n<\/p>\n<p>\n  However, the council said it did not believe the bungalow would cause a \u201csignificant loss of privacy\u201d and the retaining wall would prevent overlooking.\u00a0\n<\/p>\n<p>\n  \u201cAny loss of light from the structure would be limited to early morning due to the orientation of the properties,\u201d the council added.<\/p>\n","protected":false},"excerpt":{"rendered":"Sandwell Council rejected a planning application to build the two-bed bungalow in Castle Close, Cradley Heath, saying a&hellip;\n","protected":false},"author":2,"featured_media":561502,"comment_status":"","ping_status":"","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[7820],"tags":[855,748,393,4884,16,15],"class_list":{"0":"post-561501","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-birmingham","8":"tag-birmingham","9":"tag-britain","10":"tag-england","11":"tag-great-britain","12":"tag-uk","13":"tag-united-kingdom"},"share_on_mastodon":{"url":"","error":""},"_links":{"self":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts\/561501","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/users\/2"}],"replies":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/comments?post=561501"}],"version-history":[{"count":0,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/posts\/561501\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/media\/561502"}],"wp:attachment":[{"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/media?parent=561501"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/categories?post=561501"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/www.europesays.com\/uk\/wp-json\/wp\/v2\/tags?post=561501"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
