{"id":577538,"date":"2025-11-18T04:08:17","date_gmt":"2025-11-18T04:08:17","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/577538\/"},"modified":"2025-11-18T04:08:17","modified_gmt":"2025-11-18T04:08:17","slug":"us-trade-tribunal-to-consider-new-apple-watch-import-ban","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/577538\/","title":{"rendered":"US trade tribunal to consider new Apple Watch import ban"},"content":{"rendered":"\n<p class=\"yf-1090901\">By Blake Brittain<\/p>\n<p class=\"yf-1090901\">(Reuters) -The U.S. International Trade Commission decided on Friday to hold a new proceeding to determine whether imports \u200bof <a href=\"https:\/\/www.yahoo.com\/organizations\/apple\/\" data-ylk=\"slk:Apple;elm:context_link;itc:0;sec:content-canvas\" class=\"link \" target=\"_blank\" rel=\"noopener\">Apple<\/a>&#8216;s updated Apple Watches should be banned as part of a \u200cpatent dispute with medical monitoring technology company Masimo.<\/p>\n<p class=\"yf-1090901\">The ITC said in an order that it would investigate \u200cwhether Apple Watches that were redesigned to circumvent a previous import ban issued by the commission still infringe Masimo patents covering blood-oxygen measurement technology.<\/p>\n<\/p>\n<p class=\"yf-1090901\">The commission set a target to finish the investigation within six months.<\/p>\n<p class=\"yf-1090901\">Apple said the case was a meritless attempt to block its smartwatches&#8217;\u2060 blood oxygen feature and \u200cthat Masimo had copied its watch design in order to bring the complaint.<\/p>\n<p class=\"yf-1090901\">APPLE, MASIMO FIGHTING ON MULTIPLE FRONTS<\/p>\n<p class=\"yf-1090901\">The case is part of a \u200dcontentious, multi-front patent fight between Apple and Masimo, an Irvine, California-based medical monitoring technology company that has accused the tech company of hiring away its employees to steal \u200bits pulse-oximetry innovations.<\/p>\n<p class=\"yf-1090901\">The commission blocked imports of Apple&#8217;s Series 9 and Ultra \u200c2 smartwatches in 2023 after finding that Masimo&#8217;s patents were infringed. Apple removed blood-oxygen reading technology from its watches to avoid the ban, but reintroduced an updated version of the technology in August with approval from U.S. Customs and Border Protection.<\/p>\n<p class=\"yf-1090901\">Masimo has sued Customs over the approval, while Apple has separately challenged the \u2060ITC&#8217;s ban at a federal appeals court.<\/p>\n<p class=\"yf-1090901\">Masimo has \u200balso sued Apple in California federal court for patent \u200binfringement and trade-secret theft. A jury in Santa Ana determined separately on Friday that Apple owes $634 million in damages for infringing a Masimo \u200dpatent.<\/p>\n<p class=\"yf-1090901\">A California judge declared a \u2060mistrial in Masimo&#8217;s trade-secret case against Apple in 2023 after a jury failed to reach a unanimous verdict.
