So it was timely, that, following <a href=\"http:\/\/www.mondaq.com\/redirection.asp?article_id=1712096&amp;company_id=3442&amp;redirectaddress=https:\/\/www.lewissilkin.com\/insights\/2025\/02\/25\/ofcom-consults-on-draft-guidance-about-protecting-women-and-girls-online-102k1kv\" target=\"_blank\" rel=\"noopener\">consultation<\/a>, Ofcom published its <a href=\"https:\/\/www.ofcom.org.uk\/online-safety\/illegal-and-harmful-content\/a-safer-life-online-for-women-and-girls\" target=\"_blank\" rel=\"noopener\">final guidance<\/a> about protecting women and&#13;<br \/>\ngirls online. It deals with content and activity where service&#13;<br \/>\nproviders have duties under the Online Safety Act 2023 and where&#13;<br \/>\nthe content disproportionately affects women and girls. The&#13;<br \/>\nguidance focuses on four key areas of harm and sets out various&#13;<br \/>\nmeasures for tech companies. There have been some changes based on&#13;<br \/>\nfeedback.<\/p>\n<p>What does a tech company have to do?<\/p>\n<p>Ofcom says that tech companies should make sure that governance&#13;<br \/>\nand accountability processes address online gender-based harms,&#13;<br \/>\nthat they conduct risk assessments that focus on harms to women and&#13;<br \/>\ngirls; and they should be transparent about women and girls&#8217;&#13;<br \/>\nonline safety.<\/p>\n<p>They also need to conduct abusability evaluations and product&#13;<br \/>\ntesting, set safer default settings and reduce the circulation of&#13;<br \/>\ncontent depicting, promoting or encouraging online gender-based&#13;<br \/>\nharms.<\/p>\n<p>The final three actions are giving users better control over&#13;<br \/>\ntheir experiences, enabling users who experience online&#13;<br \/>\ngender-based harms to make reports, and responding appropriately&#13;<br \/>\nwhen online gender-based harms happen.<\/p>\n<p>For each action, Ofcom sets out what a baseline of safety looks&#13;<br \/>\nlike (foundational steps) for service providers to meet their&#13;<br \/>\nduties to protect UK users. It also highlights additional good&#13;<br \/>\npractice steps to illustrate how providers can build on the&#13;<br \/>\nfoundational steps to create safer experiences for women and girls,&#13;<br \/>\ngive their users more autonomy, and provide assurance that users&#13;<br \/>\ncan seek appropriate redress for any harm that does occur.<\/p>\n<p>The four areas of harm and what measures to employ<\/p>\n<p><strong>Misogynistic abuse and sexual violence<\/strong><\/p>\n<p>Tech firms should consider:<\/p>\n<ul>&#13;<\/p>\n<li>introducing &#8220;prompts&#8221; asking users to reconsider&#13;<br \/>\nbefore posting harmful content;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>imposing &#8216;timeouts&#8217; for users who repeatedly attempt to&#13;<br \/>\nabuse a platform or functionality to target victims;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>promoting diverse content and perspectives through their&#13;<br \/>\nrecommender &#8220;for you&#8221; systems to help prevent toxic echo&#13;<br \/>\nchambers; and<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>de-monetising posts or videos which promote misogynistic abuse&#13;<br \/>\nand sexual violence.<\/li>\n<p>&#13;\n<\/ul>\n<p><strong>Pile-ons and coordinated harassment<\/strong><\/p>\n<p>Tech firms should consider:<\/p>\n<ul>&#13;<\/p>\n<li>setting volume limits on posts (&#8220;rate limiting&#8221;) to&#13;<br \/>\nhelp prevent mass-posting of abuse in pile-ons;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>allowing users to quickly block or mute multiple accounts at&#13;<br \/>\nonce; and<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>introducing more sophisticated tools for users to make multiple&#13;<br \/>\nreports and track their progress.<\/li>\n<p>&#13;\n<\/ul>\n<p><strong>Stalking and coercive control<\/strong><\/p>\n<p>The guidance suggests that tech firms should consider:<\/p>\n<ul>&#13;<\/p>\n<li>bundling safety features to make it easier to set accounts to&#13;<br \/>\nprivate;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>introducing enhanced visibility restrictions to control who can&#13;<br \/>\nsee past and present content;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>ensuring stronger account security; and<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>removing geolocation by default.<\/li>\n<p>&#13;\n<\/ul>\n<p><strong>Image-based sexual abuse<\/strong><\/p>\n<p>Under the guidance, tech firms should consider:<\/p>\n<ul>&#13;<\/p>\n<li>using automated technology (hash-matching) to detect and remove&#13;<br \/>\nnon-consensual intimate images;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>blurring nudity, giving adults the option to override;<\/li>\n<p>&#13;<br \/>\n&#13;<\/p>\n<li>signposting users to supportive information including how to&#13;<br \/>\nreport a potential crime.<\/li>\n<p>&#13;\n<\/ul>\n<p>More broadly, Ofcom expects tech firms to subject new services&#13;<br \/>\nor features to &#8216;&#8221;abusability&#8221; testing before they&#13;<br \/>\nroll them out, to identify from the outset how they might be&#13;<br \/>\nmisused by perpetrators. Moderation teams should also receive&#13;<br \/>\nspecialised training on online gender-based harms. It also says&#13;<br \/>\nthat companies should consult with experts about design policies&#13;<br \/>\nand safety features that work effectively for women and girls,&#13;<br \/>\nwhile continually listening and learning from survivors&#8217; and&#13;<br \/>\nvictims&#8217; real-life experiences, for example, by running user&#13;<br \/>\nsurveys.<\/p>\n<p>Tech and harms evolve rapidly, and Ofcom expects providers to&#13;<br \/>\nregularly look at what they may need to do to respond to changing&#13;<br \/>\nthreats and risks from online gender-based harms. Ofcom also&#13;<br \/>\nexpects services with the highest risk and largest reach to do more&#13;<br \/>\nto make sure that they achieve safer experiences for women and&#13;<br \/>\ngirls.<\/p>\n<p>Ofcom has set out five areas of action for itself, and among&#13;<br \/>\nother things, will report in summer 2027 on progress. If progress&#13;<br \/>\nis inadequate, it will consider making formal recommendations to&#13;<br \/>\nthe government about where the Online Safety Act may need to be&#13;<br \/>\nstrengthened. It will also be enforcing and <a href=\"http:\/\/www.mondaq.com\/redirection.asp?article_id=1712096&amp;company_id=3442&amp;redirectaddress=https:\/\/www.lewissilkin.com\/insights\/2025\/07\/03\/ofcom-consults-on-additional-online-safety-measures-102kqyr\" target=\"_blank\" rel=\"noopener\">updating its guidance<\/a> on illegal harms to&#13;<br \/>\ncover the new <a href=\"http:\/\/www.mondaq.com\/redirection.asp?article_id=1712096&amp;company_id=3442&amp;redirectaddress=https:\/\/www.lewissilkin.com\/insights\/2025\/10\/16\/online-safety-update-regulatory-developments-in-the-uk-and-the-eu-102lq8b\" target=\"_blank\" rel=\"noopener\">priority offence of cyberflashing<\/a> and to&#13;<br \/>\nintroduce hash-matching measures. It has also written an open&#13;<br \/>\nletter to tech companies setting out its expectations that they&#13;<br \/>\nwill comply with the guidance. It will also continue to enforce the&#13;<br \/>\nOnline Safety Act more broadly, as well as continuing with its&#13;<br \/>\nresearch and engagement programme.<\/p>\n<p>Commentators have expressed disappointment that the guidance&#13;<br \/>\nisn&#8217;t binding and pointed out that whether it works will depend&#13;<br \/>\non the attitude of the platform concerned. Others have suggested&#13;<br \/>\nthat the government should put the guidance on a statutory footing.&#13;<br \/>\nHowever, as Ofcom will not move to make recommendations to the&#13;<br \/>\ngovernment for new laws until and unless it deems progress is&#13;<br \/>\ninadequate following its report in 2027, additional legislation to&#13;<br \/>\nprotect women and girls is unlikely for another two years.<\/p>\n<p>The content of this article is intended to provide a general&#13;<br \/>\nguide to the subject matter.
