{"id":621203,"date":"2025-12-09T01:44:12","date_gmt":"2025-12-09T01:44:12","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/621203\/"},"modified":"2025-12-09T01:44:12","modified_gmt":"2025-12-09T01:44:12","slug":"businessman-launches-high-court-challenge-to-baggot-street-hospital-primary-care-centre-the-irish-times","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/621203\/","title":{"rendered":"Businessman launches High Court challenge to Baggot Street Hospital primary care centre \u2013 The Irish Times"},"content":{"rendered":"<p class=\"c-paragraph paywall \">A businessman is taking a <a href=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\" target=\"_blank\" rel=\"noreferrer noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/high-court\/\">High Court<\/a> action challenging a grant of planning permission for a primary care centre at the rear of the old <a href=\"https:\/\/www.irishtimes.com\/tags\/baggot-street\" target=\"_blank\" rel=\"noreferrer noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/baggot-street\">Baggot Street<\/a> Hospital in Dublin 4. <\/p>\n<p class=\"c-paragraph paywall \">Eamonn Hoey, who runs a dry-cleaning business on Baggot Street, was on Monday given permission by the court to pursue the case challenging <a href=\"https:\/\/www.irishtimes.com\/tags\/an-coimisiun-pleanala\" target=\"_blank\" rel=\"noreferrer noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/an-coimisiun-pleanala\">An Coimisi\u00fan Plean\u00e1la<\/a>\u2019s (ACP) grant of permission to the <a href=\"https:\/\/www.irishtimes.com\/tags\/health-service-executive-hse\/\" target=\"_blank\" rel=\"noreferrer noopener\" title=\"https:\/\/www.irishtimes.com\/tags\/health-service-executive-hse\/\">HSE<\/a> to build the centre to the rear of the protected structure, known previously as the Royal City of Dublin Hospital.<\/p>\n<p class=\"c-paragraph paywall \">Mr Hoey, of Upper Baggot Street, Dublin, is seeking an order quashing ACP\u2019s October 7th decision to grant permission for the development, which is proposed to contain a methadone clinic and drug treatment facility. <\/p>\n<p class=\"c-paragraph paywall \">On Monday, Mr Justice Richard Humphreys granted leave to Oisin Collins SC, appearing for Mr Hoey, to pursue the judicial review proceedings. <\/p>\n<p class=\"c-paragraph paywall \">A litigant must obtain leave, or permission, from the High Court in order to pursue judicial review proceedings.<\/p>\n<p class=\"c-paragraph paywall \">According to his court papers, Mr Hoey claims ACP erred in law by granting the permission for several reasons.<\/p>\n<p class=\"c-paragraph b-it-article-body__interstitial-link\">[\u00a0<a aria-label=\"Open related story\" class=\"c-link\" href=\"https:\/\/www.irishtimes.com\/opinion\/2025\/11\/17\/una-mullally-why-is-the-state-selling-a-big-beautiful-building-on-baggot-st-instead-of-putting-it-to-use\/\" rel=\"noreferrer noopener\" target=\"_blank\">Why is the State selling a beautiful building on Baggot Street instead of using it?Opens in new window<\/a>\u00a0]<\/p>\n<p class=\"c-paragraph paywall \">Among Mr Hoey\u2019s arguments is his claim that ACP failed to recognise the proposed development constitutes a material change of use of the site. <\/p>\n<p class=\"c-paragraph paywall \">It is his case that in recent years, the HSE has considered various uses for the site, including as a housing development for public sector employees or social housing.
