{"id":63332,"date":"2025-04-30T16:09:10","date_gmt":"2025-04-30T16:09:10","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/63332\/"},"modified":"2025-04-30T16:09:10","modified_gmt":"2025-04-30T16:09:10","slug":"uks-first-trans-judge-victoria-mccloud-to-take-gender-ruling-to-european-rights-court","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/63332\/","title":{"rendered":"UK&#8217;s first trans judge Victoria McCloud to take gender ruling to European rights court"},"content":{"rendered":"<p class=\"paragraph_paragraph__iYReA\">The UK&#8217;s first transgender judge said she plans to take the British government to the European Court of Human Rights for its policies on trans rights following a divisive Supreme Court ruling.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Victoria McCloud, a retired High Court judge, said she would bring &#8220;one or more cases&#8221; against Prime Minister Keir Starmer&#8217;s government, accusing it of breaching the European Convention on Human Rights.<\/p>\n<p><a href=\"https:\/\/www.abc.net.au\/news\/2025-04-16\/uk-supreme-court-defines-woman-to-biological-sex\/105185540\" class=\"RelatedCard_link__rsgR9 FullBleedLink_root__lTw_U interactive_focusContext__yRhc_ interactive_defaults__AKxUU FullBleedLink_showVisited__g3Xvz\" target=\"_blank\" rel=\"noopener\">UK court rules a woman is defined by the gender at birth<\/a><\/p>\n<p class=\"Typography_base__sj2RP RelatedCard_synopsis__cFwMW Typography_sizeMobile14__u7TGe Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">The court upheld an appeal by a campaign group on whether transgender women are legally women under equality legislation.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">Earlier this month, Britain&#8217;s top court handed down a landmark ruling that gender and sex were defined by a person&#8217;s sex at birth in the country&#8217;s anti-discrimination laws.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The government has embraced the ruling and said trans women should use men&#8217;s facilities and vice versa, with Britain&#8217;s equality watchdog announcing interim guidance along the same lines.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">McCloud told AFP in a statement that the ruling and official response &#8220;is a serious infringement of the Convention Rights of EU and UK citizens, including in relation to sex, sexual orientation, and privacy&#8221;.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">&#8220;I intend firmly to re-assert my convention rights and other rights under the convention,&#8221; added the former judge, who now works as a litigation strategist.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">The UK Supreme Court ruling also threw into confusion the validity of gender recognition certificates, which allow trans people to gain legal recognition in their chosen gender.<\/p>\n<p class=\"paragraph_paragraph__iYReA\">McCloud has a gender change certificate but according to the ruling she would be defined as a man under the Equality Act, leaving her with &#8220;two sexes at once&#8221;, she alleged.<\/p>\n<p><img decoding=\"async\" alt=\"A young woman holds up a sign that reads &quot;FEMINISM IS THE REFUSAL TO DEFINE A WOMAN&quot; among a crowd of protesters.\" class=\"Image_image__5tFYM ContentImage_image__DQ_cq\"  src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/04\/1746029350_343_0516662b0a8a8b9e353be60057a3995c\" loading=\"lazy\" data-component=\"Image\" data-lazy=\"true\"\/><\/p>\n<p class=\"Typography_base__sj2RP FigureCaption_text__zDxQ5 Typography_sizeMobile12__w_FPC Typography_lineHeightMobile20___U7Vr Typography_regular__WeIG6 Typography_colourInherit__dfnUx\" data-component=\"Typography\">Thousands of trans rights protesters came together in central London for what was billed as an &#8220;emergency demonstration&#8221;.
