{"id":651729,"date":"2025-12-24T03:50:18","date_gmt":"2025-12-24T03:50:18","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/651729\/"},"modified":"2025-12-24T03:50:18","modified_gmt":"2025-12-24T03:50:18","slug":"wales-locals-go-to-court-over-cat-mess-row-as-dad-left-waking-up-with-dread-every-day","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/651729\/","title":{"rendered":"Wales locals go to court over cat mess row as dad left &#8216;waking up with dread every day&#8217;"},"content":{"rendered":"<p>A neighbourly dispute over cat litter in a quiet Welsh street has made its way all the way to the High Court.<\/p>\n<p>Richard Williamson, a new father living in Bedwas in the Caerphilly borough, grew so frustrated with a neighbour&#8217;s cats repeatedly using his garden as their toilet that he decided to take legal action.<\/p>\n<p>The situation became so unbearable that Mr Williamson said he &#8220;wakes with dread each day wondering if there is more cat mess for me to have to clean up&#8221;.<\/p>\n<p>His frustration with Caerphilly council&#8217;s handling of his complaint ultimately led him to seek a judicial review.<\/p>\n<p>The trouble began last year when Mr Williamson first contacted the local authority about cats fouling his property.<\/p>\n<p>His main worry centred on the potential dangers to his newborn child, &#8220;who will soon be playing in our garden&#8221;, according to court documents.<\/p>\n<p>&#8220;As a parent of a newborn who will soon be playing in our garden, I am particularly concerned about the health risks associated with cat faeces,&#8221; he wrote to the council.<\/p>\n<p>Before escalating matters, Mr Williamson had tried sorting things out directly with his neighbour.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" id=\"f8bd9\" data-rm-shortcode-id=\"bed9cc880c278582df808dcd5790d41f\" data-rm-shortcode-name=\"rebelmouse-image\" class=\"rm-shortcode rm-lazyloadable-image \" lazy-loadable=\"true\" src=\"data:image\/svg+xml,%3Csvg%20xmlns='http:\/\/www.w3.org\/2000\/svg'%20viewBox='0%200%205000%203327'%3E%3C\/svg%3E\" data-runner-src=\"https:\/\/www.europesays.com\/uk\/wp-content\/uploads\/2025\/12\/cat-stock.jpg\" width=\"5000\" height=\"3327\" alt=\"Cat (stock)\"\/><\/p>\n<p>A neighbourly dispute over cat litter in a quiet Welsh street has made its way all the way to the high court<\/p>\n<p> | <\/p>\n<p>GETTY<\/p>\n<p>He emailed his formal complaint to Caerphilly council in October 2024 after those attempts proved unsuccessful.<\/p>\n<p>Caerphilly council did look into the matter, but their investigation took a rather different direction than Mr Williamson had hoped.<\/p>\n<p>Officials concluded that cats aren&#8217;t subject to the same roaming regulations that apply to dogs or livestock.<\/p>\n<p>A council representative visited the cats&#8217; owner to verify they had proper litter trays available at home.<\/p>\n<p>The official was &#8220;satisfied that there are adequate provisions for the cats&#8221; at the property.<\/p>\n<p>The council also noted that keeping cats indoors when they&#8217;re used to going outside could actually harm their welfare.<\/p>\n<p>However, what the authority didn&#8217;t properly examine was whether the fouling might constitute a statutory nuisance.<\/p>\n<p>Judge Jarman KC, ruling at Cardiff High Court, found that the council had missed the central point entirely.<\/p>\n<p>The &#8220;essence of the challenge&#8221; was that officials had focused on how the cats were kept and their common law right to roam, rather than considering whether the mess &#8220;amounted to deposits which were prejudicial to health&#8221;
