{"id":674542,"date":"2026-01-05T02:50:14","date_gmt":"2026-01-05T02:50:14","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/674542\/"},"modified":"2026-01-05T02:50:14","modified_gmt":"2026-01-05T02:50:14","slug":"maduro-indictment-attempts-to-link-venezuelan-leader-to-tren-de-aragua-nicolas-maduro","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/674542\/","title":{"rendered":"Maduro indictment attempts to link Venezuelan leader to Tren de Aragua | Nicol\u00e1s Maduro"},"content":{"rendered":"<p class=\"dcr-130mj7b\">The superseding federal indictment unsealed against <a href=\"https:\/\/www.theguardian.com\/world\/venezuela\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Venezuela<\/a>\u2019s leader <a href=\"https:\/\/www.theguardian.com\/world\/nicolas-maduro\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Nicol\u00e1s Maduro<\/a> on Saturday immediately after his capture closely resembles 2020 charges against him but has several important new twists: the new indictment appears to embrace controversial claims made by the Trump administration about a Venezuelan street gang, <a href=\"https:\/\/www.theguardian.com\/world\/2025\/apr\/27\/what-is-tren-de-aragua-trump-venezuela\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Tren de Aragua<\/a> (TdA).<\/p>\n<p class=\"dcr-130mj7b\">Maduro was <a href=\"https:\/\/www.theguardian.com\/us-news\/2026\/jan\/03\/trump-venezuela-oil-industry\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">captured by US forces<\/a> early on Saturday and ferreted out of the country after a series of explosions in the Venezuelan capital. The operation has drawn widespread international criticism and outrage from Democrats on Capitol Hill.<\/p>\n<p class=\"dcr-130mj7b\">One of Maduro\u2019s five<strong> <\/strong>co-defendants is the alleged founder of the gang, H\u00e9ctor Rusthenford Guerrero Flores, who was indicted separately two weeks ago.<\/p>\n<p class=\"dcr-130mj7b\">Though the indictment doesn\u2019t allege Maduro ever met Guerrero Flores, it builds the case in court for what critics say are Donald Trump\u2019s exaggerated and unsubstantiated <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/nov\/01\/tren-de-aragua-trump-organized-crime\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">allegations<\/a> about TdA. Trump has repeatedly insisted Venezuela\u2019s government sent the gang to the US intentionally as a form of guerrilla warfare, to commit crimes and spread chaos, and has used the claims to further his foreign policy and his mass deportation tactics.<\/p>\n<p class=\"dcr-130mj7b\">The Trump interest in TdA dates <a href=\"https:\/\/www.theguardian.com\/us-news\/2024\/oct\/11\/trump-aurora-colorado-venezuelan-immigrants\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">back in 2024<\/a>, when members of the gang were accused of taking control of an apartment building in Aurora, Colorado. At the time law, enforcement told reporters they saw TdA as a vicious group but not as a major international threat.<\/p>\n<p class=\"dcr-130mj7b\">Still, when Trump, on his first day in office, signed an executive order to designate drug cartels and other groups as \u201cforeign terrorist organizations\u201d, he specifically included TdA.<\/p>\n<p class=\"dcr-130mj7b\">The gang became a central part of the administration\u2019s<strong> <\/strong>rationale to try to launch deportations without hearings, by invoking a 200-year-old law called the <a href=\"https:\/\/www.theguardian.com\/us-news\/2025\/mar\/16\/alien-enemies-act-explainer-can-trump-apply-a-wartime-law-to-deport-gang-members\" data-link-name=\"in body link\" target=\"_blank\" rel=\"noopener\">Alien Enemies Act<\/a>, which addressed expelling people during wars, or invasions, or a \u201cpredatory incursion\u201d. \u201cI find and declare,\u201d wrote Trump in March, \u201cthat TdA is perpetrating, attempting, and threatening an invasion or predatory incursion against the territory of the United States.\u201d<\/p>\n<p class=\"dcr-130mj7b\">The street gang was an invading force sent by Maduro, his executive order concluded, so under the law TdA members \u201care subject to immediate apprehension, detention, and removal\u201d, without any court action necessary at all. The deportation of purported TdA members, with no court oversight, to El Salvador\u2019s Cecot prison has been one of the most contested parts of Trump\u2019s deportation efforts.<\/p>\n<p class=\"dcr-130mj7b\">Those deportations<strong> <\/strong>have since been blocked by courts.<\/p>\n<p class=\"dcr-130mj7b\">Intelligence from inside the US ran counter to all of Trump\u2019s claims about Tren de Aragua. A national intelligence memorandum dated in April said \u201cthe Maduro regime probably does not have a policy of coordinating with TDA and is not directing TDA movement to and operations in the United States\u201d.<\/p>\n<p class=\"dcr-130mj7b\">The new indictment doesn\u2019t spell out precisely what Maduro\u2019s connection would be to TdA. Instead, it says Maduro and others \u201cpartnered with narco-terrorists\u201d, including TdA.<\/p>\n<p class=\"dcr-130mj7b\">A local police detective who has investigated TdA said the gang was probably the most brutal he\u2019d come across but said based on gang members he had interrogated, they had not been directed by the Venezuelan government or even their own leadership to come to the US.<\/p>\n<p class=\"dcr-130mj7b\">One former Drug Enforcement Administration official who had investigated the Venezuelan regime said he was unaware of any personal connection between Maduro and TdA, but said there was solid evidence of Maduro\u2019s profiting from the cocaine trade.<\/p>\n<p class=\"dcr-130mj7b\">\u201cTdA has been part of the Trump narrative since the beginning of the campaign,\u201d Adam Isacson of the Washington Office on Latin America said. \u201cReally it\u2019s more of a political change in this indictment.
