{"id":682381,"date":"2026-01-08T14:27:20","date_gmt":"2026-01-08T14:27:20","guid":{"rendered":"https:\/\/www.europesays.com\/uk\/682381\/"},"modified":"2026-01-08T14:27:20","modified_gmt":"2026-01-08T14:27:20","slug":"eu-kicks-off-2026-with-new-digital-asset-tax-reporting-rules","status":"publish","type":"post","link":"https:\/\/www.europesays.com\/uk\/682381\/","title":{"rendered":"EU kicks off 2026 with new digital asset tax reporting rules"},"content":{"rendered":"<ol class=\"inline-flex items-center space-x-1\">\n<li class=\"inline-flex items-center\"><a href=\"https:\/\/coingeek.com\" class=\"inline-flex items-center\" target=\"_blank\" rel=\"noopener\">Homepage<\/a><\/li>\n<li class=\"inline-flex items-center\"> &gt; <\/li>\n<li class=\"inline-flex items-center\"><a href=\"https:\/\/coingeek.com\/news\/\" class=\"inline-flex items-center\" target=\"_blank\" rel=\"noopener\">News<\/a><\/li>\n<li class=\"inline-flex items-center\"> &gt; <\/li>\n<li class=\"inline-flex items-center\"><a class=\"inline-flex items-center\" href=\"https:\/\/coingeek.com\/news\/category\/business\/\" target=\"_blank\" rel=\"noopener\"><br \/>\n                                Business<br \/>\n                       <\/a><\/li>\n<li class=\"inline-flex items-center\"> &gt; <\/li>\n<li class=\"inline-flex items-center\">EU kicks off 2026 with new digital asset tax reporting rules<\/li>\n<\/ol>\n<p>The <a href=\"https:\/\/coingeek.com\/eu-under-pressure-to-update-cbdc-tokenization-regulation\/\" target=\"_blank\" rel=\"noreferrer noopener\">European Union<\/a>\u2019s new digital asset tax reporting directive took effect on January 1, mandating crypto asset service providers (CASPs) to report detailed user and transaction data to national tax authorities by July 1, 2026.<\/p>\n<p>\u201cThe decentralised nature of crypto-assets has made it difficult for EU countries\u2019 tax administrations to ensure tax compliance,\u201d <a href=\"https:\/\/taxation-customs.ec.europa.eu\/taxation\/tax-transparency-cooperation\/administrative-co-operation-and-mutual-assistance\/directive-administrative-cooperation-dac\/dac8_en#international-impact\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">said<\/a> the European Commission explainer. \u201cThe Directive lays down the rules and procedures for exchanging information on crypto-asset users by implementing due diligence procedures and reporting rules for operators active in crypto-asset transactions and their users.\u201d<\/p>\n<p>The directive, also known as DAC8, was adopted by the bloc on October 17, 2023, and all 27 EU countries had until December 31, 2025, to transpose it. The provisions took effect as of January 1, with 2026 being the first reporting year under the new rules.<\/p>\n<p>DAC8 provides for the automatic exchange of information on \u2018crypto assets\u2019 between EU countries. This involves requiring EU countries to obtain information from the reporting CASPs \u201cand exchange that information with the EU country of residence of the taxpayer\/investor on an annual basis.\u201d<\/p>\n<p>The information must be exchanged with the the \u201ctax authorities of the EU country of residence of the non-resident investor\u201d within nine months of the end of the reporting year. Thus, the <a href=\"https:\/\/coingeek.com\/exchanges\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">exchanges<\/a> relating to the first reporting year must take place by September 30, 2027.<\/p>\n<p>The directive encompasses a broad scope of \u2018crypto-assets\u2019, building on the definitions outlined in the <a href=\"https:\/\/eur-lex.europa.eu\/EN\/legal-content\/summary\/european-crypto-assets-regulation-mica.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Markets in Crypto-Assets (MiCA)<\/a> regulation, which includes decentralized tokens, stablecoins, and certain <a href=\"https:\/\/coingeek.com\/bitcoin101\/what-is-nft-the-rise-of-non-fungible-tokens-in-cryptocurrency\/\" target=\"_blank\" rel=\"noreferrer noopener\">non-fungible tokens<\/a> (NFTs).<\/p>\n<p>\u201cThe inherent cross-border nature of crypto-assets requires strong international administrative cooperation to ensure effective tax assessment and collection of the related income and capital gains,\u201d said the Commission. \u201cThe Directive aims to strengthen the overall legal framework on the automatic exchange of information (AEOI) to fight tax fraud and combat tax evasion and tax avoidance by enlarging its scope to cover crypto-assets.\u201d<\/p>\n<p>The rules are based on the <a href=\"https:\/\/coingeek.com\/oecd-vast-majority-of-digital-asset-centers-join-global-tax-rules\/\" target=\"_blank\" rel=\"noreferrer noopener\">Organisation for Economic Co-operation and Development<\/a>\u2019s (OECD) <a href=\"https:\/\/www.oecd.org\/en\/topics\/tax-transparency-and-international-co-operation.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Crypto-Asset Reporting Framework (CARF)<\/a>, a global tax transparency initiative <a href=\"https:\/\/www.oecd.org\/en\/publications\/international-standards-for-automatic-exchange-of-information-in-tax-matters_896d79d1-en\/full-report.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">introduced<\/a> in June 2023 to set a standard for tax reporting and improve the exchange of information between countries on digital asset transactions, to combat tax evasion and avoidance.<\/p>\n<p><strong>Increasing global agreement on CARF<\/strong><\/p>\n<p>In December, the OECD\u2014a global institution that promotes policies to improve world trade and economic progress\u2014<a href=\"https:\/\/www.oecd.org\/content\/dam\/oecd\/en\/networks\/global-forum-tax-transparency\/crypto-asset-reporting-framework-monitoring-implementation-update-2025.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">published<\/a> a report on the implementation of its global digital asset tax reporting standards, in which it stated that 75 jurisdictions have now committed to the rules, including \u201cthe vast majority\u201d of digital asset centers.<\/p>\n<p>As part of the CARF, all signatory countries agreed to an AEOI between tax authorities, in relation to accounts maintained by financial institutions.<\/p>\n<p><a href=\"https:\/\/www.oecd.org\/content\/dam\/oecd\/en\/networks\/global-forum-tax-transparency\/commitments-carf.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">At the time of writing<\/a>, 76 jurisdictions have made a commitment to implementing CARF, among them many of the world\u2019s top digital asset jurisdictions, by <a href=\"https:\/\/www.chainalysis.com\/blog\/2025-global-crypto-adoption-index\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">adoption rate<\/a>, including the U.S., the United Kingdom, Brazil, Indonesia, Japan, and the 27 nations of the EU.<\/p>\n<p>Watch: Breaking down solutions to blockchain regulation hurdles<\/p>\n<p> frameborder=&#8221;0&#8243;
